HomeMy WebLinkAboutMinutes - January 17, 1910Public Hall, Lodi, California, Jan. 17, 1910 The Board of Trustees of the City of Lodi convened in regular session, Pres. G. E. Lawrence presiding and the following other members of the Board being present; J. M. Blodgett, F. O. Hale, C. A. Rich and L. Villinger The minutes of the previous meeting were read and approved. Frank I. Atherton was granted a permit to construct a residence on Lot 7, Block 4, Ivey's Addition. Mr. J. D. Crose on behalf of the Civic League of Lodi presented the matter of boys frequenting Pool and Billiard Rooms. He asked to have the Clerk read Ordinance No 500 of the City of Stockton, which the clerk then did. Mr. Crose thereupon addressed the Board asking that a similar ordinance be enacted in the City. President Lawrence asked if the Ordinance had ever been passed upon by the courts. Proponent sayeth not. The matter was taken under advisement for reference to the City Attorney. Mr. Jms. Fredrickson, on behalf of Miss Anna Brack, then made a request in writing to the Board asking for permission to construct a sidewalk in front of Miss. Brack's property at the S. W. Corner of Elm & School St. beginning at said sidewalk 18" from the dividing line instead of 3' as provided in the ordinance, setting forth as a reason for such request the nearness of several large trees, which the claimed prevented the walk from being constructed in accordance with the ordinance. There appearing to be good reason for granting the request, the Board on motion regularly passed, granted the permission desired. Judge J. R. Wherity addressed the Board in regard to the Nay Dairy, claiming that such dairy is a nuisance, and asked the Board to pass an ordinance limiting the number of cows that may be kept by one party within the City Limits. He stated that as Mr. Nay was a poor man and might require a little time to remedy the evil, the Board should give him sufficient time so that he might avoid serious loss. Mr. D. F. Owens spoke in support if Judge Wherity's suggestion but denied that Mr. Nay is a poor man. He claimed that the existence of the dairy depreciated the value of their property, saying, "Who would want to buy alongside of a thing like that?' Mr. C. L. VanBuskirk also spoke in favor of abating the so-called nuisance. The matter was referred to the Committee of the Whole. Mr. Adolph Bauer asked if a man had a right to have two or three loads of dirt onto the sidewalk and leave the same there without leveling it off. He stated that such an 252 obstruction existed in front of Mr. VanBuskirk's Creamery Station on S. School St. Mr. VanBuskirk stated that Mr. Bauer was mistaken as he had hauled six or seven loads there. The matter was referred to the St.Supt. for a report at the next meeting. Mr. Jms. Stein spoke in favor of compelling people to grade their sidewalks up the St. Grade, and asked that the Board have the St. crossings on School St. at Walnut fixed. Thereupon, the City Clerk was instructed to order another car of 3/4" new rock. Mr. Jms. Frederickson stated that he would like to close the sidewalk on Oak St. along the Madison Building for the safety of the public. Pres. Lawrence said he saw no objection to such precaution. A representative of the Standard Portland Cement Company stated that he understood that the specifications for the Sewer System provided for Eastern Cement to the exclusion of the California Product. He asked that this be remedied and that local cements be allowed, stating that the California Cement Companies would give the Board any guarantee required. President Lawrence thanked the gentleman for calling the Board's Attention to this matter and assured the gentleman that Western Cements would be included. Mr. F. J. Beaty who was present recommended the local product. Mr. Beaty asked if the Board had already arranged for the plans of the Municipal Building, saying that he would like to complete in the drawing of such plans. He was informed that the plans were already proposed. Trustee Villinger suggested that the water wagon be placed on planks so that the wheels would not sink into the mud. The matter was referred to the St. Supt. who suggested that a temporary shed be placed over them. It was moved, seconded and carried that this Board do now adjourn to reconvene on Monday evening, Jan. 24, 1910. Carried & so ordered. Attest: J. M. McMahon City Clerk A letter from Byron Jackson Machine Works was read and filed. A letter from Asst. Supt. of the S. P. Co., J. D. Brennan thanking us for calling his attention to violations of the speed ordinance and promising to hear the matter remedied was read and filed. The Reports of the City Clerk and Treasurer for the quarter ending Dec. 31, 1909, having been read at the last meeting, were approved and ordered filed. 253 An application for the improvement of Walnut St. by the S. P. Trax and Main St. was read and referred to the St. Committee and St. Supt. A petition for St. light at Garfield and Pine and Grand and Pine was read and laid on the table.
