AN UNCODIFIED U&GENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LODI ESTABLISHING OPTIONS FOR REFUSE COLLECTION AND SETTING FATES FOR LOW-VOLUME RESIDENTIAL WASTE GENERATORS WHEREAS, the City Council of the City of Lodi on October 21, 1992 adopted Ordinance No. 1558 establishing services and providing rates for residential waste collection including mandatory recycling; and WHEREAS, it now appears reasonable and necessary to offer and provide an option for low volume generators of residential waste; and WHEREAS, it also appears reasonable and necessary to offer <prepaid tags for occasional collection of additional refuse generated by residences; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS: SECTION 1. Lcdi Municipal Code Chapter 13.16 - SOLID WASTE - as it relates to residential solid waste collection monthly rates is hereby amended by adding the following language thereto: Rate6. 1. The rate for once weekly collection of a 20-gallon waste cart shall be ten dollars ($10.00) per month. .. 2. Any customer may also purchase the City or the franchisee for the price of five dollars ($5.00) each specially marked tags for affixing to trash bags which will then be collected with routine waste removal service. Such tags may not be used in lieu of other required waste removal services for residences. 3. The City Council of the City of Lodi hereby finds and declares pursuant to Public Resources Code Section 21080 that such rates are necessary and reasonable for the usual operating expenses of the franchisee, including employee wages and benefits and for the purpose of purchasing facilities, equipment and materials necessary to implement and carry out a Council-mandated recycling program. SECTION 2. This is an urgency ordinance under Government Code Section 36934, and is based on health, safety and welfare considerations arising from the need to collect appropriate fees for waste removal. SECTION 3. This urgency ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect immediately.
