In regular session of the Board of Trustees of the City:of
Lcdi,the following trustees being present: J.M.Blodgett,F.O.?iale.
G_E.Lawrence.C.A.Richand L.Villinger. President Lawrence presiding.
Attorneys E.I.Jores and R.M.F.Soto,and Engineer Tumelty were present.
The minutes of the meeting of October 2.1911.were read and
approved.
The matter of street work was then taken up. ?resident
Lawrence stated to Attorney Soto that the Board was advised that as
a precautionary measure the Board should declare the certified check
of Ransome-Crumn.ey Company forfeited. -not as a declaration of war,
but as a measure of protection to the interests of the City. Mr.Soto
replied that he was not in a position to advise on that matter.
The following resolution was then read:
RESOLUTION.
WEEREAS,Ransome-Crummey Company (a corporation) has failed,
neglected and refused to enter into the contract to perform the work
mentioned and described in its proposal dated August 14th.,1911,which
proposal was on the 14th.day of August,1911,duly accepted by this
Board of Trustees in and by its Resolution of Award of Contraet,pass-
ed and adopted on the 14th.day of August,1911,and of record at•page
189 of the minutes of the meetings of the Board of Trustees of the
City of Lodi,the same being in the matter of the street proceeding
under and in pursuance of Resolution of Intention No.1 of said Board
of Trustees.NOW,THEREPORE,BE IT
RESOLVED that the certified check accompanying said propos-
al of said Ransome-Crummey Company be and the same is hereby declared
to be forfeited,and the Clerk is directed to notify said Ransome-
Crurmney Company accordingly by mailing to it a copy of this resolut-
ion and stating the time and fact of its adoption.
It was moved by Trustee Rich and seconded by Trustee Blodgett
that the foregoing resolution be adopted as read.which motionnwas
carried and the resolution adopted by the affirmative votes of
Trustees J.M.Blodgett,F.O.Hale,G.E.Lawrence,C.A.Rich and L.Villinger.
The following resolution was then read:
RESOLUTICN OF INTENTION NC.2.
RESOLVED,that it is the intention of the Board of Trustees
of the City of Lodi,County of San Joaquin,State of California.to order •
the following Street work to be done,and that all proceedings therefor
shall be conducted,pursuant to the provisions of the Act of the

Legislature of the State of California,approved.Apri1 7,1911,
therein designated as the "Improvement Act of 1911",to-wit:-
That Sacramento Street from the north line of Lodi Avenue to
the south line of Loc(eford Street,excepting that portion thereof
north of a curved line two feet south from the southernmost rail of
the Southern Pacific Railroad; that Elm Street from the east line
of School Street to the west line of Sacramento Street and from the
east line of Sacramento Street to a line two feet west from•the
westernmost rail of the Southern Pacific Railroad; and that Pine
Street from the east line of School Street to the west line of
Sacramento Street (except sue h portions thereof as are required by
law to be kept. in order or repair by any person or company having
railroad tracks thereon and excepting also such portions thereof
es are occupied by concrete sidewalks thereon) be graded to the
official grade; that along the roadway sides thereof (excepting the
south roadway line of said Pine Street immediately fronting lots
16,17 and 18 in block number 16) a concrete curbing six inches wide
be constructed; that along said above described roadway sides of
Sacramento,Elm and Pine Streets,except the main roadway cf said
Pine Street,said curbing shall be of a depth extending from curb
grade to the bottom of the abutting concrete foundation hereinafter
provided for; that along the main roadway sides of said Pine Street,
said curring_ shall be of a depth extending from curb grade to the
bottom of the abutting concrete gutters hereinafter provided for;
that upon the sub -grade of the roadway of said first described port-
ions of Sacramento,lm and Pine Streets except the main roadway of
said Pine Street,a concrete foundation five inches thick be laid;
that along the main rcad'^ay sides only of said first Described '.ort -
ions of Sacranento,Ll'i and Pine Streets,concrete gutters twenty-four
inches in width at culvert and fifteen inches in width at all other
places be laid; that at main street intersections,arched reinforced
concrete culverts eight feet
long,twenty-four inches wide and two inches thick be constructed
ever the gutters between the produced bounding lines of the sidewalk
spaces of each intersecting street; that along the roadway sides of
said first described portions of Sacramento and Bim Streets,said ax
above described gutters shall be lain directly on said concrete
foundation; tht along said above describedportions of the roadway
sides of Pine Street,said above described gutters shall be six inches
thick; that for the rain roadway of said Pine Street,the present
macadam surface shall be taken for a sub-Cra!ie and thereupon laid
an asphaltic binder to a height and cross-section one and one-half
inches below surface grade; that over all of the road':ay of said first
described portions of Sacramento and ^lm Streets, except all gutter
areas heretofore provided for,an asphaltic tinder course one inch
thick shall be laid;that over all of the roadway of said first de-
scribed portions of Cacranenito,Bnd Elm and Pine Streets.except all
gutter areas heretofore provided for.an asphaltic wearing course one
and one-half Inches thick be laid. Excepting.however.such portions
of Sacramento Street as are required by law to be kept in order or
repair by any person or company having railroad tracks thereon.
That in the opinion of said Board of Trustees,the above de-
scribed work is of more than ordinary public benefit,and it is by said
Board hereby dedlared that the costs and expense of said contemplated
work be,and hereby are made chargeable upon the assessment district
hereinafter describeci,and that the exterior boundaries of such district
are described as follows.to-wit:-
Beginning at the northeast corner of bloc?} number 21.said
corner being on the west line of the Southern Pacific Railroad right
of way.thence southerly along said west line of said right- of way
to the north line of Elm Street; thence easterly along said north line
of Elm Street to the center line of said right of way; thence southerly
along said center line of said right of way to the south line of Elm
Street; thence westerly along said south line of Elm to said west line
of said right of way;thence southerly along said west line of said
right of way to the north line of Lodi Avenue; thence southwesterly
along said north line of said Lodi Avenue to a point half way between
Sacramento and School Streets; thence northerly and parallel with said
School Street to the center of block number 1G,said center of said
block being also the center of the junction of two alleys;thence
westerly along the Center line of one of said alleys to the east line
of School Street;thence northerly along the east line of said School
Street to the center line of the alley running east and west through
the center of block number 14; thence easterly along said center line
said
of said alley to the center of block number 14;thence northerly
parallel with said School Street to the south line of said Lockeford
Street; thence easterly along said south line of said Locge ford Street
to the point of bac-inning; all of said lots,blocks,streets,alleys,
avenues.right of way,etc.beir.g as shown and delineated on the

official.map and plat of said City of Lodi by F.E.Qua1l,County
Surveyor.approved as and declared to be the official map of said
City by the Board of Trustees of said City cn the second day of
March,1908.
That the aforesaid described district is hereby declared to be
the district benefited by said work,and shall be assessed to pay
the costs and expenses thereof.
The City Clerk of said City of Lodi is hereby directed
to publish this resolution in "The Lodi Sentinel (weekly edition);
a weekly newspaper,publlshed and circulated in the said City of Lodi,
for two days by two consecutive insertions therein.
It was moved by Trustee Blodgett that the foregoing resolut-
ion be adopted as read,which motion was carried and the resolution
adopted by the following vote:
Ayes: Trustees J.U.Blodgett,F.C.Fale,G.F.Lawrenee,and L.Viliinger.
Noes: Trustee C.A.Rich.
fln motion of Trustee Hale,Rev.Fugene Sullivan was unanimous-
ly granted permission to use the City lot at the corner of Sacramento
and Lodi for holding the Catholic Fair,providing arrangements were
made with S.A.Shinn.
On moticn,the Board adjourned until October 9,1911,at the
usual hour and place.
