HomeMy WebLinkAboutOrdinances - No. 1690ORDINANCE NO. 1690 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LODl AUTHORIZING AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF LODl AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM BE IT ORDAINED BY THE LODl CITY COUNCIL AS FOLLOWS: Section 1. That an amendment to the contract between the City Council of the City of Lodi and the Board of Administration, California Public Employees' Retirement System is hereby authorized, a copy of said amendment being attached bereto, marked Exhibit, and by such reference made a part hereof as though herein set out in full. Section 2. execute said amendment for and on behalf of said Agency. The Mayor of the City of Lodi is hereby authorized, empowered, and directed to Section 3. as such conflict may exist. All ordinances and parts of ordinances in conflict herewith are repealed insofar Section 4. This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval. i 2000. Public Agency, in accordance with Government Cod2 Section 20790, ceased to be a "employer" for purposes of Section 20834 effective on July 1, 1977. Public Agency shall contribute to said Retirement System the contributions determinEd by actuarial valuations of prior and future service liability with respect to loczl miscellaneous members and locA safety members oi said Retirement System. Public Agency shall also contribute to said Retirement System as follows: a. Contributions required per covered member on account of the 1959 Survivor Benefits provided under Siction 21573 07 szid Retirement Law. (Subject ~ZJ annuzl chanp.) In addition, all assets and lizbilities of Public Agency and i:s employees sf~ll bs pookd in a single account, based on term insurance rates, for survivors of all local miscellaneous mernbirs and local safety members. b. Contributions required of Public Agency and its employees shall be subject ic adjustment by Board on account of amendments to the Public Employees' Retireme;> Law, and on account of the experience under the Retirement System as determined b) the periodic investigation and valuation required by said Retirement Law. 13. Contributions required of Public Agency and its employees shall be paid by Publ:c Agency to the Retirement System within fifteen days after the end of tile period to whici said contributions refer or as may be prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, proper adjustment skfl be made in connection with subsequent remittances. Adjustments on account of errors in contributions required of any employee may De made by direct payments behvern the employee and the Board. 3. In addition to the classes of employees excluded from membership by said Retiremmt Law, the following classes of employees shall not become members of said Retirement System: a. PERSONS COMPENSATED ON AN HOURLY BASIS WHO ARE flIRED JUNE 1,1966 OR TH1EREAFTER. Assets heretofore accumulated with rzspect to members in the local retirement systern have been transferred to tne Pujlic Employees' Retirement System and applied again3t the liability for prior service incurred thereunder. That portion of the assets so transferred which represent the accumulated contributions (plus interest thereci;) required of the employees under said local system bas been credited to the individual membership account of each such employes under the Public Employees' Retirement System. Benefits paid to pensioners and annuitants undsr ti72 local system on the effective dats of the contract were recalculated, as authorkid by Section 20481 of the Government Code, to conform with benefits zipplicable to persons retiring after the effective date of the contract except that no benefit which would have been payable under ths continuation of the local system shall be reduced.
