City Manager Claves, Ad- ministrative Assistant Brown, City Attorney Mullen and Plan- ning Director Rodgers present. MINUTES Minutes of November 18, 1959 and December 2, 1959 were approved as written and mailed on mo- tion of Councilman Culbertson, Katzakian second. PUBLIC HEARINGS FREEWAY ADDITION ORD. NO. 665 INTRODUCED 463 Notice thereof having been published in accord- ance with law, Mayor Brown called for public hear- ing on the proposed annexation of the Freeway Addition. The City Manager read the recommenda- tion of the Planning Commission that the annexa- tion be approved. There were no protests, written or oral. On motion of Councilman Robinson, Cul- bertson second, the Council introduced Ordinance No. 663 annexing the Freeway Addition to the City of Lodi by reading of title only and waiving reading of the ordinance in full. Notice thereof having been published in accord- ance with law, the Mayor called for public hear- ing on the completion of and the assessment on the Vine -Windsor Street Lighting District. There were no protests, written or oral. Mr. Wenge of 708 West Vine Street requested that an error in the amount of his assessment be corrected. On motion of Councilman Robinson_, Katzakian second, the Council adopted Resolution No. 2279 confirming the assessment on the Vine -Windsor Street Light- ing District which was at the rate of $1.61 per front foot. Notice thereof having been published in accord- ance with law, the Mayor called for public hearing on the proposed establishment of building set- back lines on West Lockeford Street between Church Street and California Street at 40 feet each side of and parallel to a certain center line. There were no protests, written or oral, and on motion of Councilman Katzakian, Culbertson second, the Council introduced Ordinance No. 664 establishing said lines by reading of title only and waiving the reading of the ordinance in full. Notice thereof having been published in accord- ance with law, Mayor Brown called for public hearing on the proposed establishment of building setback lines on South Sacramento Street 30 feet each side of and parallel to the center line of said street between Lodi Avenue and a point 350 feet south of Tamarack Drive. There were no protests, written or oral, and on motion of Councilman Mitchell, Robinson second, the Coun- cil introduced Ordinance No. 665 establishing said lines by reading of title only and waiving the reading of the ordinance in full. 464 WERNER REST HOME DENIED PLANNING MILLER FAMILY PLAN HOME minuuee of yecemoer to, IeDy conL1nueu Notice thereof having been published in accordance with law, Mayor Brown called for public hearing on the appeal of affected resi- dents from the decision of the City Planning Commission granting a zoning adjustment to Mr. Ed Werner to erect a 35-bedrest home at 549 and 600 York Street. City Manager Glaves read the memorandum from Planning Director Rodgers reporting the action thereon of the Planning Commission. City Attorney Mullen explained what action could be taken under the Zoning Ordinance, that is, that the use of the non -conforming buildings could be changed if it would be a distinct benefit to the district and that any change other than for the present R-1 use for the residence and vacant lot would require rezoning. Phe following property owners in the area then spoke against having the manufacturing use changed to a rest home: James Newman, 711 York Street; Barbara Duerksen, 715 York Street; Ray Mahoney, 537 York Street; Mrs. R.J. -Todd, 543 York Street; and Fred Buechler, 530 York Street. A letter from Mr. and Mrs. L.H. Lukens, 547 Park Street, iri favor of the rest home was read. Mr. Ed Werner spoke in behalf of his request for a rest home. After considerable discussion of the factors in- volved, the Council overruled the decision of the Planning Commission on motion of Councilman Katzakian, Mitchell second, by the following vote: AYES: Councilmen - Culbertson, Katzakian, Mitchell and Brown NOES: COMMISSION ELEMENTARY SCHOOL IN LAWRENCE RANCH SUBDIVISION AMENDMENTS TO COMMERCIAL USE LIST Councilmen - Robinson The following actions of the Planning Cnn- missi.on were reported: 1. Granted a use permit to Mr. Daniel Miller to operate a State Family Plan Horne for four aged persons at 1202 Liebig Street in the R-3 zone. 2. Granted a use permit to the Lodi Ele- mentary School District to construct an elementary school on an 11 -acre site in the Lawrence Ranch area immediately north of the stadium. The Planning Commission reaffirmed its orig- inal recommendation regarding screening of outdoor type businesses in the C_1 zone which had been referred back to the Planning Com- mission by the Council at its meeting of November 4 along with a request that hours of closing be studied also. The Planning Com- mission felt that the proposal for a limita- tion of closing hours was unnecessary since the,economics of a neighborhood shopping area would ordinarily preclude unreasonable clos- ing time. Chief Building Inspector McClure stated that the screening fence height should be clarified to conform with front yard require- ments where necessary. It was decided that the resolution should be in final form before adoption, and on motion of Councilman Culbert- son the matter was continued to the meeting of January 6, 1960. CHURCH S'1'. ADDN. R-1 Minutes of December 16, 1959 continued 465 The Planning Commission recommended that the Church Street Addition be annexed with R-1 zoning. STREET IMPROVE -Councilman Robinson commented on the Planning MENTS & Commission minutes of November 23, stating that REVERSE FRONT- in considering the preliminary map of Lawrence AGE LOTS Ranch Subdivision, Unit No. 2, it appeared to be exceeding its powers in regard to improvement of streets having reverse frontage lots. Such a matter would require determination of ooli.cy by the City Council. On motion of Councilman Cul- bertson, Katzakian second, the Council requested a report from Planning Director Rodgers an the experiences of other cities in regard to payment of street improvement for streets abutting re- verse frontage lots. COMMUNICATIONS CLAIM FOR DAMAGES ABC LICENSES Claim for Damages from Allen Sanguinetti et al in the amount of $300 was rejected and referred to the City's Agent of Record on motion of Council- man Katzakian, Mitchell second. Notices of application for Alcoholic Beverage License as follows: 1. On Sale Beer, J.S. Wilson, Wayside Village Cafe, E/S Highway 99 and Morse Road. 2. Transfer On Sale Beer and Wine, Lawrence McGrath, Lillian McGrath and Floyd Schnell, Lido Club, 18 South Main Street. 3. Transfer On -Sale Beer and Wine, Niki Werner, Liberty Cafe, 114 North Sacramento Street. 4. Transfer Off Sale Beer and Wine, George Babas and Lauren Van Kirk, Tokay Market, 320 N. California St. 5. Transfer Off Sale Beer and Wine, Edward Chan and Frank Leong, Valley Market, 112 East Elm Street. REPORTS OF THE CITY MANAGER LIABILITY INSURANCE City Manager Cleves reported that action should be taken on liability insurance for the coming year. The present carrier (American Surety Company) is asking for a rate increase because of the claims experience of the past year. The present rate is $1.072 per $100 of the City's payroll; the increase asked is $1.273, which would make a total premium of $12,387.98. The City Manager recommended that the new rate be accepted. with the feeling that if the City's losses are reduced in the coming year, the following year should see a reduction in premiums. The Agent of Record concurred. On motion of Councilman Mitchell, Katzakian second, the liability in- surance for 1960 was awarded to the American Surety Company for $12,387.98, all councilmen voting in favor thereof. 46 TRANSFORMER ' SPECS CHURCH STREET ADDITION RFS. BD. munuLes 01 uecemoer ib, 1.y7y continues The City Manager presented specifications for a 5000 KV transformer. Superintendent of Utilities Killelea was present to answer questions and explain that this transformer was to be used to service General Mills and vicinity in order to reduce line losses and is part of the plan to eventually change the system voltage to 12,000 volts. On motion of Councilman Mitchell, Culbertson, second, specifications for the transformer were approved and call for bids authorized by unanimous vote. The City Manager explained that a new resolu- tion setting public hearing for February 3, 1960 would be required on the intention to annex the Church Street Addition because of publication requirements. On motion of Councilman Culbertson, Katzakian second, the Council adopted Resolution No. 2280 giving notice of intention to annex the Church Street Addition and setting public hearing for February 3, 1960. City Manager Claves requested authorization to construct storm drains in Son -Ray and Ben- son Manor subdivision west of Mills Avenue. The drains would conform to the Master Storm Drainage Plan and acreage payments required of subdividers would be applied to the cost: however, the City would need to pay an addi- tional $;16,515. On motion of Councilman Cul- bertson, Katzakian second, the Council ap- proved 816,515 for storm drainage for Son - Ray and Benson Manor and also approved speci- fications and authorized advertising for bids on concrete pipe for said drains. Mr. Glaves reported that a pedestrian walkway was needed at the Kettleman Lane Crossing of the Southern Pacific railroad tracks and that soon a nro,ject would cost approximately $150. The Southern Pacific�or.:panv had.no objec- tion to such a walkway. On motion of Councilman Culbertson, Katzakian second, the City Council adopted Resolution No. 2283 endorsing the program of the Lodi District Chapter of the San Joaquin County Safety Council to avoid accidents during: the holiday season. Robert S. Fuller was reappointed trustee or the northern San Joaquin County Yoscuito abatement District for two years to Decem- ber 31, 1961 on motion of Councilman Katzak- ian, Mitchell second.
