RECOMMENDED ACTION: That City Council adopt the attached resolution that includes the
stipulations and assurances required by the San Joaquin County
Council of Governments for the Measure K Noncompetitive Bicycle Projects,
and authorize the City Manager to sign all claim forms for these funds.
BACKGROUND INFORMATION: The Lodi Bicycle Transportation Master Plan was adopted on
November 16, 1994. The City of Lodi identified the various bike
lanes it wanted to create within the city limits. They would be
installed as part of other street work or as grants are obtained.
The Measure K bicycle program apportions approximately $15,000 per year to the City of Lodi for
bicycle programs. In order for the City to receive the funds, we must provide a one-time resolution and
an assurance, signed by the City Manager, for each project.

RESOLUTION NO. 98-16
A RESOLUTION OF THE LODI CITY COUNCIL
MAKING ASSURANCES ON BEHALF OF THE CITY
OF LODI CLAIMING MEASURE K BICYCLE
PROGRAM NON-COMPETITIVE FUNDS
WHEREAS, this project lies entirely within San Joaquin County, and does not duplicate
an existing bicycle facility and that the project is, or will be, contained in an adopted local or
regional bicycle plan; and
WHEREAS, this project is not by nature a maintenance or rehabilitation project, and this
agency certifies that it will bear responsibility for the maintenance and operation of the facility
presented in the claim; and
WHEREAS, Measure K Funds identified in this claim are not being used in place of
developer funds; and
WHEREAS, this agency, as a condition of eligibility for PROGRAM funds, is using its
pedestrian and bicycle Transportation Development Act funds for pedestrian and/or bicycle
projects; and
WHEREAS, a final report that includes completion date and final cost will be submitted to
COG upon project completion; and
WHEREAS, this agency possesses legal authority to claim PROGRAM funds for its
project and can finance, acquire, and construct it; and
WHEREAS, the agency will cause work to be commenced on the project within a
reasonable time after approval of a Measure k Bicycle Program claim form. The claim form will
be used in lieu of a contract. Successful claimants will encumber allocated (claim approved)
PROGRAM funds by January 1, 1998, or have them set aside as requested in the claim.
WHEREAS, the agency will comply where applicable with provisions of the California
Environmental Quality Act, the Americans with Disabilities Act, and any other applicable federal,
state and/or local laws and/or regulations.
