HomeMy WebLinkAboutOrdinances - No. 291AN O€EIIMTGE OF TRE CITY OF LODI AUWORIZING TKE 'I"SmR TO ANf) THE ASWEOM AND DISCmGX BY ClFFICERS OF THE COUNTY OF SAN JOAQUTN OF CERTAIN FUMCTIOPTS OF SkID CITY RELATING TO THE ASSEsWEaT ANTS COLLECTION OF TmCIPAL TAXES, PROBIDING FOR THE CONSOLIDATION AND B;BOLITION OF TI= OFFICES OF CITY ASSESSOR CITY TAX COLUCTOR, PROVIDING FOR THE DISCHARGE OF THEIR DUTIFS BY OFFICE& OF SAID courm~ OF sm JOAQUIR AND PROVIDING FOR A COnTTRACT FOR TI333 CO~!il?ENSATION TO BE ALLOWED TO SAID COuPaTY OF SAN JOAQUIN FOR SERVICES TO BE REHBERXD SAID CITY, AND REPEAZING ORDINANCE NO. 129 OF THE CITY OF LODI, AND ALL ORDINAJ%ES &ENDATORY THEmOF YECEE TRE CITY COUNCIL OF TEE CITY OF LODI DOES ORDAIN AS FOLLOWS : Section 1. The City Council of the City of Eodi, a city of the sixth class , hereby elects that the duties of assessing property and collecting taxes provided by law to be performed by the Assessor and Tax Collector, respectively, of said city shall after the effective date of this ordinance be performed by the County Assessor and the County Tax Collector, respectively, of the County of San Joaquin, as provided in *#An act to provide for the levy and collection of taxes by and for the use of municipal cor- porations and cities incorporated under the laws of the State of California, except municipal corporations of the first class, and to pfovide for the consolidation and abolition of certain municipal offices and to provide that their duties may be performed by certain officers of the county and fixing the compensation to be allowed for such county officers for the services so rendered to such munieipal corporation," approve-d March 27th, 1895, and all Acts amendatory thereof and supplementary thereto. Section 2, That from and after January lst, 1944, and after the filing of a certified copy of this Ordinance with the Auditor of said County of San Joaquin a11 assessments madg by the County Assessor, after the same may be equalized or corrected by the Board of Supervisors or State Board of 'Equhlization shall be used as a basis for the levy of the taxes of the City of Lodi, and said taxes shall be collected by the Assessor and Tax Collector of said County of San Joaquin at the same time and in the manner county taxes are collected, Section 3. That from and after January lst, 1944, and after the filing of a certified copy of this ordinance with the Auditor of the County of San Joaquin, the assessment for tmation, equalization of assessments, levy of taxes, and the collection of the same shall be conducted in all respects in accordance with and in the manner se~ out in the provisions of LIle said Act mentioned in Section 1 of this Ordinance, and all Acts amendatory thereof and supplementary thereto, and the duties of all officers and agents of said County of San Joaquin and of the City of Lodi in relation to assessment and equalization and to the levy and collection of all taxes, current and delinquent, shall be such as are prescribed by said Act and of all Acts amendatory thereof and supplementary thereto; provided, that such taxes, when so collected, shall be paid tq the City Treasurer of the City of Lodi, as provided in said Act and in the acts amendatory thereof and suppelementary thereto, said city council not electing to avail itself or said city of the provisions of section 2 of said Act. Section 4. That from and after the going into effect of this ordinance, a11 duties, other than the assessing of the property of such city or munic3pZi.l corporation, theretofore performed by the City Assessor, shall be transferred to and be performed by the Clerk of the City of Lodi, and a$1 duties, other than the collection of taxes, theretofore performed by the City Tax Collector shall be trans- ferred to and be performed by the City Treasurer of said city, this ordinance, the offices of City Assessor and Tax Collector of said City of Lodi are abolished. Section 5. That from and after the going into effect of Section 6. That the Edayor and City Clerk are hereby authorized to enter into a contract with the Board of Supervisors of the County'of San Joaquin fixing the amount of compensation to be charged by and paid to the said County of San Joaquin for the performance of the services of assessment and collection of taxes, as provided in the said Act and all Acts amendatory thereof and supplementary thereto, such compensation to be fixed at a sum not greater than that provided by Section 6 of said Act as mended April lgth, 1927. adoption of this ordinance and before the first Monday in the month of February 1944, file with the Board of Supervisors of the County of San Joaquin a certified copy hereof and perform such other duties as are provided in said Act referred to in Section 1 hereof; and this act shall be effective from and after January lst, 1944. flict hecewith are hereby repealed.
