ORDINANCE NO. 403 APPROVING TKE ANNEXATION OF CERTAIW UNINHABITED TERRITORY IN SAN JOAQUIN COUNTY, DESIGNATED AS "M.F.AERS ADDITION NO. I", TO THE CITY OF LODI WEREAS, In answer to a petition signed. by the owner of not less than one-fourth of the area and representing in excess of one-fourth of the assessed valuation of the uninhabited terri- tory in San Joaq.uin County, California,/contiguous to this Citjr hereinafter described, requesting that said territory he annexed to the City of Lodi, this City Council did on the 7th day of December, 1949, pass and adopt its Resolution No. 14-94 declarin? therein its intention to annex said territory to the Citv of Lodi pursuant to proceed- ings had and to be had conforming with the provisions of the "Annexation of Uninhabited Territory Act of 1939'' desisnating said territory *'M.F.AYBRS ADDITTOIT NO. 1" as an appropriate name therefor, and, WEEREAS, The City Planning Commission of the Ciky of Lodi did, on the 21st day of November, 1949, approve the annexa- tion of said territory and so report to this City Council, and, WHEREAS, Said Resolution No. 1496 was published. in full in The Lodi Times for two consecutive weeks, as is evidenced by affidavit on file and of record in the office of the City Clerk of this City, prior to the date of public hearing of objections to said annexation, noticed therein, and, -1- WHERZAS, Said Resolution No. 11~96, amonp: other thin,ys, .-, pave public notice that owners of real propertv affected bv said annexation, miplht f'i1.e written protests or objections theretao up to the hour of' 8:OO o'clock p.m. of Wednesday, December 21, 1949, with the Clerk of this City Council, which protests would be read, heard and cogsidered by this City Council, in the City Council Chambers, City Hall, Lodi, California, at said time, and, WHEREAS, At that time and place, this City Council did, in open public meetin?, declare that it was then ready to receive and hear any and all protests or objections to this annexation, and no protests or objections, written or oral were received or presented and by reason thereof, this City Council did there and then acnui.re jurisdiction to adopt; this ordinance and to annex said territoT to the Clty of Lodi, now therefore, THE CTTY COTPNCIL OF T_HE CITY OF LOnI DOFJS ORDAIN AS FOLLOWS : Section I, The annexation of the following described contiguous uninhabited terrZtorg in San Joaquin County Caiifornia to the City of Lodi desienated "M.F,AYERS ADTITTIOR NO. 1" is hereby approved and the same is hereby declared to be annexed to and made part of said City of Lodi, to wit: LOT NINE (9) AS SAID LOT IS D'EIJNEATED AND SO DESIGNATED ON Ti33 OFFICIAL MAP OF "GERARD TRACT" FILE33 AUGUST 8, 1916 IN BOOK OF MAPS, VOL. 8, PAGE 62, SAT! JOAQTJII? COUNTY RECORTfS, BOUNI)m WEST BY WOODLAKE TRACT, NORTH BY SOUTHERN PACIFIC CON- PAW'S WOODBRIDGE BRANCH RIGHT OF WAY, EAST BY THE WEST LINE OF LOT 10 GEXARD TRACT AND SOUTI-I BY TKE CENTER LINE OF LAKE STREET, CONTAINTXG 3.19 ACRES. -2- Secttnn 2. TJpon the effective date of this ordinance, the City Clerk shall make, certify and transmit a certified copy tkiereof to the Secretary of State of the State of Califor- nia, pivine the date of its passage, adoption and approval and he shall also CornDly -- with the provisions of such statutes as may be anplicable hereto to effect the purposes hereof.
