HomeMy WebLinkAboutOrdinances - No. 232. .. The City Council of the City of Lodi does ordain as follovrs: SECTION 1. DEFINITIONS. As used in this ordinance, unless other- wise apparent from the context, all rvords or combination of words are hereby defined as having the same meaning as provided and as they are defined in the Agricultural Coae of the State of California, (a) 1q-e s;n:*n?rr number includes the plural, and the plurzl the sing& r . (a) An official bovine tuberculin test is a test performed by a veterinarian accredited by the Bureau of .Animal Industry of either on both the State Department of Agriculture or the United States Department of Agriculture. (e) Cattle regularly tested for bovine tuberculosis are those located in a Federal-State modified accredited area or nkich have been i;ested by an accredited Qeterinarian within the past eighteen months. SECTION 2. All condensed, evaported and dried milk, butter, cheese, or other dairy products, intended for hurnan consmption, mde from milk and/or cream produced from cows which have passed an official tuberculin test, shall hzve printed, stamped, or attached upon or to any container, wrap,ner, covering, or labBl thereon the words, tested cowsf1, or in lieu thereof, a sworn affidevit by the manufacturer or distributor of such milk products, filed with the District Eealth Officer of the San Joaquin Local Heal-th District, showing the name and address of the producer, with proof that such milk products have been produced from cattle that are reslerly tested for bovine tnberculosis, and from Tfhich the reactors have been removed. fThis product is produced from non-reacting tuberculin -1- S"5TICX 3. .'Ul codensea, evaporated and dried milk, butter, cheese, or other dairy products, intended for hm-m con.sumpticn, male from nilk and/or cream produced from COIVS which have not passed an officird. tuberculin test, shell have printed, stmped, 01' attached upon or to any container, wrapper, covering, or lebel thereon, the wrds, "This product is not produced from non-reacting tuberculin tested cowsff. SZCTIC%T 5. !t& rimlatioil of this o&iziatce, or aziy provision 01- provisions of this ordinance, is a inisdemeanor and is punishable by a fine of not less than twenty-five ($25.00) dollars, or more than five hundred ($500.00) dollars, or by iaprisonraent in the County Jail of not less than ten (10) days or more than ninety (90) deys, or by both such fine and imprisonment. SECTION 6, If any section, sentence, clause or part of this ordinance is, for any reason, held to be unconstitutiond, such decision shall not affect the validity of the remaining portions of this ordinznce. The City Coumil of the City of Lodi hereby declares that it would have passed this ordinance and each section, sentence, clause or part thereof, irrespective of the tact that any one or more sections, sentences, clauses or parts be declared unconstitutional. .. SECTICE 7. This ordinence shall take effect thirty days after the date of its ,nassa,ze, and its effective date shall be lhy 1, 1937, and prior to the expiration of fifteen (15) 8.ays from the date of passage thereof, shall be published for at least one (1) time in the LODI bLGifS-SEl~TI”TT, a newspaper of general circulation printed and published in the city of Lodi, County of Siin Joecpin, State of California, toqether with the names of the mernl: 4 for and against the same. ved thjs 15th dcoy of February, 1937.
