ORDINANCE NO. 338 AN ORDIRiANCE APPROVING TEE ANNEXATION OF "KRIEGER ADDITION" TO TRE CITY OF LODI, CALIFORNIA. WHEREAS, in answer to a petition signed by owners of more than one- fourth of the area of the lands and representing not less than one-fourth of the assessed vsluation of such lands, this City Council did, on the 9th day of October, 1946, pass and adopt its Resolution of Intention No. 1280, declaring it to be the intention of this City Council to annex to the City of Lodi certain uninhabited territory contiguous to said City, in accord- ance with proceedings had and to be had pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939" as amended, said territ- ory, for the purposes hereof, to be designated " KRIEGER ADDITION and particularly bounded and described as hereinafter set forth, and, VEEXEAS, due publication of said Resolution No. 1280 was had in time, form and manner as required by law as is evidenced by affidavit on file and of record in the office of the City Clerk of this City, and, WHEREAS, among other things, the Said Resolution No. 1280 lic notice that owners of real property affected by said annexation might file written protests against said annexation up to the hour of 8:OO orclock P.M. of gednesday, October 30, 1946, with the City Council, vrhich protests would be received and considered at said day and hour in the Council Chambers, City Hall, Lodi, California by the said City Council, and, WEREAS, said hearing was rewlarly adjourned, postponed and set over to and until 8:OO o'clock P.16. of Wednesday, November 6, 1946 at a regular meeting of said City Council, and, WHEREYS, on that day and hour and at the place so set, this City Council did in open meeting, declare that it was then ready to receivi and hear any and all protests or objections against the annexation of seid territory to the City of Lodi and no protests or objections either written or oral were present- ed, and, by reason that no protests were received, this City Council did then acquire jurisdiction to annex said territory to the City of Lodi, now, therefore, The City Council of the City of Lodi does ordain as follows: -1- ( Ord. No. .38 - 2 ). Section 1. The annexation of the following described uninhabited ter- ritory to the City of Lodi, San Joaquin County, California, is hereby approved and is hereby declared to be annexed to and made part of said City, to-wit: A PORTION OF THE SOUTHWEST ONE QUARTER OF SZCTION SEVEN, TOWNSHIP NOFEH 589.36 FEET OF TI% FOLLOWING: RANGE 7 EAST AND RUNNING THENCE "ZXSTERLY 792 FEET, THENCE SOUTHERLY 668.05 FEET, THENCE "ESTEKLY 796.15 FEET, THENCE NORTHERLY 667.6 FEET TO THE POINT OF BEGINhiING AND WNTAINING 3.382 AGES MOm OR mss. THREZ NORTH, RANGE SEVZN EAST - BEING THE WEST 250 FEFP OF THE CORNER OF 33% SCUTWIEST ONE-QUAKI'ER OF SECTION 7, TOWNSHIP 3 NORTH, BEGINXING GN THE NORlXWEST Section 2. Upon the effective date of this ordinance, the City Clerk shall make, certify and transmit a certified copy hereof to the Secretary of State of the State of California, giving the date of its passage and adoption and he shall also comply with such other statutes as may be applicable hereto. BLAKELY, City Clerk of the City of Lodi, do hereby certify that the foreging Ordinance No. 338 was regularly introduced and read at an adjourned regular meeting of the City Council of said City held November 6, 1946 and was thereafter passed, adopted and ordered to print in regular meeting of said City Council held on the 13th day of November, 1946 by the following vote: Am8 : Councilmen, Haskell, Lyble, Riggs, Tolliver and Rinn NOES : Councilmen, None.
