HomeMy WebLinkAboutOrdinances - No. 409In the City Council City of Lodi Lodi, California ORDINANCE NO. 4-09 APPROVING TI33 ANN'EXATIOI'T OF "HORTON AD- DITION" TO TH'X CITY OF LODI, CALIFORNIA IaJTIEREAS, this City Council did on the 15th day of February, 1950, pass and adopt its Resolution No. 1509, therein declaring the intention of said City Council to annex certain uninhabited territory in Sgn Joaquin County, contiguous to the City of Lodi, hereinafter described, pursuant to proceedings rt had and to be had conforming to the provisions of the Annexation of Uninhabited Territory Act of 1939", as amended, designatin3 the lands comprising the territory proposed to be annexed as '*XO??TOR ADDITION" as an appropriate designation for identifi- cation, and, WHEREAS, said Resolution was published in time, form mdi manner as provfded by law as evidenced by the aff'idavlt of the ploincipal clerk of the publishem of The Lodi Times, a weekly newspaper of general circulation printed and published in this City, on file and of record in the office of the City Clerk of the Crty of' Lodi; said Resolution No. 1509, among other things giving notice that this City Council had designated Wed- nesday, the 15th day of March, 1950, at the hour of 8:OO p.m. and the City Council Chambers, City Hall, Lodi, California -1 - (Ord. No. 4-09] P as the time and'place when and where writtell protests or objec- tions to said annexation would be recelved, heard and considered, and , WEREAS, at said time and place, this City Council did announce that it was then ready to receive and hear all such protests or objections and no protests, written or oral were presented, and, therefore this City Council did then and there acquire jurisdiction to annex said territory to the City of Lodi, CalFfornia; now therefore: TRE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS : Section 1. The annexation of the following descpibed uninhabited territory in S2n Joaquin County, California, con- tiguous to the City of Lodi designated "HORTON ADDITION" is hereby approved and the same shall be, from the effective date of this ordinance, annexed to and made part of the City of Lodi, to wit: BeginnFng at a point on the east line of State Highway 4 (US 99-50), commonl-y known as Cherokee Lane, where said east lZne is intersected by the south line of the Northwest Quarter of Section 7, Township 3 North, Range 7 East, 13. D. 3. tc 12. (said point being 59.62 feet easterly from the Southwest corner of said Quarter Section), run- ning thence South 87" L1Zf East along said. Quarter line a distance of Three Hundred Seventy (370) feet; -2- (Ord. No. 4C9) thence Northerly, pwallel to the East line of said Highway 4- and 370 feet distant therefrom to a point on the North line of Section 7, T3N, RTE; thence.. Westerly along said section line to the section corner conqon to Sections 6 and 7, Townshlp 3 North, Range 7 East and Sections 1 and 12, Town- ship 3 North, Range 6 East; thence continuing Westerly on the North line of Section 12, T3N, R6E to the West line of State Hightvay 4; thence Southerly on and along said West line to its ' intersection with the South line of the Xortheast Quarter of said\ Section 12; thence South 87O !12! East on said Quarter Section line and the South llne of the Northwest Quarter of' Section 7, T3N, Rp 99,62 feet, nore or less, to the East line of State Highway 4 and the point of beginning of the description of the tract of land herein pro- posed for annexation, containing 23 acres, More or less, exclusive of public roads. Section 2. Upon the effective dete of this ordinance, the City Clerk shall make and transmit to the Secretary of State of' the State of California, a certified copy thereof', giving the date of' its passage, adoption and appsoval and he shall also comply with such statiltes as may be appl, :cable hereto to effect the purpose hereof'. -3 - (Ord. ?To. 4-09) Section 3. This ordinance shall be published one time in The Lodi Times, a weekly newspz9er published in this City and shall be in force and take effect at the time and Approved thls dLlb day of April, 1950.
