HomeMy WebLinkAboutAgenda Report - May 20, 1998 (64)AGENDA TITLE: Amend Bridgetowne Park Improvement Agreement and Accept Deed MEETING DATE: May 20, 1998 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council authorize the City Manager to sign an amendment to the Improvement Agreement dated November 18, 1996, covering the Bridgetowne Park improvements, accept the deed, and authorize the appropriation of funds as outlined in the agreement. BACKGROUND INFORMATION: The November 18, 1996, agreement with the developers of Bridgetowne Subdivision covers the purchase and development of a park within that subdivision. This agreement provided that the City would take title to the park land upon completion by the developer and acceptance by the City of the park irrigation and landscaping improvements. The City plans to locate a well within the park boundaries. In order for the master site plan of the park to be completed, the actual location of this well is needed. That requires that a test well be drilled. The developer would prefer that the City has title to the land before the test well is drilled. This amendment to the agreement would allow the City to take title now. No other conditions of the original agreement would change. The developer will remain responsible for the park site, including but not limited to the maintenance and dust control of the property, until the City accepts the improvements. When title to the land is transferred clear and free of encumbrances, developer will be paid $10,000, as outlined in the agreement. This amount must be appropriated from the Parks and Recreation Developer Impact Mitigation Fee Fund.
