HomeMy WebLinkAboutOrdinances - No. 398In the City Council, City of Lodi, Lodi, California I ORDINANCE NO. 398 APPROVING THE ANNEXATION OF GRANT AVENUE ADDITION TO THE CITY OF LODI, CALIFORNIA WHEREAS, this City Council did, on the 17th day of August, 1949, pass and adopt its Resolution No. 1488 declaring its intention to annex certain contiguous uninhabited territory in the County of San Joaq-uin to the City of Lodi pursuant to proceedings to be had in conformance with the provisions of the "Annexation of Uninhabited Territory Act of 1939" as amended, stating in said resolution the reasons for initiating such pro- ceedings, and designating said territory "GRANT AVENUE ADDITION" as an appropriate designation for identification, and, bMEREAS, said Resolution No. 1488 was published in time, form and manner as provided by law as is evidenced from the affidavit of the principal clerk of the publishers of The Lodi Times, a weekly newspaper printed and published in the City of Lodi, on file and of record in the office of the City Clerk of said City, the said Resolution No. 1488, among other things, containing a notice that this City Council had designated Wed- nesday, the 7th day of September, 1949 at the hour of 8:OO P.M. and the City Council Chambers, City Hall, Lodi, California as the time and place when and where written protests or objections against said annexation would be received, heard and considered, and, -1- WHEREAS, at said place and time, this City Council did announce that it was then ready to receive and hear the object- ions of owners of real property in the territory proposed for annexation and no protests or objections, either written or oral were presented, and, therefore, this City Council did then and there acquire jurisdiction to annex said territory to the City of Lodi, now therefore, THE CITY COUNCIL OF THE CITY OF LODI DOES ORDAIN AS FOLLOWS: Section 1. The annexation of the following described terri- tory in San Joaquin County, California, designated "GRANT AVENUE ADDITION", is hereby approved and the same shall be, from the effective date of this ordinance, annexed to and made part of the City of Lodi , to wit: BEGINNING ON THE INTERSECTION OF THE SOUTHERLY CONTINUATION OF THE EAST LINE: OF GRANT AVENUE IN BURR'S ADDITION TO LODI WITH THE NORTH LINE OF THE SIXTY'FOOT RIGHT OF WAY OF THE WOODBRIDGE BRANCH RAILROAD OF SOUTHERN PACIFIC COMPANY, ( FOF!.PEI),LY SAN JOAQUIN AND SIERRA NEVADA RAILWAY ), AND RUNNING THENCE NORTH 670 00' ANIS ALONG SAIL3 NORTH RIGHT OF WAY LINE SIX HUNDEBU NINETY AND TW"TY - TWO HUNDREDTHS (690.22) FEET TO THE INTERSECTIOK OF THE SAME WITH A LINE DRAWN PARALLEL TO AND SEVEN AND ONE-HALF (7.5) FEET IRdESTERLY FROM THE EAST LINE OF TRACT SIX (6) OF BUER'S AUDITION'TO LODI , THZNCE NORTH 00 297 WEST ON AND ALONG SAID PAIZALLEL LINE EIGHT HUNDRED SEVENTY FIVE AW THIRTY FIVS HUNDREDTHS (875.35) FEET TO A POINT THIRTY (30) FEET SOUTHERLY FROM THE CENTER LINE OF LOUIE AVENUE, ALSO IN BURR'S ADDITION LINE OF LOUIE AVENUE SIX HUNDRED THIRTY THREE AND TE~J HUNDFZDTHS (633.1) FEET TO A POINT ON THE EAST LINE OF GRANT AVENUE, THENCE SOUTH Oo 29f EAST OM AND ALONG THE EAST LINE OF GRANT AVENUE AND ITS SOUTHERLY CONTINUATION TO ITS INTERSECTION WITH THE NORTH LINE OF THE RIGHT OF WAY OF SOUTHERN PACIFIC CONPAMY + S WODBRIDGE BRANCH RAIL- ROAD FIRST MENTIONED HEREIN AND THE POINT OF BEGINNING OF THE BOUNDARY LINE BESCRIPTION OF THE TRACT OF LANO PRO- POSE~ TO BE ANNEXED WHICH SAID TRACT CONTAINS 13.45 ACRES, MORE OR LESS, EXCLUSIVE OF PUBLIC STREETS. Section 2. Upon the effective date of this Ordinance, the City Clerk shall make, certify and transmit a certified copy thereof to the Secretary of St'ate of the State of California, giving the date of its passage, adoption and approval and he shall also comply with such other statutes as may be applicable hereto to effect the purposes hereof.
