"3, the City Council of the City of Lodi did on the 2nd day of Rlay, 1984, read the title of the above entitled ordinance and did thereupon schedule a public hearing thereon for May 16, 1984 at the hour of 8:OO o'clock p.m. of said day in the Council Ckarrhers of the City Hall, Lodi, California, in accordance with the provisions of Section 50022.1 et seq. of the Government Code; and . WHERIlAS, notice of the hearing was published twice in a newspaper of general circulation in accordance with the provisions of Section 50022.3 of the Government Code as appears by the Affidavit of Publication on file therein; and \WEREAS, at the time set for hearing no protests were received by the City Council; NOGV, DBRIKW4, the City Council of the City of Lodi does ordain as follows : Section 1. Section 10-1 through 10-10 inclusive of the Code of the City of Lodi is hereby repealed and is superceded and replaced by new sections 10-1 through 10-10 inclusive as hereinafter set forth. I Section 2. There is hereby adopted new Sections 10-1 through 10-10 of the Code of the City of Lodi to read in full as follows: Section 10-2. Adoption. The provisions set forth in the "Uniform Fire Code," 1982 Edition together with the appendixes thereto, are hereby adopted as the fire prevention code of the city. The fire prevention code of the city shal apply in all matters pertaining to storage, handling and use of hazardous substances, materials and devices; and to conditions hazardous to life and property in the use or occupancy of buildings or premises within the city. Section 10-2. Bureau of Fire Prevention. The Uniform Fire Code shall be enforced by the bureau of fire prevention in the Fire Department of the City, which is hereby established and which shall be operated under the su@ervision of the Chief of the Fire Department. / Section 10-3. Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the City Manager within thirty days frcm the date of the decision appea 1 ed . Section 10-9. New materials, processes or occupancies which may require pemi t s . Bureau of Fire Prevention shall act as a comnittee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies, which shall require permits, in addition to those now enumerated in the code. The Chief of the Bureau of the Fire Prevention shall post such list in a conspicuous place in his office, and distribute copies thereof to interested persons. i The City R'lanager, or Chief of the Fire Department and Chief of the Section 10-10. Penalties. Section 1-7 of this Code shall be applicable for any and all violations of the provisions of this chapter. Section 3. This ordinance shall be published one time in the *%di News Sentinel," a newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days after its passage.
