ORDINAIWE NO. 212 -A P.T. 23444 AN ORDINANCE OF THE CITY OF ZODI, CALIFORNIA ORDERING, CALLING AND PROVIDING FOR AND GIV- ING NOTICE OF A S?ECIAL ELWTION TO BE HELD IN THE CITY OF LQDI, CAZIFOmIA, ON THURSDAY, THE 12th DAY OF SEPTEIBER, 1935, FOR THE PUR- POSE OF SUJ3UTTTING TO THE QUALIFIED ELECTORS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR THE ACQUISITION AND CONSTRUCTION OF A CERTAIN MUNICIPAL IM- PROVEMENT IN SAID CITY. ~~1~~~~~ WHEW, the City Council of the City of Lodi did on the first day of July, 1935, by a vote of more than two-thirds of the members of said Council adopt a Resolution N0.7&, entitled "A Resolution of the City Corn- cil of the City of Lodi, California, declaring that the public interest and necessity demand the acquisition and construction of a certain municipal im- provement, the cost of which is and will be too great to be paid out of the ordinary annual income and revenues of said city" which said resolution was duly signed and approved by the Mayor of said city and attested and certi- fied by the City Clerk of said city; NW, THEREFORB, the City Council of the City of Lodi does ordain as folluws: SECTION 1: That a special election be held and the same is hereby called to be held in the City of Lcdi on the 12th day of September, 1935, for the purpose of submitting to the qualified voters of said city a proposition as hereinafter stated to incur bonded indebtedness and to issue bonds of said city therefor in the amount hereinafter set forth, and for the objects and purposes set forth in said Resolution and hereinafter stated. All qua5ified electors of said city shall be qualified to vote at said elec- tion. SECTION 2: That the objects atid purposes for which said in- debtedness is proposed to be incurred and bonds issued therefor are as follows: PROPOSITION: The acquisition and construction by the City of Lodi of a certain municipal improvement, to-wit: electric generating plant, Diesel electric generating plant and transnission line, including lands, rights of way, easements, dam, penstock, power plant and building, transmission lines, conduits, wires, poles, substakions, trans- formers, dwos, notors, switches, machinery, apparatus, fixtures, equipment, and other stmctures, works, rights and properties oecessary or convenient to generate electricity to apply said City of Lodi and its inhabitants with electricity for light, heat and pavrer. The construction of a hydro- SECTION 3: That the estimated cost of the proposed nunicipal improvement described in the Proposition stated in Section 2 hereof is SiDc Hundred Thousand dollars ($600,000); that the amount of the principal of the indebtedness to be incurred therefor is the sum of Four Hundred Sixty-six Thousand dollars (#466,000), and that the rate of interest to be paid on said indebtedness shall be four per cent per mum, payable semi-annually. ,Dmt if the proposition to incur said indebtedness for said purpose so submitted receives the requisite number of votes, to-viit, two- thirds of the votes of the qualified electors voting. at said election on suoh proposition, bonds of said city in not exceeding the principal amount of $466,000 shall be issued and sold for the objects and purposes set forth in ' 1 said Proposition. SECTION 4: That the polls for said election shall be opened at six otclock a.m. of the day of said electionmd shall remain open contin- uously from said time until seven o'clock p.m. of the same day when said polls shall be closed, except, however, that if at the said hour of closing there are any voters in any polling place, or in line at the door thereof who are qualified to vote, and have not besn able So do so since appearing, the polls thereat shall be kept open a sufficient time to enable them to vote, but no one Who shall arrive at any polling place after seven o'clock p.m. of said day shall be entitled to vote, although the polls may be open when he arrives. That on the ballots to be used at said special election, in addition to the other matters required by law, there shall be printed sub- stantially the following: Mark crosses (X) OD ballot ONLY 'KtTH RUBBER STAMP; never with pen or pencil. INSTRUCTIONS TO VOTERS To vote on any question, proposition or constibi- tional mendment, stanp a cross (X) in the voting square after the word "Yes" or after the word ttMott. A11 -marks, except the cross (X) are forbidden. All distinguishing marks or erasmes are forbidden and aaloe the ballot void. A cross (X) stamped in the voting square after SECTION 5: That for the purpose of holding said election there shall beLfour consolidated voting precincts in said city, which pre- cincts shall consist of consolidations of the regular election precincts now established in said city for the holding of state and county elections therein; that said consolidated precincts shall be designated as hereinafter stated; that the polling places for the respective precincts shall be the places hereinafter designated and that the persons hereinafter named, being competent and qualified electors and residents of said city and of their respective election precincts, are hereby appointed officers of election for their respective election precincts and they shall hold said election and make return thereof in the manner provided by law. Consolidated Voting Precinct A shall consist of regular elec- tion precincts numbered 1, 2, 3. 4. & I, as now established in said city for holding state and county elections: Polling Place: City Hall, Pine St.. at Pleasant Ave., Inspector; Awustus G. Consolidated Yoting Precinct B shall consist of regular elec- tion precincts numbered-5. 6, 8, & 9. , as now established in said city for holding state and county elections: Polling Place: Shattuckts Garwe. Rear 300.W. Oak St., Inspector: Samuel T. Henderson Judge: Ernest A. Jacobsen, Clerks: Mrs. Edith 15: Hennina & Mrs. Gladys F. Food. consolidated Eoting Precinct C shall consist of regular elec- tion precincts numbered 10. 11, 12, & 13. , as now established in said city for holding state and caunty elections. Polling Place: galem School Building Inspector : Mrs. Bba T. Weaver. Judge : Mrs. Florence MCLachlan. Clerks: Mrs. Clara L. Watson & Mrs. Verna V. Giles. Consolidated Voting Precinct D shall consist of regular elec- tion precincts numbered 14. 15, 16: & 17 , as now established in said city for holding state and county elections. Polling Place: 608 S. Central Avenue. Inspectop: Mrs. Olive C. Welch. Judge: William J. Barnes. Clerks: blrs. Sara W. WriEht & Mrs. Esther C. Turing. SECTION 6: ducted, and the votes thereat canvassed, and the returns thereof made, and the result thereof ascertained and determined as herein provided; and in all particulars not prescribed by this Ordinance said election shall be held and conducted as provided by law for the holding of municipal elections in said City. The returns of said election shall be made out and signed by the elec- tion officers and shall be by them deposited with the Clerk of said City, to- gether with the ballots cast at said election; and this City Council shall meet and canvass said returns on Monday, the 16th day of September, 1935 (being the first Monday after said election), at the hour of eight otclock P.M.; and if upon such canvass it shall be found that at least two-thirds of the qualified electors of said City, voting at said election, voted in favor of said propo- sition, then bonds of said City of Lodi in the amount specified in said propo- sition, to-wit, $466,000, will be issued and sold by said City for the purpose therein mentioned.
