Section 1. Section 15.20.010 through 15.20.360 inclusive of
the Code of the City of Lodi is hereby repealed and is superseded
and replaced by new sections 15.20.010 through 15.20.480
inclusive as hereinafter set forth.
Section 2. There is hereby adopted new Sections 15.20.010
through 15.20.480 of the Code of the City of Lodi to read in full

15.20.010 ADOPTION
The provisions set forth in the "Uniform Fire Code, 1988
Edition", together with the appendixes I-A, I-E, I-C, 11-A,
1'1-A, 1'1-B, \'I-D thereto, are hereby adopted 2s the fire
prevention code of the city. The fire prevention code of
the city shall apply in all matters pertaining to storage,
handling 2nd use of hazardous substances, materials and
devices; 2nd fo conditions hazardous to life and property in
the use or occupancy of buildings or premises vithin the
ci:y.

adopting the 1989 Supplement to the Uniform Codes relating
to the Uniform Fire Code, Uniform Fire Code Appendix and the
Fire Code Standards, as promulgated by the International
Conference of Building Officials and the h'estern Fire
Chiefs Association, 2nd by this reference is made 2 part of

15.20.030 EUEEAU OF FIRE PREVEXTJON

The Zuretu of Fire Frevenrion is est~biished in the
Fire Depirrrnent of the City of Lodi an< xhich st.all be
cperarel czder :fie supervision of :he chief of the
department. The Bureau of Fire Prevention shall
enforce and is authorized to issue such orders or
notices as may be necessary for the enforcement. of the'
Uniform Fire Code, National Fire Codes and where
necessary and appropriate, any fire or life safety
sections of the California Health and Safety Code,
California Penal Code, and all other city, county or state
fire or life safety related lah's 0:- codes not specifically
covered in any part of this code.
15.20.040 JURISDICTION DEFINED
Whenever the k'ord "jurisdiction" is used in the Uniform
Fire Code ~t shall mean the City of Lodi.
15.20.050 SECTION 2.101.9 ADDED RESPONSIBILITY FOR
ENFORCEMENT
Section 2.101.9 of the "Uniform Fire Code, 1988 Edition" adopted
by Section 15.20.010 is added to read as follows:
The apprehension, detention and prosecution of those persons
found to be in violation of the arson, explosive and fire
insurance fraud sections of the California Penal Code.
15.20.060 SECTIOK 2.103b ADDED FIRE PREVENTION BUREALI-
ARSON INVESTIGATORS
Section 2.103b of the "Uniform Fire Code, 1988 Edition" adopted
by Section 15.20.010 is added to read as follovs:

All sworn members assigned to the Fire Prevention Bureau are
hereby assigned as Arson Investigators and as such shall
enforce the provisions of the Cal~fornia Penal Code as it
pertains to arson.
15.20.070 SECTION 2.105 AMENDED AUTHORITY OF FIRE
PERSONNEL TO EXERCISE
POWERS OF POLICE OFFICER
Section 2.105 ci the "Uniform Fire Code, 1988 Edition" adopted by
Section 15.20.010 is amended to read as follows:
The Fire Chief and members of the Fire Prevention Bureau
shall be peace officers as described in Section 830.31 of
the California Penal Code.

15.20.090 SECTION 3.101 ANENDED VIOLATION
Section 3.101 cf the "Uniform Fire Code, 1968 Edition" adopted by
Section 15.20.010 is amended to read as follows:
No person, whether as oktner, lessee, sublessee or occupant,
shall use, occup)' or maintain any occupancy, premises, or
vehicle oi cause or permit the same to be done, contrary to
or in violation of any of the provisions of this fire code
or any lavful order issued by the Fire Chief or his
authorized representatives under this chapter. Any person
violating the provisions of this section is guilty of a
misdemeanor for each day such violation continues.
15.20.100 SECTION 4. 107f ADDED REVOCATION, SUSPENSION
DENIAL
Section b.107f of the "Uniform Fire Code, 1988 Edition" adopted
by Section 15.20.010 is added to read as follows:
The Fire Chief further shall have the power to revoke, suspend,
or deny the granting of any permit required pursuant to the
provision of the Code for any of the following reasons:
When deemed necessary for the protection of
life, limb, or property; or
For the violation of any provisions of this
Code; or
for changing the occupancy, equipment,
materizls, processes, or other conditions
in such E manner as to create 2 greater
danger of fire or explosion or less

Section 4.109 of the "Uniform Fire Code, 198.S Edition" adopted by
Section 15.20.030 is added to read as follows:

where person(s) monitor and/or receive emergency signals
from alarm systems, and thereafter, relay messages from such
signals by live voice to the City of Lodi PoliceIFire
Dispatch Center.

(L) Every building hereafter changed in occupancy
c3assificatIon and the total floor area is 6,000 square
feet or mo:e. The character of the occupancy of '
existing buildings may be chsnged subject to the
apprcval of the Fire Chief, and the building may be
occupied fbr the purposes in other groups h'ithout
confcrrnin& to the requirements of this paragraph for

15.20.410 SECTION 79.115h ADDED SAFEGUARDING TANKS
Section 79.115h of the "Uniform Fire Code, 1988 Edition" adopted

Underground tanks that have been removed from the ground and
abovegound tanks ttiat are no longer in service shall be
clear of flammable vapors as certified by an approved
testing lab.
The Fire Chief may limit the number of flammable liquid
tanks that are stored on any property.
The storage of tanks shall be as approved by the Fire Chief.
15.20.420 SECTION 70.501 LIMITS STATIONARY TANK STORAGE,
ABOVEGROUND OUTSIDE OF
BUILDINGS
The limits referred to in Section 79.501 of the "Uniform
Fire Code, 1988 Edition" adopted by Section 1.5.20.010 in
which the storage of Class I and Class 11 liquids in
aboveground tanks outside of buildings is prohibited in the
entire city except areas zoned C-E'I, !!-I 2nd M-2 25 such
zones are defined in the zoning regulations of the city.

Class I or Class 11 liquids ma). be cispensed into the fuel
tank of a motor vehicle from an outdoor aboveground special
enclosure conforming to this section.
Outside aboveground special enclosures shall have tanks
enclosed by reinforced concrete at least 6 inches thick and
shall bear an Underwriters's Label.
Fill opening shall be equipped with a closure designed so
that it may be locked.
Outside aboveground special enclosures shall be at least 10
feet from any building or combustible storage and so located
as such additional distance shall be provided as will ensure
that any vehicle, equipment or contsiner being filled
directly from such tank shall be not less than 10 feet from
~ny structure or other combustible. Outside aboveground
special enclosures shall be kept at least 5 feet from
property line and public ways.
Flammable and combustible liquids shall not be transferred
from aboveground special enclosures by gravity discharge.
Electrical controls shall meet all requirements of Section
79.903e of the "Unicorm Fire Code, IOeE Edition".
Cispensing devices shall conform tc Seccion 70-903c of the

Porcable fire extinguishers with a minimum classification of
