AN ORDINANCE REGULATING THE RIGI-IT OF MAKING A SPEECH UPON
THE PWLIC STREETS OR OTHER'PUBLIC OUTDOOR PLACES IN THE CITY OF LODI.
Be it ordained by the City Council of the City of
Lodi as follows , to-wit :

Sec. 1. Definitions. The following terms shall
have the meaning set out herein:
"Public place" shall mean any street, alley, COW,
square, park or other outdoor place controlled or owned by
the public or by the City of Lodi. It shall not include
any public building or other covered enclosure.
"Speech" shall nean any oral appeal to the public or
any part or group thereof, and shall include address or
lecture.
Sec. 2. No person shall be permitted to deliver any
speech updn or from any public place in the City of Lodi,
unless a permit so to do has first been issued to said person
by the Chief of Police of the City of Lodi.
Every application for a permit to deliver a public
speech shall be filed with the Chief of Police and shall give
the name of the person or persons who desire to speak; under
whose auspices the speech is to be given; general nature of'
speech, such as religious, patriotic, labor problems, etc. ;
when it is proposed to deliver safd speech and whether the
speaker or speakers are aliens or citizens of the United States.
The permit to deliver a speech from 8 public place
shall state where the speech may be'delivered; the time When said
speech is to be delivered, and the person or persons who may
deliver the same.
Sec. 3. Anyone violating any of the terms of this
ordinance shall be deemed guilty of a misdemeanor and upon con-

viction thereof, shall be punished in the manner prescribed in
the Penal Code of the State of California, for the punishment
of mlsdemeanors
Sec. 4. It is hereby declared that an unusual public
emergency exists necessitating the immediate passage of this
ordinance and necessitating that this ordinance take effect
immediately. Such emergency consists of the fact that political
agitators threaten to hold and will hold in public places
within the City of Lodi immediate public meetings at which will
be delivered public speeches advocating radical changes in the
form of city, state and national government and advocating
immediate over-throw of the government by violent means and
such meetings and speeches are liable to result in immediate
mob violence within the corporate limits of said city with
consequent damage to property within said corporate limits and
to citizens of said city and because of such emergency this
ordinance shall take effect immediately.
The foregoing Ordinance WRS duly and regularly passed
and adopted by the City Council of the City of Lodi, San
Joaquin County, California, at a regular meeting of said City
Council duly and regularly held at the office and principal
place of business of said City Council, to-wit, at the City
Hall, in said City of Lodi, on Konday, August
the hour of 8:OO o'clock P.M. of said day, by the following
20th 1934, at
