CALL TO ORDER / ROLL CALL The Special City Council meeting of May 16, 2005, was called to order by Mayor Beckman at 5:36 p.m. Present: Council Members — Hansen, Hitchcock (arrived at 5:45 p.m.), Johnson, Mounce (arrived at 5:49 p.m.), and Mayor Beckman Absent: Council Members — None Also Present: City Attorney Schwabauer and City Clerk Blackston Note: City Manager King was excused from attending the meeting by Mayor Beckman. B. CLOSED SESSION At 5:36 p.m., Mayor Beckman adjourned the Special City Council meeting to a Closed Session to discuss the following matter: B-1 Review of Council Appointees — City Clerk and City Attorney (Government Code §54957) The Closed Session adjourned at 7:22 p.m. C. RETURN TO OPEN SESSION / DISCLOSURE OF ACTION At 7:22 p.m., Mayor Beckman reconvened the Special City Council meeting and disclosed that no reportable action was taken in closed session. D. REGULAR CALENDAR D-1 "Discussion of Council Appointee compensation and benefits — City Clerk and City Attorney (Government Code §54957)" MOTION #1 / VOTE: The City Council, on motion of Mayor Beckman, Hansen second, unanimously adopted Resolution No. 2005-98 amending Section 14, "Severance Pay," of the employment contract with City Attorney Schwabauer to continue to pay health insurance benefits upon the same terms set forth in the agreement for six months from date of termination. Council Member Hansen reported fiat the City Attorney recognized the City's financial position and requested not to be granted a salary increase this year. Mr. Hansen commented that it was commendable and a reflection of his character. In regard to the City Clerk, Mr. Hansen stated that, in terms of benefit analysis with other comparable positions in the City, her salary is insufficient and she is deserving of a raise. He believed that it was a reflection of Ms. Blackston's commitment to the City that she also requested not to receive a salary increase. MOTION #2: Council Member Hansen made a motion, Mounce second, to allow City Clerk Blackston to sell 40 hours of Administrative Leave on a one-time basis. DISCUSSION: Mayor Pro Tempore Hitchcock expressed concern regarding setting a precedent related to selling back leave time. She agreed with Mr. Hansen that the City Clerk's salary is deficient compared to other positions. She asked that the motion be substituted with a 5% salary increase. Continued May 16, 2005 The request to amend the motion was declined. Council Member Hansen commented that when the financial condition of the City stabilizes there should be significant salary increases granted to the City Clerk. Council Member Johnson stated that the City Clerk was an excellent employee; however, in light of current circumstances and his unwillingness to set a precedent, he would oppose the motion. VOTE: The above motion carried by the following vote: Ayes: Council Members — Hitchcock, Hansen, Mounce, and Mayor Beckman Noes: Council Members — Johnson Absent: Council Members — None E.
