The Board of Trustees of the City of Lodi convened in adjourned
session at 8:00 p. rr.., Present Trustees Hale, Black, Keeney and Fo1Pn-
dorf. Absent Trustee Deaver.

President Lawrence of the Board of Freeholders -introduced Attor-
ney A. n. Bogue, legal advisers of the Board of FrPPPolders-, who gave
an oral opinion to the Board of Trustees to the effect that the special
census of thR City, taken in :February of this year, had rot been done
in accordance with the law; that the, Board had not acquired legal jur-
isdiction in the matter Of the election of the Board of Freeholders.
The election of the Board of Freeholders therefore being illegal the
foundation for the proposed charter was not Sound. City Attorney Steele
save as his opinion that any further efforts Of the Board of Freeholders
would be useless.
In the matter of a contract for the construction of a building
for the Municipal Swimming Pool the following resolution was intro-
ucea:
RESOLUTION.
WHEREAS, this Board of Trustees did, at its last meeting, on
Monday, the 18th day of September, 1916, award to A. L. P;ilbrick and
E. R. Colvin, co-partners doing business under the firm name and style
of Phiibrick 'c Colvin, the Contract to construct the building ana
roof to eeClose and cover the r[unicipal swimming p001 Of the City Of
Lodi, for the sum of ti6e4-8.Oo,—
NO'ri, THEREFORE, it is ordered that the President of this Board
of Trustees be, and he eereby is authorized to execute a written con-
tract for and on behalf of the City of Lodi with Said co-partners for
the construction of said .uilding and roof in a good workmanlike man-
ner, for said sum, to be paid in four installments, said contract to
contain all the usual covenants and agreements contained in building
contracts, and such other provisions as in the judgerent-of.the Pres-
ident of this Board and said co-partners nay be deemed proper and
necessary, including a gearantee signed by two responsible guarantors
that said co-partners will do said work in accordance with the plans
anc specifications hereof.
Trustee Folendorf *!coved, seconded by Trustee Keeney, the adopt-
ion of the resolution as read. Upon roll call the motion carried by
the following vote:
Ayes -Trustees Folendorf, Keeney, Black and Hale.
Nays -None.
Absent -Trustee Deaver.
C.E.Longton presented an agreement signed by twenty-two prop-
erty owners on West Oak street proposing to deed ten f"e't of frontage
of ::e it properties to the City trovidirg the Board of Trustees will
adopt eha necessary resolution of intention authorizieg the paving of
the said street.
Trustee Keeney moved, seconded by Trustee Folendorf, that the
City Engineer be hereby directed to prepare plans ant specifications;
the City Attorney present a resolution of intention to pave, Curb
and `::.t -e. West Oak street from the. East line Of Schoc1 street to
the'ast line of Haterins street, and the City Clark be instructed to
secure deeds'from the property owners wast of Pleasant avenue for
certain tell -foot strips Of land fronting on said West Oak street,
said deeds to be delivered to the City when said resolution of in-
tention is adopted by the Board of Trustees. The motion carried
unanimously.
The Board adjourned.
