AGENDA TITLE: Letter Regarding Driveway Replacement at 107 North School Street
MEETING DATE: January 7, 1998

RECOMMENDED ACTION: That the City Council approve the attached letter committing the City to
replace a driveway at 107 North School Street.
BACKGROUND INFORMATION: As part of the Downtown project, the City removed a driveway at the
northwest corner parcel at School and Elm streets. This parcel is
also served by a driveway on Elm Street and neither driveway was
in regular use.
As part of previous use approvals, the City had required that the School Street driveway be abandoned;
however, this requirement was deferred. Thus, this work was included in the Downtown project to gain
additional on -street parking. The property owner was also saved the cost of abandoning the driveway.
However, the property owner was not notified of the removal prior to the work and subsequently
requested that it be replaced. After much discussion, staff responded with a letter, satisfactory to the
owner, offering to replace the driveway at the City's expense.
We are asking for Council concurrence on this arrangement.
FUNDING: None required at this time. Future funding, if ne ssary, from the Street Fund.

I am in receipt of your letter regarding the School Street driveway at your property on the
corner of School and Elm Streets in Lodi. As your letter explains, the City did remove
the drive with the understanding that it was no longer in use and not required in the
future. Based on these facts, it was the City Engineer's opinion that the City could save
you money in the future by having the new sidewalk treatment completed as part of the
entire project.
The background having been said, I fully appreciate your desire to have the driveway
replaced in the future. With that, the City of Lodi will treat the location as if it were a
"grand -fathered" driveway and commit to paying for the improvement when needed.
This obviously does not affect the existing drive that provides access on the Elm Street
frontage.

SUBJECT: Letter Regarding Driveway Replacement at 107 North School Street
Enclosed is a copy of background information on an item on the City Council agenda
of Wednesday, January 7, 1998. The meeting will be held at 7 p.m. in the
