HomeMy WebLinkAboutOrdinances - No. 3\,%%. Ordinance No. 3. An ordinance regulating the number and conduct of saloons in the City of Lodi. The Board of Trustees of the City of Lodi do ordain as follows: Section 1.- The number of saloons in the City of Lodi is hereby regulated and limited as follows: There shall be four saloons for the first 2500 inhabitants or under, and one additional saloon for every 500 inhabitants over 2500. Provided, that nothing herein shall preclude the Board of Trustees from issuing if in their judgment the i % erests of the City would be served an additional license to any person or persons, firm or corporation who in good faith shall erect and maintain a hotel building in the City of Lodi. Section 2.- When any person desires to open, keep or conduct any saloon in the City of Lodi such person shall petition the Board of Trustees to order a license to be issued therefor, and shall present with such petition a certifi- cate signed by five respectable citizens of said city, reiiding or doing business in the immediate vicinity of such proposed place and giving their residences and place of businesses and occupations, setting forth that the applicant is a person of good moral character and sober and a suitable person to keep and conduct such place. Section 3.- Upon receiving such a petition and certificate the Board of Trustees may refer the matter to the President of the Board of Trustees and the Marshal for investigation as to the moral charac’ter of the applicant and whether such applicant is a sober and suitable person to keep and con- duct such a place, and they shall report to the Board of Trustees at the next meeting. If the Board finds such person to be a good moral character, and a sober and suit- able person to conduct such place,-and that such place is a suitable reasonable and proper locality for conducting such business, agreeable to social order and to police regulation of the city they shall order the Clerk to issue the license. If the Board shall find that the applicant is not a sober and suitable person to keep and conduct such a place, or that such place is an improper place or locality, considering the police regulation of the city and the social order thereof they shall deny the petition. If the petition be denied, no license shall-be issued. Should the Board of Trustees at any time determine that any per- son keeping or conducting such a plaee is not a person of good moral character or is not a sober or a suitable per- son to keep and conduct such place or that such place is not conducted in a lawful and orderly manner, or if immoral conduct is permitted, or if such person permits any women or any boy under the age of 18 years to frequent the place, or who sells any liquor to any person who is a reputed cjrunkard, or who sells BIB liquor to any person visibly under the influence thereof, or to any per- son or persons contrary to the written instructions of the Marshal deli'vered to him, or permits any plays, any music to attract a crowd, or any conduct of a character contrary to proper police regulations or injurious to social order of the municipality or the public, is permitted or not prevented therein, they may revoke such order or license and thereupon no further license shall be issued. In such cases the Board of Trustees shall be'the judges of what conduct, and whether such conduct as aforesaid, is detrimen- tal to-morality and to the interests, social and police, of the city, and their findings and decision thereon shall be entered at large on the minutes of the Board, and such place so decided against is hereby declared to be and shall be treated as a nuisance. Section 4.- The word saloon as used herein is hereby defined, to be a place wher'e spirituous, mylt or fermented liquors or any alcoholic drink is sold or givenaway in quantities less than one quart to be drunk on the premises. . . . . .. . . . .. . . . - .. Section 6.- This ordinance shall be published the same in three public places in the City of Lodi. Section 6.- This ordinance shall take effect immediately upon approval and publication. Section 7.- ZM All ordinances and parts of ordinances in conflict herewith are hereby repealed.
