Call to Order / Roll Call The Special City Council meeting of August 23, 2016, was called to order by Mayor Chandler at 7:00 a.m. Present: Council Member Johnson, Council Member Mounce, Council Member Nakanishi, Mayor Pro Tempore Kuehne, and Mayor Chandler Absent: None Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Ferraiolo NOTE: Council Member Nakanishi arrived at 7:01 a.m. B. Reaular Meetina B-1 Consider Adopting Resolution Providing for the Appointment of Officers That Were to Be Elected and Cancelling the November 8, 2016, Election of Officers City Clerk Ferraiolo reported that, at the close of the nomination period, there were two qualified candidates for two seats on the City Council and that Elections Code §10229 allows for the following courses of action to be taken by Council if there are not more candidates than offices to be elected: 1) Appoint to the office the persons who have been nominated; 2) Appoint to the office any eligible voter if no one has been nominated; and 3) Hold the election if either no one or only one person has been nominated. Further, Council was notified that there were not more candidates than offices to be elected and that the persons nominated were Bob Johnson and JoAnne Mounce. A notice was published in the newspaper on August 17 notifying the public of these facts and that the Council will meet on August 23, at least five days following the publication date, to either make the appointments or direct an election to be held. Ms. Ferraiolo stated that Council has until August 25 to take action, which is the 75th day before the election. If no action is taken, the election shall be held. The San Joaquin County Registrar of Voters estimates a cost savings of roughly $10,000 to cancel the election of officers, which would offset the election costs associated with the two City measures. If Council opts to make the appointments pursuant to the Elections Code, statements of write-in candidacy cannot be accepted after the appointments are made. Those appointed to office would qualify and take office and serve exactly as if elected at a municipal election for the office. Council Member Nakanishi stated he believed elections should be fair and efficient and not be costly, adding that a savings of $10,000 in election costs would benefit the City and citizens and cancelling the election would eliminate the tensions associated with running campaigns. Mayor Pro Tempore Kuehne made a motion, second by Council Member Nakanishi, to adopt Resolution No. 2016-159 providing for the appointment of officers that were to be elected and cancelling the November 8, 2016, election of officers. VOTE: The above motion carried by the following vote: Ayes: Council Member Johnson, Council Member Mounce, Council Member Nakanishi, Mayor Pro Tempore Kuehne, and Mayor Chandler Noes: None Absent: None C.
