HomeMy WebLinkAboutMinutes - December 21, 1999 SS258 CITY OF LODI INFORMAL INFORMATIONAL MEETING "SHIRTSLEEVE" SESSION CARNEGIE FORUM 305 WEST PINE STREET TUESDAY, DECEMBER 21,1999 An Informal Informational Meeting ("Shirtsleeve" Session) of the Lodi City Council was held Tuesday, December 21, 1999 commencing at 7:00 a.m. ROLL CALL Present: Council Members — Hitchcock, Land, Nakanishi (arrived at 7:02 a.m.), Pennino and Mann (Mayor) Absent: Council Members — None Also Present: City Manager Flynn, Deputy City Manager Keeter, Public Works Director Prima, Transportation Manager Tobar and Deputy City Clerk Taylor Also in attendance was a representative from the Lodi News Sentinel and The Record. TOPIC(S) 1. Discuss ordinance amending Municipal Code Chapter 8.12, Section 8.12.030-D and authorize City Manager to designate smoking areas at City of Lodi outdoor areas ADJOURNMENT No action was taken by the City Council. The meeting was adjourned at approximately 7:14 a.m. ATTEST: Ja ueline ayl De City C erk Smoking at City -Owned Facilities Current Code: 8.12.010 Definitions. As used in this chapter: A. "City -owned building or facility" means any and all structures owned or under the control of the city, customarily -used for municipal purposes, including places of public assembly. B. "Enclosed space" means any space contained within a roof and walls on all sides, normally used for human habitation or occupation. C. "Sign" means a device utilizing letters at least one inch high, posted in a conspicuous place, advising that smoking is allowed within a room or space in which such sign is posted. D. "Smoke" or "smoking" means the inhaling, exhaling, lighting, burning or carrying of any lighted cigar, cigarette, pipe, tobacco product or other vegetable material customarily burned for the ingestion of the smoke produced thereby. (Ord. 1457 § 1 (part), 1989) 8.12.020 Prohibition of smoking in public buildings or facilities. It is unlawful for any person to smoke any cigar, cigarette, pipe, tobacco product or similar substance within any enclosed space located in any city -owned building or facility, whether or not such space is open to the public, unless appropriate signs are posted designating such space to be a "smoking permitted" area. (Ord. 1457 § 1 (part), 1989) 8.12.030 Exceptions. This chapter shall not apply to: A. Any city -owned outdoor facility, intended and utilized primarily for recreational purposes, including parks and stadiums or similar places where members of the public assemble to engage in or witness athletic competitions or entertainment events. However, smoking in such locations or facilities as designated by the city manager may be prohibited by posting of appropriate signs indicating that smoking is not permitted; B. Jail or detention facilities in which arrestees, sentenced or unsentenced prisoners are confined; C. Enclosed spaces in city -owned facilities designated by the city manager, and appropriately signed, allowing smoking. (Ord. 1457 § 1 (part), 1989) Recommended change: Revise 8.12.030 A. to include transit and other non - recreation facilites: A. Any city -owned outdoor facility, intended-and-utilized-pr-ifnar4l}-€or-recr-eational--ptifposes; including transit facilities. courtyards, parks and stadiums or similar places where members of the public assemble to engage in or witness athletic competitions or entertainment events.
