In regular session of the Board of Trustees of the City of Lodi,the following trustees being present: J.M.31odgett,F.v.Hale. G.E.Lawrence,C.A.Rich and L.Villinger. President Lawrence presiding. City Attorney E.I.Jone and City Engineer R.C.Tumelty were present. The minutes of the Meeting of July 10,1911.were read and approved. Attorney Jones then read the following resolution. RESOLUTION. WHEREAS, The 3arber Asphalt Paving Company (a corporation) has failed,neglected and refused to enter into the contract to per- form the work or improvement mentioned and described in its proposal, dated May 13th.,1911,which proposal was on the 15th. day of May,1911, duly accepted by this Board of Trustees in and by its Resolution of Award of Contract,passed and adopted on the 15th. day of May,1911, and of record at page 164 of the minutes of the meetings of said Board of Trustees, the sane being in the matter of the street pro- ceeding under and in pursuance of Resolution of Intention No.l.of said Board of Trustees,. NO7,TMEREFCRE.BE IT RESOLVED that the bond accompanying said proposal of said The Barber Asphalt Paving Company,be and the same is hereby declared to be forfeited,and the Clerk is directed to notify said The 3arber Asphalt Paving Company and its surety accordingly.by mailing to each a copy of this resolution and stating the time and fact of its adoption. It was moved by Trustee Rich and seconded by Trustee Hale that the foregoing resolution be adopted as read,which motion was carried and the resolution adopted by the affirmative votes of Trustees J.M.Blodgett,F.O.Rale.G.E.Lawrence,C.A.Rich and L.Villinger. Attorney Jones then read the following resolution: IN THF MATTER OF.TE STREET PROCEEDING UNDER AND IN PURSUANCE OF RESOLUTION OF INTENTION N0.1. RESOLUTION. Whereas,in the Matter of the Street Proceeding under and in pursuance of Resolution of Intention No.1,which resolution was adopted on the 23rd.day of February,1911,and is of record at page 137 of the Minutes of the meetings of this Board of Trustees,it is found that in the opinion of sone persons.particularly contractors, 180 that the specifications for the work heretofore on the 17th.day of Apri1,1911,adOpted,are fatally faulty in some of the items thereof,and Thereas,all and singular the action of this Board of Trustees in said Street Proceeding leading up to and including said Resolution of Intention No.1 were had in compliance with and in response to a petition therefor signed by the owners of more than'a majority of the frontage upon the work described in said Resolution of Intention No.].,now,therefore,be it RESOLVED: that for the purpose of prosecuting the work described in said Resolution of Intention No.1 and of continuing the Street proceeding under and in pursuance of said Resolution of Intention No.1,all and singu_ar the action of this Board of Trustees in the adoption of said specifications,together with the accompanying plans,estimates and diagrams,and in the resolution ordering the work, and thereafte;in pursuance of said order of work,be and the same are hereby rescinded,annulled and set aside,and R.C.Tumelty,the City Engineer,is hereby directed to furnish anew plans,specifications and careful estimates of the costs and expenses of the street work or improvement in said Resolution of Intention No.1 described,and also to maize or furnish anew a diagram of the property affected or bene- fited by the proposed work or improvement as described in said Resolution of Intention No.1 and to be assessed to pay the expenses of said proposed work or improvement. Said diagram is to be made in accordance with the provisions of Subdivision 12 of Section 7 0_" an Act entitled "An Act to provide for work upon Streets,Lanes,Alleys,Courts,Places and Si4ewalks,and for the construction of sewers within Municipalities",approved March 18,1885,and all Acts amendatory thereof. It was moved by Trustee 31odgett,seconded by Trustee Villinger, that the foregoing resolution be adopted as read,which motion was carried and the resolution adopted by the affirmative votes of Trustees J.M.Blodgett,F.O.Hale,G.E.Lawrence,C.A.Rich and L.Villinger. R.C.Tumelty,City 2ngineer,then presented plans.specificat- ions.and'estimates of.costs of the proposed work and improvement de- scribed in Resolution of Intention No.1,and also a diagram of the property affected or benefited by the said proposed work or improve- ment. L L)J Attorney Jones then read the followinZ: IN THE MATTER OF THE STREET PROCEEDING UNDER AND IN PURSUANCE OF RESOLUTION OF INTENTION NO.1. RESOLUTION ADOPTING AND APPROVING PLANS,SPECIFICATIONS,ESTIMATES OF COST AND DIAGRAM. ?JHEREAS,R.C.Tumelty,has in pursuance of the direction of this Board heretofore given,made,presented and furnished anew plans, specifications and careful estimates of the costs and expenses of the proposed work and improvement described in Resolution of Intention No.1,and also a diagram of the property affected or bene- fited by the proposed work or improvement in said. Resolution of Intention No.1.described,be it RIS_LVED: that the said plans,apecifications and estimates of costs and expenses and said diagrrn be and are and each of the same is hereby approved and adopted,and the City Clerk is directed, for the purposes of identification and certification to indorse upon said specifications,and each of the papers constituent of said plans and upon said diagram substantially the following: State of California, ( ss. County of San, Joaquin.) I.J.M.McMahon,Cit:% Cleric of the Cita, of Lodi.do hereby certify that the within (plans.specifications,estimate of costs,was or were) by a Resolution of the Board of Trustees of the City of Lodi,duly passed on the 17th.day of July,1911,duly approved and adopted. Attest: J.M.McMahon City Clerk of the City of Lodi. And said City Clerk is authorized and directed to write "cancelled" in red ins across any other certificate or identification marks which he may have hitherto placed upon any of said papers,and to deliver said diagram.when so certified,to the Superintendet of Streets of said City. It was :coved by Trustee Hale,seconded by Trustee Villinger, that the foregoing resolution be adopted as read,which motion was carried and the resolution adopted by the affirmative votes of Trustees J.M.31odgett,F.O.Hale,G.E.Lawrence,C.A.Rich and L.Villinger. 182 Attorney Jones then ream the following resolution: ORDER OF WORK •RESOLUTION ORDERING STREET WORK NO.1 RESOLVED,that the public interest and convenience require the work herein described,and the 3oard of Trustees of the City of Lodi, having heretofore adopted anew plans,specifications,estimates of costs and diagrn,hereby orders the following street work to be done according to the specifications therefor on this 17th day of July,1911,approved and adopted: That Sacramento Street from the north line of Lodi Avenue to the south line of Lockeford Street,excepting that portion thereof north of a curved line two feet south from the southernmost rail of the Southern Pacific Railroad; that Elm Street from the east line of School Street to the west line of Sacramento Street and from the east line of Sacramento Street to a line two feet west from the westernmost rail of the Southern Pacific Railroad; and that Pine Street from the east line of School Street to the west line of Sacramento Street (except such portions thereof as are required by law to be kept in order or repair by any person or company having railroad tracks thereon and excepting also such portions thereof as are occupied by concrete sidewalks thereon) be graded to the official grade; that along the roadway sides thereof (excepting the south roadway line of said ?ine Street immediately fronting lots number 16, 17 and 18 in block number 16) a concrete curbing six inches wide be con— structed; that along said above described roadway sides of Sacramento, Elm and Pine Streets,except the main roadway of said Pine Street,said curbing shall be of a depth extending from curb grade to the grade of the bottom of the abutting concrete foundation hereinafter provided for; that along the main• roadway sides of said Pine Street,said curbing shall be of a depth extending from curb grade to the bottom of the abutting con— crete gutters hereinafter provided for; that upon the sub—grade of the roadway of said first described portions of Sacramento,Elm and Pine Streets,except the main roadway of said Pine Street,a concrete foundation five inches thick be laid; that along the main roadway sides only of said first described portions of Saeramento,Elri and Pine Streets,con— crete gutters twenty-four inches in width at culverts and fifteen inches in width at all other places be laid;that at main street intersections, arched reinforced concrete culverts .eight feat long,twenty.—four inches wide and two inches thick be constructed over the gutters between the \ HD 183 produced bounding lines of the sidewalk spaces of each intersecting ---,- street; that along the roadway sides of said first described* port= ions of Sacramento•aud 11M Streets.,said above described gutters shall be laid directly on said concrete foundation; that along the said above described portions of the roadway sides of Pine Street, said above described gutters shall be six inches thick; that for the main roadway of said Pine Street,the present macadam surface shall be taken for a sub -grade and thereupon laid an asphaltic binder to a height and cross-section one and one-half inches below surface grade; that over all of the roadway of said first described portions of Sacramento and Elm Streets, except all gutter areas heretofore provided for,an asphaltic binder course one inch thick shall be laid; that over all of the roadway of said first described portions of Sacranento,Eln and Pine Streets, except all gutter areas heretofore provided for,an asphaltic wearing course one and one-half inches thick be laid. That in the opinion of this Board of Trustees,the above describ- ed work is of more than ordinary public benefit; and it is hereby declared that the costs and expenses of the aforesaid work and in- provenent are to be assessed upon a district hereinafter particularly described,and it is declared and ordered that the exterior boundaries of the district affected and benefited by the aforesaid wort: and improvement, and within and upon which said district an assessment shall be levied and assessed according to law,to pay the costs and expenses of such work and improvenent,are,bv this Board of Trustees, found and declared to be and are particularly described as follows, to -wit: Beginning at the northeast corner of block number 21,said corner being on the west line of the Southern Pacific Railroad right of way.thence sutherly along said west line of said right of way to the north line of Elm Street; thence easterly along said north line of Elm Street to the center line of said right of way; thence southerly along, said center line of said right of way to the south line of Elm Street; thence westerly along said south line of E]Ti' Street : tosaid:west line of said right of way; thence southerly along said west line of said right of way to the north line of Lodi Avenue; thence southwesterly elopg said north line of Lodi Avenue to a point half way between Sacramento and School Streets; thence northerly and parallel with said School Street to the center of block number 184 1C,said ce_.ter of said block being also the center Of the junction of two alleys; thence westerly along the center line of one of said alleys to the east line of School Street; thence northerly along the east line of said School Street to the center line of the alley running east and west through the center of block number 14; thence easterly along said center line of said alley to the center of block number 14; thence northerly parallel with said School Street to the south line of said Lockeford Street;thence easterly along said south line of said Lockeford Street to the point of beginning; all of said lots,blocks,streets,alleys,avenues,right of way.eto.,being, as shown and delineated on the official map and plat of said City of Lodi by F.E.Quail,County Surveyor,approved as and declared to be the official map of said City by the Board of Trustees of said City on the second day of March,1908. The said above described property bounded as described above shall be and is hereby constituted and designated the assessment district within which there shall be levied and upon the lands,lota or portions of lots therein situate,shall be assessed and imposed an assessment to cover the total amount of the costs and expenses of such work.as provided by law. The City Clerk is hereby directed to publish this resolution for two days and upon the completion of the publication of this Order as required by law,said City Clerk is further ordered and directed to publish notice inviting sealed proposals or bids for doing the work and referring to the specifications posted or on file,also for two days,both in The Lodi Sentinel, a tri—weekly newspaper of general circulation,published and circulated in this city,hereby designated for that purpose. Said notice shall require a certified check or a bond,either,as prescribed by 1awand for an amount not leas than ten per cent :f the aggregate of the proposal. He is also directed to post said notice,with specifications,conspicuously for five days, on or near the Chamber door of said Board of Trustees,towit the Council chamber door. It was moved by Trustee Blodgett,seconded by Trustee Villinger, that the foregoing resolution be adopted as read,which motion was carried and the resolution adopted by the affirmative votes of Trustees J.M.Blodgett,F.O.Ha1e,G.E.Lawrence,C.A.Rich and L.Villinger. • A communication from Supt.J:L.Rrennan of the Southern Pacific Compnay 1 -n -regard to signal bells was read and referred to the street committee. • A report from H.H.Henderson on the rate•for power'at the septic tanx,and on the progress of the work at the pumping station was read. The members of the Board signified their willingness to have a cora • — matte meeting with Hr.uenderson,at his request,on next Thursday evering,at 8 o'clock P.M. On motion,the President _.of the•Board was authorized to sign a transformer contract with General Electric Co. ' On rrotion.fts. Supt .Henna.^.g was empowered to purchase three transformers from Joe Moran for $128.00 or less. A communication from Lodi Merchants' Association,requesting that the City do not sell electric fixtures of any kind was read and referred to thecommittee of the Whole. • The acceptance'of the franchise granted to Central California Traction Company was read and filed. A communication from Lodi Laundry,offering the City '1.73 acres cf land for a dumping ground for the sum of 41000.00 was read and referred to a committee consisting of Trustees Ridn and Blodgett. F.A.Dougherty appeared on behalf of Wm.Beckman and Cal Dayton, who have nct the means to install plumbing and connect ?pith the sewers. He asked that • the Board be lenient with the above parties, and stated that he would do all in his power to raise the necessary money on their property. On motion,the roard decided to open bids for street work on August 14,1911. Gn motion,the Board adjourned until July 24,1911.at the usual hour and place. Attest: 5
