AGENDA TITLE: Short-term Land Lease at White Slough Water Pollution Control Facility (270 acres)

RECOMMENDED ACTION: That the City Council adopt the attached resolution leasing 270 acres of
land at the White Slough Water Pollution Control Facility (WSWPCF) to
Bechthold-Kirschenman Farms. The lease term shall be April 16, 1998
through October 15, 1998.
BACKGROUND INFORMATION: The 270 acres of WSWPCF property is the acreage under
consideration by the California Youth Soccer Association (CYSA).
Since CYSA is still evaluating the feasibility of using this property, it
is felt to be in the City's best interest to allow a short-term lease of
the property for farming operations. (Rules of lease are similar to current leases except for 30 -day
termination clause.)
Bechthold-Kirschenman Farms, which currently is farming other land at WSWPCF, is interested in
farming the full 270 acres at $80 per acre (see attached March 20, 1998 letter). This would provide the
sewer utility with approximately $21,600 in rental fees. Bechthold-Ki rschen man Farms has been willing to
farm this property under short-term lease for the last two seasons. This has been advantageous not only
for the revenue, but also for the maintenance and upkeep in appearance which takes place. The lease
amount of $21,600 will be reduced by $3,600 over paid by the tenant during their 1997 lease on this
property.

This letter concerns the 270 -acre parcel at the White Slough Water Pollution Control
Facility. We are fully aware of the difficulty the City is having with the soccer complex
negotiations. We are interested in a short-term lease (April 15 through October 15) for
the current year at $80.00 per acre.
If the complex is approved we are willing to take the risk of cancellation and will not file a
claim for crop loss against the City.
Our intentions are to prepare a portion to plant alfalfa this summer to coincide with our
recently approved 5 -year lease, which will commence January 1999. The remainder of
the acreage will be planted in feed corn.
We wish to apply the over payment of $3600.00 we made on unused ground last year to
the rent.

APPROVING THE SHORT-TERM LAND LEASE OF 270
ACRES AT WHITE SLOUGH WATER POLLUTION
CONTROL FACILITY
BE IT RESOLVED, that the Lodi City Council does hereby approve the short-
term land lease with Bechthold-Kirschenman Farms for 270 acres at the White Slough
Water Pollution Control Facility, effective April 16, 1998 and terminating October 15,
1998.
