ORDINANCE NO. 1040
AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN
UNINHABITED TERRITORY, DESIGNATED "NEUHARTH- WEST
ADDITION", TO THE CITY OF LODI
The Council of the City of Lodi does ordain as follows:
WHEREAS, on the 3rd day of July, 1974, the Council of the
City of Lodi did pass and adopt Resolution No. 3941 giving notice of
the proposal to annex certain uninhabited territory to the City of Lodi,
said territory being therein designated as "Neuharth-West Addition",
said Resolution describing the boundaries of the territory proposed to
be annexed; and
WHEREAS, said Resolution No. 3941 did contain a notice of the
day, hour and place when and where the Council of the City would hear
protests made by any person owning real property within the territory
proposed to be annexed, the time of said hearing being not less than
forty nor more than sixty days from the date of passage of said Resolution;
and
WHEREAS, said Resolution was duly published in accordance with
law; and
WHEREAS, on the 2 1st day of August, 1974, at the houi of 8:OO
p. m., in the Council Chambers in the City Hall of the City of Lodi,
County of San Joaquin, State of California, said time and place being the
day, hour and place fixed in said Resolution No. 3941 for hearing protests
to the said annexation, the said City Council did hear and pass upon all
protests made to the proposed annexation and did determine that protests
had not been made by the owners of one half of the value of the privately

owned territory proposed to be annexed as shown by the last equalized
assessment roll, nor by public owners of one half of the value of the
publicly owned territory proposed to be annexed as determined by said
legislative body; and
WHEREAS, said territory is contiguous to the City of Lodi, and
is uninhabited territory in the County of San Joaquin;
NOW, THEREFORE, the said Council of the City of Lodi does
hereby approve the annexation of the territory hereinafter described to
the City of Lodi, and does hereby further ordain that the said territory
be and is hereby annexed to the City of Lodi.
That said territory, the annexation of which to the City of Lodi
is herein approved, is all that territory situate in the County of San
Joaquin, State of Caliiornia, more particularly described as follows:
A portion of the Northwest Quarter of Section
13, Township 3 North, Range 6 East, Mount Diablo Base
and Meridian, being more particularly described as follows:
Beginning at the intersection of the south line of
said Northwest one-quarter section with the centerline of
Church Street (40 feet wide), said point being shown on
Map of Survey filed in Book of Surveys, Volume 14, page 122,
San Joaquin County Records, said centerline also being on
the existing City Limit line of the City of Lodi, as described
by City of Lodi Ordinance No. 924, ROBBY'S ADDITION;
thence North 02" 00' 00" East along said centerline and City
Limit line, 30.00 feet; thence along said City Limit line the
following four courses: (1) South 87" 25' 30" West, 200. 00
feet, (2) North 02" 00' 00" East, parallel with the center-
line of said Church Street, 300.00 feet, (3) North 87" 25' 30"
East, 10.00 feet, and (4) North 02" 00' 00" East, parallel

with the centerline of said Church Street, 170. 00 feet to a
point in the existing City Limit line as described by City
of Lodi Resolution No. 3669, GOEHRING ADDITION; thence
North 87" 25' 30" East along said City Limit line and south
line of said Goehring Addition, 2 10. 05 feet to the East right
of.way line of said Church Street; thence North 87" 40' East
continuing along said City Limit line and south line of said
Goehring Addition, 758.80 feet to the west line of the
Southern Pacific Railroad 100 ioot wide right of way, said
south line of Goehring Addition being the North line of those
certain parcels of land shown on Map of Survey filed in Book
of Surveys; Volume 16, page 67, San Joaquin County Records;
thence South 03" 54' 00" West along said west Railroad right
of way line, 2 17. 14 feet to the southeast corner of that
certain 3. 146 Ac. Net parcel of land shown on said Map of
Survey; thence South 87" 45' 50" West along the south line
of said 3. 146 Ac. Net parcel of land, 75 1.49 feet to the east
right of way line of said 40 foot wide Church Street; thence
South C2O 00' 00" West along said east right of way line,
285. 78 feet to a point in aforesaid south line of the northwest
one-quarter of said Section 13; thence South 87" 42' West
along said south line, 20. 05 feet to the point of beginning.

certify that Ordinance No. 1040 was introduced at a regular meeting
of the City Council of the City of Lodi held August 2 1, 1974, and was
thereafter passed, adopted and ordered to print at a regular meeting
of said Council held September 4, 1974, by the following vote:
Ayes: Councilmen - EHRHARDT, HUGHES, KATNICH,
PINKERTON and SCHAFFER
Noes : Councilmen - None
Absent: Councilmen - None
I further certify that Ordinance No. 1040 was approved and
signed by the Mayor on the date of its passage and the same has-been
published pursuant to law.
