AN ORDINANCE APPROVING THE AN- mroN OF ~'ACADEMI ADDITION"
WHWEAS, on the 5th day of October, 1936 a petition was presented and
filed with this City council asking that certain bnhabited new territory,
therein described, be annexed to the City of Lodi and that an election be called
and held in said territory upon the question whether said territory shall be
annexed to, incorporated in and made a part of the City of Lodi and the property
therein be, after such annexation, subject to taxation equally with property in
said City to pay that portion of the bonded indebtedness of the City of Lodi
issued and outstanding at the date of said petition for annexation or thereto-
fore authorized, and,
VEER?MS, after the filing of said petition for annexation and at the
next meeting of this City Coul)cil next succeeding said filing, the City Clerk
of this City reported that the signatures annexed thereto were in excess of
one-fourth (%) of the number of electors residing in said proposed new territory,
and this City Council did thereon pass and adopt its Resolution No. 862 wherein
the hour of 8:OO o'clock P.IvI. of Monday, November 9, 1936 and the Council
Chambers of this City Council in the City Hall of the City of Lodi were designated
as tBe time and place where and when objections would be heard from property
owners in the proposed new territory to annexation of the same.
No, 862 also contained among other things a declaration of this City Council of
its intention to call an election in said territory in not less than fifty (50)
days from the date of the adoption thereof upon the question of whether the
property in said territory shall be annexed to said City and after said annexation
be taxed equally with the property now in the City of Lodi to pay that portion of
Said Resolution
the bonded indebtedness of said City issued and outstanding at the date of such
election, and a copy of said Resolution No. 862 was published in time, form and
manner as required by law in the Lodi News-Sentinel, a newspaper of general
circulation printed and published in the City of Lodi, as is evidenced by the
affidavit of Clyde C. Church now on file and of record in the office of the City
Clerk of this City, and,
WHEXEAS, no objections in writing or otherwise were received or
filed with this City Couucil up to and including the hour of 8:OO o'clock Pa.,
of Monday, November 9, 1936 nor thereafter, and this City Council having acquired
jurisdiction so to do then did on said 9th day of November, 1936 pass and adopt
its Resolution No. 864 ordering and calling and giving notice of a special
election to be held in the said proposed new territory on Tuesday, December 15,
1936, and,
?%EREAS due and proper notice of said election was given by publication
of a notice thereof for once each week for the four (4) weeks next preceeding
the date set for the said election in the WTOCKTON E03CORD", a newspaper of
general circulation printed and published in San Joaquin county out side the
City of Lodi, as is evidenced by the affidavit of Earl Lenfesty now on file
and of record in the office of the City Clerk of this City, and,
WFEXEAS, said election was held and conducted in accordance with
law and the provisions contained in Resolution No. 864 on the said Tuesday,
the 15th day of December, 1936 and the votes cast thereat received and counted
and the returns thereof transmitted to this Ci%y Council who did tkereerteq,
at its next regular meeting held next after thsee days from the date of said
election, to-wit, held on the 21st day of December, 1936, canvass &he returns
of said election and declare the result thereof and as a result of said canvass
this City Council herein finds and declares that the total number of votes
cast at said election was sixty-five (65); that the total number of votes cast
in favor of the proposal and for annexation was thirty-seven (37); that the
total number of votes cast against the proposal and against said annexation
were twenty-eight (28); and that the necessary majority of votes required by
law were cast in favor of the proposal and for annexation, now therefore,
The City Council of the City of Lodi does ordain as follows:
Section 1: That the annexationto the City of Lodi of the followirig
described inhabited, unincorpomted territory designated as "ACADM ADDITIO~"
be, and the same is hereby approved, ratified and confirmed, which'said territory
is contiguous to the City of Lodi, County of San Joaquin, State of California and
is particularly bounded and described as follows:
Commencing on the West line of Cherokee Lane (as said west line
now exists) at a point where said West line of Cherokee Lane
is intersected by the North line of Poplar Street in the "Lodi
Barnhart Tract", thence Sautherly on and along the nos existing
V?est line of Cherokee Lane to a point where the same intersects
the North line of Kettleman Lhne as said Kettleman Lane is
delineated a.nd so designated on the official rmp of "Ldi
Barnhart Tract", thence Westerly on and along the North line
of said Kettleman Lane to a point 269 feet Easterly and 25
feet Northerly from the Southwest corner of Section 12, Town-
ship 3 North, Range 6 East, M.DeB,8cM., such point being the
Southwest corner of n3etllley Suburban Acres" as per the official
map thereof, thence Northerly on and along the West line of
said Bewley Suburban Acres and its Northerly continuation to
the intersection of the same with the North line of the Soutip
west one-quarter (a) of Section 12, Township 3 North, Range
6 East, M.D.B.W., thence Westerly on and along said North
line of the Southwest one-cparter (2) of Section 12, a distance
of 301.6 feet more or less to a point 30 feet East from the
Northwest corner of said Southwest one-quarter (2) of Section
12, such point being on the East line of Quinby Avenue, thence
Northerly on and along said East line of Quinby Avenue a
distance of 706 feet more or less to the present boundary line
of the City of Lodi, thence Easterly on and along said
boundary line to a point on the East line of South School
Street in Wutchins Addition", thence Southerly along said East
line of South School Street to the intersection of the same with
the Vksterly extension of the North line of Poplar Street,
thence Easterly along the ssid Northerly line of Poplar Street
and its Westerly extension to its intersection with the present
Westerly bounday line of Cherokee he and the point of begin-
ning first in this description mentioned. The lands herein
described and sought to be annexed to the City of Lodi are
delineated and designated on or form a part of lands included
in the following maps and. plats, San Joaquin County records:
Lodi Barnhart Tract, Filed November 5, 1906.
Acacia Tract, Filed June 28, 1921.
A, J. Larson's Subdivision of a Portion of S@ Section
12, T3N, R6E, Filed December 8, 1891,
Eewley Suburban Acres, Filed &rch 7, 1921.
Hutchins Addition to the Town of Lodi, Filed April 10, 1897.
Section 2: That the property within said territory shall from the
date of the annexation thereof be subject to taxation equally with the
property within said City of Lodi to pay all of the bonded indebtedness of
said City outstanding at the date of the filing of said petition of annexation
and at the date of the first publication of the notice of election as the amounts
of said bonded indebtedness are set forth in the said Notice of Election.

Section 3: That the City Clerk of this City shall forthwith upon
the taking effect of this Ordinance make and certify under the seal of the
City of Lodi and transmit to the Secretary of State of the State of California
a copy of this Ordinance giving the date of its passage.
Section 4: This Ordinance shall take effect and be in full force
and effect at the times and in the manner provided by law.
I, hereby approve and sign the foregoing Ordinance No. 229 this
4th day of January, 1937.

certify that the annexed copy of ORDINANCE NO. 229 entitled "AN ORDINkI\TcE &'A
FFIOOVJNG 'EIE ANNEXATION OF 'ACADEMY ADDITION1" is a fill, tme and correct copy
of said ordinance and that the same was regularly introduced at a regplar
meeting of the City Council of said City held on December 21, 1936 and was
thereafter finally passed, adopted and ordered to print at a regular meeting
of' said City Council of said City held on January 4, 1937 and that said
Ordimnce has been published according to law.
