WHEREhS, in answer to the petition of the owners of Lot I, Gerard Tract, map filed August 8, 1916 in Book of Naps and Plats, Vol.. 8, Page 62, San Joaquin County Records, and in accordance with an agreement made between said owners and the City Council of the City of Lodi providing for an exchange of lands whereby Holly Drive will be opened frm Loma Drive, westerly to the west line of said Lot 1, this City Council did, on the 17th day of May, 1950, pass and adopt its ResolutionNo. 1527 thereln declaring the intention of said City Council to vacate that portion of Lockeford Avenue * delin- eated on the official map of Gexard Tract as lying between the northerly projection of the east and west lines of said Lot 1, and, HEEREAS, the City Planning ccamnission of the City of Lodi has approved and reconnuended that this portion of Zockeford Avenue be vacated, and, WHEIUBS, notice of such intention has been regularly published ad posted in time, form and mannerrequired by law as appears from the affidavit of June Brodehl, principal clerk of the publisher of The Lodi Times, the weeklynewspaper of general circulation printed and published in this City in which said Resolution Noo 1527 was published on May 26th and June 2nd., 1950 and frcao the affidavit of Vilmer Zieman, who, at the direction of the Saperintendent of Streets of the City of Lodi, personally posted Notices of Stmet Vacation on and along the portion of street proposea to be vacated on the 27th day of May, 1950, and, WHEREiW, said Resolution and said notices, publishedand posted as aforesaid, gave public notice of a hearing for the reception of evidence, either for or against the vacation of this portion of a public street, to be held Wednesday, June 7, 1950 at the hour of 8:OO occlock P.M. in the City Council Chambers, City Hall, Lodl, California, and, Ord.421 - 2 WHEEWS, at that time and place, a public hearing on said proposed street vacation was held and conducted by this City Council, at which hearing no persons appeared to be heard or presented evidemce against said proposed vacation, therefore, TEE CITY CCIUNCIL OF THE CITY OF LODI DOE§ 0R.WIN AS FCIf;GOPJS: Section 1.
