AGENDA TITLE: Reject Bid and Authorize Readvertisement for Bids for White Slough Water Pollution
Control Facility Sludge Lagoon Biosoild Removal

RECOMMENDED ACTION: That the City Council adopt the attached resolution rejecting the bid for the
above project and authorize readvertising for bids.
BACKGROUND INFORMATION: This project is to provide pumping service to remove biosolids from
the two sludge lagoons in the City's White Slough Water Pollution
Control Facility (WSWPCF) into a nearby open field. The City does
not have the proper equipment to do this work.
Plans and specifications for this project were approved on August 6, 1997. This project was bid as a
Public Works project per Government Code and the bid was opened on. ,A L;gu3t 20, 1r197. The City
received only one bid, from DK Environmental of Martinez, in the amount of $79,948. This bid is well
over the project estimate of $25,000. In doing further checking, the reason for the high bid is mainly due
to the Class A license requirement imposed by the Public Works bidding process.
Staff has consulted with the City Attorney and is recommending the project be rebid without the Class A
license requirement. Most lagoon cleaning companies do not have a Class A license. This type of work
is exempted from the State Contractor's License Board. By bidding the work as a service contract, we
should be able to obtain prices more in line with the budget.

RESOLUTION NO. 97-127
A RESOLUTION OF THE LODI CITY COUNCIL REJECTING
BID FOR WHITE SLOUGH WATER POLLUTION CONTROL
FACILITY SLUDGE LAGOON BIOSOLID REMOVAL AND
AUTHORIZING READVERTISEMENT FOR BIDS
WHEREAS, in answer to notice duly published in accordance with law and the order of
this City Council, sealed bids were received and publicly opened on August 20, 1997 at 11:00
a.m. for White Slough Water Pollution Control Facility Sludge Lagoon Biosolid Removal, described
in the specifications therefor approved by the City Council in August 6, 1997; and
WHEREAS, said bids have been compared, checked, and tabulated and a report thereof
filed with the City Manager as follows:

Engineer's Estimate $ 25,000.00
DK Environmental, Martinez $ 79,948.00
WHEREAS, this project was bid as a Public Works project per Government Code, and
also required a Class A license requirement imposed by the Public Works bidding process; and
WHEREAS, staff has consulted with the City Attorney and the State Contractors License
Board and is recommending the project be rebid without the Class A license requirement; and
WHEREAS, the sole bid received was well in excess of the project estimate.
NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that the bid from DK
Environmental of Martinez, CA is hereby rejected and;
BE IT FURTHER RESOLVED by the Lodi City Council that this project is authorized to be
readvertised for bid without the Class A license requirement.
