Be it ordained by the Boar& /of the City of Lodi as follows:
See, 1. It shall be and hereby is made unlavlful for any person or
persons, iim, corqoration, partnership, organization, socicty, club,
or associztion, either as uwner, principal, agent, eraployee , or otrlemise,
to sell, furnish, serve, or give aI:ray, or in any planner dispose of, either
directly or indirectly, to any pei-son,or persons, any spirituous,
vinous, malt, nixed, fermented, distilled, alcoholic, or intoxicating
liquors xithin the corporate limits of the City of Lodi, except as
here ina 1 t e r p r ovi d.e d .
See, 2. It shall ne and hereby is made unlauful for any person or
persons, fi-m, corporation, club or associstion, eitiier as ov-.-.er,
principal, agent, servant , eiyployee, or otherwise, to establish, conduct
or keep a place, vithin the corporate limits of the City oi Lodi, wliiere
mirituou-s, vinous, indt, mixed, fe-menteS., distilled., alcholic, or
my intoxicating l_ic,uors are sold, seriaed, furnished or f,iven cyiay, or

Sec. 3, It shall not be unlawful ucler tiiis ordinance,
(a) To serve any of the liquors ixentione8 in Article 1
hereof, in a ixivate home to members of the fcvnily or to guests, \ken
such home is not a place of pblic resort, an4grien no rnoney or other
representative of value, or my valuable consideration is, or is to be
given or receive4 therefor:

(b) To use wine at the sacramntal service of
re1 igious organization:
(c) FOT any registered pharmacist to sell or dispense
alcoholic liquors at a phamacy, for nedicinal prposes only, upon a
mitten prescription, calling for not to exceed eight ounces of slcoholic
liquor; such sale shall be on the date of the issuance of said pre-
scription, and said prescription shall not oe relilled. Every such
prescription shall be issued-, signed and dated by a duly licensed
physician, and shall have endorsed upon it by such physician the name
and tne address of tile person for whose aae such prescri2tion is made,
and tne statement that in his opiinion the liquor prescribed is re-
qaired by such person as a medicine,

All such prescriptions shall be kept on file for oils year

a valid permit from the Board. of Trustees of the City of Lodi, to sell
any of tile liquors rxeiltioiied in Article 1 hereo.f, in quantities of
not less than 21 ounces, -pr'ovided said liquors shall not be sold before

See, 4. It shall be unlawful for the owner Oi- manager of any
place of phlic resort, nilere any alcoilolic liquor nay not legally
be sold, to pemit therein the &xiicing of any such liquor, 2nd it shall
be unlav€ul for the oymer or menager of any place, diere such liquor may legally be sold, to permit therein the drinking of any such Iiquor at any fime when it may not legally be sold therein.
See, 5, The Board of Trustees, of said City of Lodi, shall lime

See. 6, The Board of TrustLes, may, at any time, in its 6-iscretion,
without notice, revoke, rescind or crncel zny pemit for a liquor
license therctofore granted., and may cancel zn6. SLeclare forfeite6- any
license issued-.
See. 7, Any person violating any of the provisio-ns of tiiis ordi-
nance, shall be deemed- guilty of 2 misd.eineanoi* and upoz conviction
thereof shall 5e piiished by a fine not exceerling $300.00 or by im-
prisoment in the County jail of Ss?n Joaquin County, for 2 period not
exceeding three months, or by both such fine and iniprisomxent.
See. 8. 611 parts of ordinances in conrElict aitli tlie provisions
of this ordinance, are ’hereby repealed.
