HomeMy WebLinkAboutOrdinances - No. 413In the City Council City of Lodi Lodi, California ORDINANCE NO. 413 ORDER VACATING THE PUBLIC UTILITY EASE- MENT IN LOT 13 OF "FLORA STREET TRACT". NBEREAS, This City Council of the City of Lodi, acting on the petition of Herbert G. Hentschel, owner of Lots 13 and 14 of "Flora Street Tract" in said City, did on the 1st day of March, 1950, pass and adopt its Resolution of Intention No. 1512 therein declaring the intention of said City Council to vacate the public utility easement in said Lot 13 as no longer required for present or prospective use for the purposes for which it was intended, and, BVHEREAS, Said Resolution of Intention was published by printing in The Lodi Times, a newspaper of general circulation printed and published in the City of Lodi and notices of passage thereof were properly posted along said easement as evidenced by affidavits on file and of record in the office of the City Clerk of this City, said resolution and said notices, among other things giving notice that the City Council of the City of Lodi had fixed Wednesday, the 5th day of April at the hour of 8:00 p.m. and the City Council Charrrbers, City Hall, Lodi, California, as the time and place when and where interested persons might appear and offer evidence either for or against the vacation herein contemplated, and, . Ord.413 - 2 WHEREAS, At that time and place, no persons appeared in opposition to the vacation of said easement, and, WHEREAS, This City Council finds and determines that said easement does not ROW and will not be re,quired to serve any pub- lic use present or prospective, therefore, THE CITY COUNCIL OF THTE CITY OF LODI DOES ORDAIE AS FOLLOWS: Section 3.. The public utility easement shown on the official map of "FLORA STREET TRACT", filed March I, 1920, in Book of Maps, Vol, 9, Page 74, San Joaquin County Records as extending over the Westerly five (5) feet of' Lot Thirteen (131, therein, is hereby ordered vacated and abandoned, said easement not having been used for over five years next preceding the adoption of this ordinance and serving no present or prospective public use, Upon the effective date of this ordinance, said easement shall revert to the owner of said Lot 13 free of all rights of the public thereto or therein. Section 2, This ordinance shall be published one time in The Lodi Times, the official newspaper of the City of Lodi and shall take effect thirty days from the date of its passage, The City Clerk shall hause a certified copy of this order to be recorded in the office of' the County Recorder of San Joaquin County.
