ORDINANCE NO. 1485
AN ORDINANCE OF THE LODl CITY COUNCIL
AMENDING LODI MUNICIPAL CODE SECTIONS 6.04.030, 6.08.160
AND 12.12.020 RELATING TO DOMESTIC ANIMALS IN PARKS
BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOWS:
SECTION 1. Lodi Municipal Code Section 6.04.030 relating to animals
at large is hereby amended to read as follows:
"6.04.030. ANIMALS AT LARGE.
"It is the duty of the animal control officer to take up and
impound, as provided in this chapter, any domestic animal or fowl that
is found running at large in or upon any street, alley or public place
except as provided in Section 12.12.020(6) of this Code, within the
corporate limits of the City or upon the private premises of any
person, firm or corporation other than the person, firm or corporation
owning or having the custody or control of the animal or fowl."
SECTION 2. Lodi Municipal Code Section 6.08.160 relating to dogs at
large is hereby amended to read as follows:
"6.08.160. DOGS AT LARGE.
"No person owning any dog or having the care, custody or control
or possession of any dog shall except as provided in Section
12.12.020(6) of this Code, suffer, allow or permit such dog to run, be
or remain at large on any public street, road, alley, park, square, or
other public place, or upon any private property other than the
property of the owner or custodian of such dog without the consent of

the owner of such property within the corporate limits of the 'City.
P11 dogs are "running at large" within the meaning of this section
unless tied, restrained by chain, strap or cord not exceeding six (6)
feet in length attached to their collars and actually held by some
person or tied or restrained in an automobile or other vehicle, or
unless staked or fastened or kept securely in an enclosure."
SECTION 3. Lodi Municipal Code Section 12.12.020 is hereby amended
as follows:
12.12.020 DOMESTIC ANIMALS.
A. ANIMALS PROHIBITED.
Notwithstanding subdivision (B) of this section, no person having
care or custody of a dog or other domestic animal shall allow such
onimal in any park whether restrained or at large. For purposes of
this section, an animal is "at large" unless tied, restrained by chain,
strap or cord atthched to their collars and actually held by some
person or tied or restrained in an automobile or other vehicle, or
unless staked or fastened or kept securely in an enclosure. This
section shall not apply to dogs used by public law enforcement agencies
nor to animals in parking lots or walkways adjacent to parks.
B. EXCEPTIONS.
The director of recreation and parks shall be authorized to
designate, by appropriate signs, specified parks or portions of parks
in which it shall be permissible to allow dogs to be present without
leashes or other restraints. The owner or handler of any dog present
in such desiyated parks shall be required upon request to pi'esent
proof of a current rabies vaccination for such animal.
C. CLEAN UP REQUIRED.
It shall be the duty of any person having care or custody of any
animal in a park to clean up after such animal. All waste shall be
collected by such persons and deposited in an appropriate receptical or
container.
SECTION 4. All ordinances and parts of ordinances in conflict
herewith are repealed insofar as such conflict may exist.
SECT!ON 5. This ordinance shall be published one time in the "Lodi
News Sentinel", a daily newspaper of general circulation printed and
published in the City of Lodi and shall be fn force and take effect
thirty days from and after its passage and approval.
