SPECIAL CITY COUNCIL MEETING
CARNEGIE FORUM, 305 WEST PINE STREET
TUESDAY, NOVEMBER 14, 2000
A. ROLL CALL
The Special City Council meeting of November 14, 2000 was called to order by Mayor Pro
Tempore Nakanishi at 7:55 a.m.
Present: Council Members — Hitchcock, Land, Nakanishi and Pennino
Absent: Mayor Mann
Also Present: City Manager Flynn, City Attorney Hays, and City Clerk Blackston
B. REGULAR CALENDAR
B-1 "Request to establish PCE/TCE Advisory Committee regarding the issuance of
subpoenas"
City Attorney Hays explained that this is the first step to again initiate the legislative
subpoena program that the California Supreme Court has validated. The Council
previously established the PCE/TCE Advisory Committee. One of the Committee
members (Jack Sieglock) is no longer on the Council, which necessitates the action
requested today of reestablishing the Committee. Mr. Hays recommended that the
pattern followed previously be continued — that of having the Committee consist of the
Mayor and Mayor Pro Tempore.
Council Member Land questioned if the Committee appointment should include specific
names.
City Attorney Hays responded that by designating positions it would eliminate the need for
future Council action in establishing the Committee each time the Council reorganizes.
Council Member Hitchcock asked what the purpose of the Committee is.
City Attorney Hays replied that staff communicates with the Committee regarding why,
and to whom, they need subpoenas issued. The Committee then brings back a
recommendation to Council to issue the subpoenas. Subpoenas are issued by the
Council and signed by the Mayor.
Council Member Hitchcock asked if the legislative act requires that the Committee be
involved, rather than having the City Attorney make the recommendation directly to the
Council.
City Attorney Hays responded that the process is set forth by the Government Code. Part
of the process involves establishment of a committee to review requests to issue
subpoenas so that a legislative activity trail is created. He clarified that the
recommendation today is for the Council, by motion, to reestablish the Advisory
Committee that is set out in Resolution 97-09 and that that Committee be made up of the
Mayor and the Mayor Pro Tempore.
MOTION:
The City Council, on motion of Council Member Land, Hitchcock second, reestablished
the PCE/TCE Advisory Committee as set out in Resolution No. 97-09, and designated the
Mayor and Mayor Pro Tempore as the Committee makeup. The motion carried by the
following vote:
Ayes: Council Members — Hitchcock, Land, Nakanishi and Pennino
Noes: Council Members — None
Absent: Council Members — Mayor Mann

D. ADJOURNMENT
There being no further business to come before the City Council, the meeting was adjourned at
7:59 a.m.
