HomeMy WebLinkAboutAgenda Report - February 18, 1998 E-13CITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Approve $200 Filing Fee for Election Initiatives MEETING DATE: February 18, 1998 PREPARED BY: City Clerk RECOMMENDED ACTION: That the City Council adopt the attached resolution establishing a fee for the processing of an initiative petition for any municipal measure. BACKGROUND INFORMATION: Section 9202(b) of the Elections Code of the State of California provides that any person filing a notice of intent with the elections official shall pay a fee to be established by the legislative body not to exceed two hundred dollars ($200) to be refunded to the filer if, within one year of the date of filing the notice of intent, the elections official certifies the sufficiency of the petition. In view of the time involved in processing an initiative petition, we believe this would be a prudent action and are recommending that the City Council adopt the attached resolution establishing a fee in the amount of $200 for the processing of an initiative petition for any municipal measure. D�o Flynn :- City Nkraqer, RESOLUTION NO. 98-28 A RESOLUTION OF THE LODI CITY COUNCIL ESTABLISHING A FEE FOR THE PROCESSING OF AN INITIATIVE PETITION FOR ANY MUNICIPAL MEASURE WHEREAS, §9202(b) of the Elections Code of the State of California authorizes the City Council to establish a fee not to exceed two hundred dollars ($200.00) for the purpose of processing an initiative petition; NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council hereby declares, determines and orders as follows: 1. That pursuant to §9202(b) of the Elections Code of the State of California, the City Council establishes a fee of $200.00 to be paid to the City Clerk by any person at the time of filing a Notice of Intent to circulate an initiative petition in the City of Lodi; and 2. The City Clerk is directed to deposit any fees collected pursuant to this Resolution into the general fund of the City. The fee will be refunded to the filer if, within one year of the date of filing the Notice of Intent, the Clerk certifies to the sufficiency of the petition. 3. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
