OFDINANCE NO. 349
AN ORDINANCE APPROVING TI32 ANNEXATION OF
"VALNUT ORCHARD TO THX CITY OF
WDI, CALIFORMIA,
WHER?3AS, in answer to a petition signed by the owners of not less than one-
fourth of the area and representing not less than one-fourth of the assessed
value of the territory hereinafter described, the City Council did, on the 7th
day df May, 1947, pass and adopt its Resolution No. 1317 declaring it to be the
intention or said City Council to annex to the City of Lodi certain uninhabited
territory contiguous to said City, in accordance with the proceedings had and
to be had pursuant to the provisions of the llAnnexation of Uninhabited Territory
Act of 1939'* as amended, said territory for the purposes hereof to be designated
for identification as Walnut Orchard Additionn and particularly bounded and des-
cribed as hereinafter set forth, and,
WHEREAS, due publication of said Resolution No. 1317 was had in time, form
and manner as required by law is evidenced by affidavit on file and of record in
the office of the City Clerk of this City, and,
that

THEBEAS, among other things the said Resolution No, 1317 gave public notice
owners of real property affected by said annexation might file written pro-
s against said annexatton up to the hour of 8:OO o'clock P, Id. of Wednesday,
May 28, 1947 with this City Council, which protests would be received and con-
sidered at said day and hour in the City Council Chambers, City Hall, Lodi, Cali-
fornia, and,

open regular meeting declare that it was then ready to receive and hear any and
all protests or objections against the annexation of said territory to the City
of Lodi and no protests either written or oral were presented, and, by reason
that no protests were reoeived, this City Council did then and there acquire
jurisdiction to amex said territory to the City of hdi, now therefore,
The City Council of the City of Lodi does ordain as follows:
Section 1. The annexation of the following described uninhabited territov
contiguous to said City of Lodi, County of San Joaquin, State of Cdifomiais
hereby approved and is hereby declared to be annexed to and made a part of said
City, to-yci-t:
A portion of the North one-half of the Southwest one-quarter of Sec-
tion Seven (71, fownship Three (3) North, Range Seven (7) Xast: Be-
ginning on the west line of Cherokee Lane, (State Highway ,$), where
said west line would be intersected by the qesterly projection of the
north line of said quarter section and running thence on and along
said projection and on said north quarter section line a distance of
three hundred fifty (350) feet more or less to an iron rod, thence
South 0' 341 East six hundred sixty-seven and one half (6673) feet to
an iron pin, thence South S7O 4.1" East five hundred sixteen and ninety-
three hundredths (516,931 feet to an iron rod, thence South 1' 0.4' &st
667.95 2eet to a point on the & & Section line, thence North 87O 40'
Tiest eight hundred forty-two and eighty-five hundredths f842,85) feet
more or less to the west line of said State Highway 4, said west line
being the Easterly boundary line of the City of Lodi, thence North 0'
34.g' West along said west line one thousand three hundred thirty four
and eight hundredths (1334.8) feet to the point of beginning, EXCEPT-
ING therefrom an? part heretofore annexed to the City of Lodi as
"Krieger Addition" by Ordinance No. 338 of the City Council of the
City of Lodi, a copy of which Ordinance was filed with the Secretary
of State on December 14, 1946 and with the Xecorder of San Joaquin
County on December 16, 1946.
Section 2. Upon the effective date of this ordinance, the City Clerk shall
make, certify and transmit a certified copy hereof to the Secretary of State of
the State of California, giving the date of its passage, adoption and appraval
and he shall also comply with such other statutes as may be applicable hereto,

by certify that the foregoing Ordinance Ro. 349 was reg-
ularly introduced and read at an adjourned regular meet-
ing of the City Council of said City held Eay 28, 194'7 and
was thereafter passed, adopted and ordered to print in
regular meeting of said City Council held on the 4th day
of June, 1947, by the followhg vote:
