AN ORDINANCE MENDING SECTION ll OF ORDINANCE N0.238
RBGULATE, RESTRICT AND SEGREGATE THE LOCATION OF IND-
USTRIES, BUSINESS, TRADES, APAF3!MENTS, DWELLINGS AND
OTHER SPECIFIED USES; TO REGULATE AND LlbiIT THE
HEIGHT AND BULK OF BUILDINGS €EKEAFTER ERECTED; TO
REGULATE AND Dl3ERWNE THE AFUCA OF YARDS AND OTHER
TO DISTRICTS, TO PROVIDE FOR ENFORCadENT AND PRESCRIBE
PENALTIES FOR THE VIOLATION OF ITS PROVISIONS, AND TO
REPEAL ORDINANCES IN CONFLICT HZREWITH AND DECLARING
SECTIONS OF CERTAIN ORDINANCES CONTINUED IN FORCE.
ADOPTED JULY 19, 1937, ENTITLZD: - “AN ORDINANCE TO
OPEN SPACES; FOR SAID PURPOSES TO DIVIDE THE CITY IN-
The City Council of the City of Lodi does ordain as follows:
Section 1.
in the title hereof, is hereby amended to read as follows:
Approval of Plans - 11-1.
Section 11 of Ordinance No. 238, entitled as set forth

IN CASE AN APPLICATION IS MADE FOR A BUILDING PmIT FOR A
BUILDING TO BE ERECTED IN THE OME AND TWO FAMILY RESIDENCE
DISTRICT ZONE, MULTIPLE FAMILY RESIDENCE ZONE, CaMMERCIAL
ZONE OR INDUSTRIAL ZONE, THE CITY COUNCIL MAY REQUIRE mAT
SAID APPLICATIONS $HALL BE ACCOMPANIED BY DRAWINGS OR SKETCHES
SHOW?IXG THE FRONT, SIDE AND REAR ELEVATIONS OF THE PROPOSED
.BUILDING. UPON BEING FILED, SUCH DRAWNGS OR SKETCHES SHALJi
FORTHRITH BE TRANSMITTED TO THE PLANNING COMMISSION, WHICH
SHALL CONSIDER THE SAME IN AN ENDEAVOR TO PROVIDE TMT THE
CITY SHALL DEVELOP IN AN ORDERLY AND ~ONIOUS MANNER AND
THAT BUILDINGS SHALL BE SO DESIGNED AND CONSTRUCTED THAT
THEY WILL NOT BE OF UNSIGHTLY OR OBNOXIOUS APPEARANCE TO
THE EXTE;NT THAT THEY WILL IMPAIR THE DESIRABILITY OF LIV-
ING CONDITIONS IN THE SAME OR ADJACENT RESIDENTIAL DISTRICTS,
DEPRECIATE TEE VALUES OF PROPERTY AND ADVERseLY AFFECT THE
GENHZAL PROPERTY AND ADVERSELY AFFECT THE GENERAL PROSPERITY
AND WELFARE. TO THIS END, THE PLANNING COMMISSION SHALL
SUGGEST ANY CHANGES IN THE PLANS OF SUCH PROPOSED BUILDINGS
AS IT MAY DEm NECESSARY TO ACCOMPLISH THE PURPOSES OF THIS
SECTION, AND SHALL NOT .APPROVE SUCH PLANS UNTIL IT IS SATIS-

APPLICANT IS NOT SATISFIFD WITH THE ACTION OF THE PLANNING
COMMISSION, HE MAY WITHIN TKWl.”T (20) DAYS AFTER SUCH ACT-
ION, APPEAL IN WRITING TO THE CITY COUNCIL. THE COUNCIL
SHALL HOLD A HEARING ON SAID APPEAL AND SHALL RENIlER ITS
DECISION THEREON WITHIN THIRTY (30) DAYS AFTER THE FIIJNG
THEREOF. IF THE CITY COUNCIL SHALL APPROVE THE ACTION OF
THE PLANNING GOMISSION, THE APPLICANT MAY FIB WITH THE
PLANNING COMMISSION A NOTICE OF INTENTION TO PROCEED WITH
THE CONSTRUCTION OF THE BUILDING, AND SHALL FILE A COPY OF
SUCH NOTICE IN THE OFFICE OF THE BUILDING INSPECTOR. NO
BUILDING PERMIT FOR ANY BUILDING COMING UNDER THE PROVIS-
IONS OF THIS SECTION SHALL BE ISSUED UNI;EsS THE PLANS
TKEREOF SHALI, FIRST HAVE BEEN APPROVED BY THE PLANNING
COMMISSION OR BY THE CITY COUNCIL OR UNTIL THIRTY (30)
DAYS SHALL HAVE ELAPSED FROM THE DATE OF THE FILING OF
SUCH NOTICE OF INTENTION TO BUILD. UPON SUCH APPROVAL
OR AT THE EXF’IRATION OF SUCH THIRTY (30) DAYS, THE BUILD-
ING INSPECTOR .SHALL ISSUE A PERXIT FOR SAID BUILDING PRO-
VIDED ALL OTHER PROVISIONS OF LAW HAVE BEEN C0MPLIEL.l WITH.
EVERY DRAWING .m SKETCH FILED UNDER THE PROVISIONS OF THIS
SECTION SHALL BECOME A PART OF THE PEXMANENT RECORDS OF
THE PLANNING COlsUdISSION.
Section 2. This ordinance shall be published one time in The Lodi
Times and shall be in force and take effect thirty (SO) days after its

certify that the foregoing Ordinance No. 334 was regularly
introduced in the City Council of said City on the 11th day
of September, 1946 and was thereafter passed, adopted and
ordered to print on the 25th day of September, 1946 by the
