ORDINANCE NO. 406
APPROVING THE ANNEXATION OF “FAIRMONT PARK ADDITION” TO THE CITY OF LODI, CALIFORNIA
WHERIGAS, This City Council did, on the 21st day of December,
1949, pass and adopt its Resolution No. 1503 therein declaring
the intention of said City Council to annex certain uninhabited
territory in San Joaquin County, hereinafter described, contiguous
to this City,pursuant to proceedings had and to be had conforming
to the provisions of the “Annexation of Uninhabited Territory Act
of 1939”, as amended, as petitioned by the owner of all of the
lands comprising said territory, designating said territory “FAIR-
MONT PARK ADDITION” as an appropriate designation for identification,
and,
WHF,REAS, Said Resolution was published in time, form and
manner as provided by law as is evidenced from the affidavit of
the principal clerk of the publishers of “he Lodi Times, a weekly
newspaper printed and published in this City, on file and of record
in the office of the City Clerk of the City of Lodi, aaid RssoXuOion,
among other things giving notice that this City Council had desig-
nated Wednesday, the 18th day of January, 1950, at the hour of
8:OO o’clock p.m. and the City Council Chmbers, City Hal&, Lodi,
California, a8 the time and place when and where written protests
or objections against said annexation would be received, heard and
considered, and,
WHEREAS, At said time and place, this City Council did announce
that it was then ready to receive and hear all such protests or
objections, and no protests or objections, written or oral, were
presented, and, therefore, this City Council did then and there
acquire jurisdiction to annex said territory to the City of Lodi,
California, now therefore,

THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS:
Section 1. The annexation of the following described terri-
tory in San Joaquin County, California, designated "FAIRMONT PARK
ADDITION" is hereby approved, and the same shall be, from the
effective date of this ordinance, annexed to and made Part of the
City of Lodi, to wit:
A PORTION OF THE NORTHEAST ONE: QUARTER OF SECTION
2, TOWNSHIP 3 NORTH, RANGE 6 EAST, M. D. B. & Ma AND OF
LOTS 1, 2, 3, 4 AND 5 IN BLOCK 13 OF HUTCHINIS ADDITION
TO LODI (MAP FILED APRIL 10, 1897 IN VOL. 1, PAGE 58,
BOOK OF MAPS AM) PLATS, SAN JOAQUIN COUNTY RECORDS):
BEGINNING AT THE SOIJTHWEST CORNER OF THE NORTHEaST
QUARTER OF SECTION 2, TOWSHIP 3 NORTH, RANGE 6 EAST
AND RUNNING THENCE TI 1' 10' W ALONG THE WEST LINE OF SAID
QUARTER 409.0 FEET TO A POINT AT THE INTERSECTION OF SAID
WEST LIKE WITH THE SOUTHERLY LINE OF WEST LOCKEFORD STREET;
THENCE S 86' 59&1 E ALONG SAID SOUTHERLY LINE 432.6 FEET
TO AN IRON ROD AT A CORNER OF THE PRESENT LODI CITY BOUNDARY
LIKE; THENCE RUNWING ALONG THE PRESENT CITY B0"DARY LINE
FOR TRE FOLLOWING FIVE COURSES AND DISTAMCES: S 30 18t f
385.45 FEET TO AN IRON ROD ON T~ NORTH LSNE OF LOT 1,
HUTCHIN'S ADDITION, THIS ROD BEING N 89O 481 E 401.5 FEET
FROM THE NORTHWEST CORNER OF SAID LOT 1; THENCE s 00 3791
E 287.4 FEET TO A PIPE; THENCE S 89' 5631 E 573.4 FEET TO
AN IRON ROD ow THE EAST Lrh OF LOT 5 IN SAID HUTCHIN'S
ADDITION; THENCE S 1' 121 E ALONG SAID EAST LINF, 629.5
FEET TO A POINT 546.0 FEET PIORTfkRLY FROM THE SOUTH LINE
OF SAID LOT 5 (BEING ALSO THE CENTW LINE OF WEST OAK
STREET); THENCE H 89' 56%~ W AND PARALLEL TO SAID SOUTH LINE
981.4 FEET TO A POINT ON THE WEST LINE OF SAID LOT 3; THENCE

HUTCHINIS ADDITION 915.1 FEET TO THE POINT OF BEGIHSNING,
CONTAINING 20.6 ACRES, MORE OR LESS.

Section 2. Upon the effective date of this ordinance, the
City Clerk shall make, certify and transmit a certified copy thereof
to the Secretary of State of the State of California, giving the
date of its passage, adoption and approval, and he shall also com-
ply with such other statutes as may be applicable hereto to effect
the purposes hereof.
Section 3. This ordinance shall be published one time in
The Lodi Times and shall be in force and take effect at the time
and in the manner herein and by law provided.
