HomeMy WebLinkAboutOrdinances - No. 1140ORDINANCE NO. 1140 AN ORDINANCE AMENDING SECTION 11-3 OF THE CITY CODE OF THE CITY OF LODI, ENTITLED "COLLECTION RATES FOR GARBAGE SERVICES". The City Council of the City of Lodi does ordain as follows: Section 1. Section 11-3 of the City Code of the City of Lodi is hereby repealed and re-enacted to read in full as follows: "Section 11-3. Collection Rates. The monthly rates to be charged for garbage collec- tion service shall be as follows: A. For any private dwelling house or residence the rate for one weekly garbage collection shall be: i. For the first container of thirty gallons or less, and not to exceed 60 lbs. , two dollars and forty eight cents PLUS a surcharge of fifty two cents from the effective date of this ordinance to June 30, 1979. ii. For each additional container of thirty gallons or less and not to exceed 60 lbs. each, one dollar plus a surcharge of twenty cents from the effective date of this ordinance to June 30, 1979. - 1- B. Owners of flats, apartments or the tenants or lessees thereof shall pay an amount equal to three dollars times the number of apartment units owned or occupied. C. For owners or tenants of business houses the rate shall be as follows: I. Class A Commercial collection service which exceeds the capacity of a one-5 cubic yard container the rates shall be : a. Small load ( 12- 14 cubic yard) rate $49.68 per load b. Medium load (14-16 cubic yard) rate $60.72 per load c. Large load (20, 30 or 40 cubic yard) rate $3.86 per yard d. Class C Commercial collection service when required either daily or weekly and the waste can be accommodated by 1 to 6-30 gallon cans not exceeding 60 lbs. per can. Class D Commercial collection service is for dry waste and for waste paper which is uncontainerized or loose. Class shall be by mutual agreement of the customer and the City The rates for this collector subject to appeal to the City Council as provided in the next se c tion. V. For larger quantities or more frequent collections or for any collection service not covered in the multifamily or commercial rate classification, such additional amounts of service and correspond- ing service rates shall be mutually agreed upon by the customers and -4- .- the City Collector, or determined by the City Council. In the event that a satisfactory rate cannot be agreed to, the matter shall be submitted in writing to the City Cauncil through the City Clerk, which shall fix the collection fee by resolution, and its decision shall be final. None of the rates referred to herein and agreed upon with the customer, and not ordered by the Council shall be effective until the garbage collector shall have filed with the City Finance Director a statement of the amount to be charged, if in excess of three dollars per month. Section 2. The rates herein established shall become effective for all garbage collection services rendered on or after May 1, 1978. Section 3. Urgency Measure. The City Council finds that the holder of the franchise for the collection of garbage in the City of Lodi is not being paid an adequate fee for its services rendered and in order to maintain the existing garbage service to protect the public health and safety of the City, that this ordinance, being one for the increase of revenues for gar- bage service, shall take effect immediately upon its adoption. Section 4. News - Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi, as an urgency ordinance. This ordinance shall be published one time in the "Lodi -5- CITY CLERK' State of California County of San Joaquin, ss. I, Alice M. Reimche, City Clerk of the City of Lodi, do hereby certify that Ordinance No. 1140 was introduced at an adjourned regular meeting of the City Council of the City of Lodi held March 14, 1978 and was thereafter passed, adopted and ordered to print at a regular meeting of said Council held April 5, 1978 by the following vote: Ayes: Councilmen - Hughes, Katzakian, McCarty and Pinke rton Noes: Councilmen - Katnich Absent: Councilmen - None I further certify that Ordinance No. 1140 was approved and signed by the Mayor on the date of its passage and the same has been published pursuant to law. , CITY C.LERK -6-
