Call to Order / Roll Call The Special City Council meeting of July 26, 2011, was called to order by Mayor Johnson at 7:00 a.m. Present: Council Member Hansen, Council Member Nakanishi, Mayor Pro Tempore Mounce, and Mayor Johnson Absent: Council Member Katzakian Also Present: City Manager Bartlam, City Attorney Schwabauer, and City Clerk Johl B. Authorize the Mayor to Send a Public Comment Letter to the San Joaquin County Superior Court Regarding the Planned Tracy and Lodi Court Closures (CA) City Attorney Schwabauer provided a brief overview of the draft comment letter in opposition to the proposed closures of the Tracy and Lodi courthouses as set forth in the Council Communication. In response to Mayor Johnson, Mr. Schwabauer stated that, even if small claims are eliminated, the local courts will still handle pre-trial hearings and misdemeanor trials. In response to Mayor Johnson, Mr. Schwabauer stated the proposal will not eliminate the overall presence of a district attorney in Lodi but the district attorney will not have an office in Lodi. In response to Council Member Hansen, Mr. Bartlam stated the County budget has restored positions but the district attorney has yet to respond to the office space situation in Lodi. In response to Council Member Hansen, Mr. Schwabauer stated he has been unable to locate a budget analysis setting forth the savings associated with closing small claims court in Lodi. In response to Mayor Johnson, Mr. Schwabauer stated he does have a call into Tracy to find out how it is responding to the proposed court closures. In response to Council Member Hansen, Mr. Schwabauer stated he is not sure why the Manteca court was selected to remain open. Mayor Pro Tempore Mounce made a motion, second by Council Member Hansen, to authorize the Mayor to send a public comment letter to the San Joaquin County Superior Court regarding the planned Tracy and Lodi court closures. VOTE: The above motion carried by the following vote: Ayes: Council Member Hansen, Council Member Nakanishi, Mayor Pro Tempore Mounce, and Mayor Johnson Noes: None Absent: Council Member Katzakian C.
