An ordinance regulating the furnishing of liquor with meals
by proprietors of hotels, boarding houses, restaurants and
other eating places, and licensing public halls.
The Board of Trustees of the City of Lodi do ordain as
follows:
Section 1.- Hotel, restaurant and boarding house proprietors
who are engaged in the hotel, restaurant or boarding house
business in good faith, and as the same are defined in this
Ordinance and in Ordinance No. 2, Article 2, shall procure a
license for selling, giving away or furnishing to their
guests, in connection with their meals, and to be drunk-in
the dining-room when eating their meals and at no other
time or place, any vinous, spiritous, malt or fermented
wine or liquor, and shall 'pay for the same the sum of
$10100 per quar'ter. Provided, however, that Such liquor
shall be sold in bottles containing no't less than one pint,
and provided, thatcno person, firm or corporation who
procures a re.tai.1 liquor license in accordance with
Ordinance No. 2, Article 2, shall be required to procure a
license for furnishing wines or liquors to guests
with their meals in a hotel, restaurant, or boarding-house
as defined by ordinance,-conducted by such person, firm
or corporation in the same building as the saloon for
which he has procured a retail liquor license.
Section 2.- Any person, firm or corporation, engaged in
the business of keeping or conducting a tamale house, or
serving lunch or short orders, in good faith, shall procure
a license for selling, giving 'away or furnishing to their
guests, in connection with such tamales, enchiladas, lunch
or short orders, to be served and drank 'therewith on the
premises where sold, furnished, or given away and at no
other time or place,' any vinous, spirituous, malt, or +
fermented wine or liquor, or any admixture thereof, and
shall pay therefor the sum of $10.00 per quarter.

Provided, that such liquor shall be served in bottles
containing not less than one pint.
Section 3.- For the purpose of this ordinance a hotel is
defined to be a public place where meals, and rooms with
beds, are provided for guests, the meals being prepared and
served with such frequency as are ordinarily furnished by
hotels and boarding-houses to boarders who pay a scheduled
price for their meals by the meal, day or week.
Section 4.- For the purpose of this lordinance a restaurant
is defined to be a place where hot meals are served to the
general public at a table in a dining-room in which there
is no bar.
The serving of spiritous, vinous, or malt liquors
with crackers and cheese or with cold lunches, or other
subterfuges shall not constitute a restaurant, and is not
authorized by a restaurant license and shall be considered
a violation of this ordinance.
Section 5.-Any person, firm or corporation who shall
maintain any theatre, hall or other building used exclusive-
ly for theatrical performances, opera singing, concert
singing, dancing, fairs, and other Gublic amusements, shall
procure a license therefor in the manner provided in
Ordinance No. 2, Article 2, ordinances of the City of Lodi,
which is hereby fixed at the sum of $12.50 per quarter.
All performances, fairs and public amusements held'
in such theatre,hall o'r building, shall be exempt from &he
license tax provided for in Subdivision 16 of Ordinance
No. 2, Article 2.
Section 6.- Any person, persons, firm or corporation who
shall violate any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor, and upon conviction
thereof shall be punisaed by a finexnot exceeding $100.00
or by imprisonment not exceeding 50 days or by both such
fine and imprisonment.

Section 7.- This ordinance shall be published by, ""3% PO ting
the same in three public places in the City of LGdi.
Section 8.- This ordinance shall be in force and take
effect immediately on approval and publication.
Section 9.- All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
