HomeMy WebLinkAboutOrdinances - No. 358ORDIrJmm NO. 358 -U O?tDIbIANCX &TR(I'TlNG THT -U!&%IyATlON OF LODI, IN CALIFOR!TIA LAUE STRE";T ADDITION TO THE CITY OF W'fIEJBd, in answr to a petition signed by the owners of not less than one-fourth of the area and reprosenting not less than one- fourth of the assessed value of the territory hereinafter described, the City Council did, on the 22x16 day of October, 1947, pass and adapt its Resolution No. 1375 declaring it to be the intention of said City Council tc annex to the City of Lodi certain uninhabited territory contiguous to said City, in accordance with the proceedings had and to be had pursuant to the provisions of the "Amexation of Uninhabited Territory Act of 1939" as amended, said territory for the purposes hereof to be desiw-ated for identification as Take Street Addition" and particulerly bounded and described as hereinafter set forth, and, BHEIEAS, due publication of said Resolution 'lo. 1375 was had in time, form and iranner as required by law is evidenced by affi- davit on file and of record in the office of the City Clerk of t:lis City, End, TElEFWiS, a%ong other things the said Resolution No. 1375 Qave public notice that owners of real property affected by said annexation might file written protests against said annexation up to the hour of 8:OO o'clock P. Pi:. of Wednesday, 3ovember 19, 1947 with this City Council, which protests would be received and considered at said day and hour in the City Council Chambers, City Hall, Lodi, Calif- ornia, and, !EERJZ&S, at that place and on that day and hour this City Council did in open regular meeting declare thaC is was then ready to receive and hear any and all protests or objections against the annexa- tion of said territory to the City of Lodi and no protests either written or oral were presented, and, by reason that no protests were received, this City Council did then and there acquire jurisdiction to mnex said territory to the City of Lodi, now therefore, The City Council of the City of Lodi does ordain as follorus: Section 1. The annexation of the follcwing described unin- habited territory contiguous to said City of Lodi, Comty of San Joaquin, State of California is hereby approved and is hereby declared to be annexed to and made a part of said City, to-wit: Lots Sixteen (16) and Seventeen (17) as said lots are delineated and so designated on the official ma2 of "Gerard Tract" Map filed August 8, 1916 in Vol. 8, Page 62 of Maps and Plats Snn Joaquin County Records, excepting the South Six (6) f -,et of the West, one acre of said Lot 17. Section 2. Upon the effective date of this ordinance, the City Clerk shall make, certify and transnit a certified copy hereof to the Secretary of State of the State of California, giving the date of its passage, adoption and a?_oroval and he shall also comely with such other statutes as may be applicable hereto.
