The Board of Trustees of the City of Lodi convened in regular session at 8:00 p. m., there being present Trustees hale, Black,Deaver, Folencorf and Keeney. Immediately after roll call the president of the Board was presented with a new gavel, which was accompanied by the following let- ter TO HIS HONOR, THE MAYOR,L0DI,CALIFORNIA: Noting on many occasions the absence of an official gavel in the firm hands of our city's chief executive, -and, realizing the im- portance of such an implement in the preservation of harmony and dec- orum, your constituents take infinite pleasure in providing this tool made from the native woods of our California by Lodi mechanics, and presenting it to your honor to be used in preserving the peace and dignity, promoting the harmony ana governing the destinies of the greatest city in the West. Hunt applied for permission to build an airdome for the ope:ation of a moving picture theatre, to be located on lot 1, block 20, City of Lodi, on North Sacramento street. Upon motion of Trustee Deaver, seconded by Trustee Black, the permit was granted for a period not to exceed six months, the vote upon the motion re- sulting as follows: Ayes -Trustees Deaver, Black, Keeney, Hale. Nays- Folendorf. Absent --::one. The following additional building permits were granted: W.H.Cutts, addition to dwelling at 210 North Stockton St. J.W.Crose, cobbler's shop on Lot 6, Block 23, Lodi. 1. Thoman, dwelling on Lot 12, block B, Barnhart Tract. Bare Fruit Company, platform and wagon scales, corner i ain and Pine streets. F. G. Cary, for G.A.Keagle,dwelling on lot 24, Bloek 1, West Lodi. 0. R. Pearce, poultry house on lots 7 and division, Ayers & Pitchers Addition. Frank Jopp, woodshed at 336 Daisy avenue. V. P. Lancaster, dwelling on Lot 7, Block subdivision, of Ayers & Pitchers Addition. Chas. I. Rice, for J. C. Burson, addition 201 best rim street. 8, Brier Sub - 2, Lancaster to dwelling at Chas. I. Rice, for W. H. Thompson, addition to dwelling at 1.5 West Walnut street. Jno. A. Henning, poultry house at 427 West Elm street. The application of Otillie Morrow for permit to construct a dwelling on lot 7, block- C, Barnhart Tract, was not granted for the reason that application stated there would be no plurbirg in the building. The resignation of 0. J. Hemphill as a member of the Board of Health was accepted; the Clerk instructed to notify him and ex- press the thanks of the Board for his services. Upon motion regularly made, seconded and carried, August scucie was appointed a member of the Board of Health to fill -the vacancy caused by the resignation of 0. J. Hemphill. - Chas. H. Buck and Van & Hansen applied to the Board to supply their shops with three-phase electric current for their mo- tors. Upon the report of Superintendent Henning regarding the ex- pense iInvolved no action was taken. A communication was received from the State Compensation Insurance Fund enclosing new policy for the year beginning May 1, 1915, and accompanied by a check for ;:80.02 covering refund on previous year's policy from May 1, 1914, to January 1, 1915. The Pacific Telephone & Telegraph Company proposed to sell to the City of Lodi one-half interest in one 30 -foot pole on north side of Elm street, between Hutchins street and Lee Avenue; one 25 - foot :joie on 'utchins street, at alley between Elm and Pine streets; 411 one 25 -foot pole, corner of Cordler and Elm streets, at a total cost of $16.00, which proposition was upon motion accepted. The president of the Board was authorized to sign supplement I:O. 18 to the Joint Pole Agreement of November 1910, confirming such purchase. The Clerk was authorized to ask for bids for the City print- ing for the fiscal year beginning July 1, 1915. Applications for saloon licenses.were received from Martin D. Duffy, A. F. %avaraugh and R. 11. Combs; for wholesale liquor 11- censes from C. J. Bender, Wilkinson & Wilkinson, Lodi Soda Works & Ice Depot and Jacob G. H1eb.Tro applications being regular and accom- panied by properly executed bonds the Clerk was instructed to adver- tise tl_e same accord-ing to the provisions of Ordinance number 78. Dr. S. W. Hopkins, president of the Board of Health, re- quested the Board of of Trustees to have constructed a sewer in the alley between, Cordler and Hutchins street to provide drainage facil- ities for residences in that locality. Adolph Bauer, representing George West & Son, applied for a reduction in the city's minimum charge of 924 per month for current used at their .Lodi winery. Mr. Bauer was informed the request would be giver. consideration. A resolution introduced April.15, 1915, and laid on the table for net less than five days, appropriating lots 1, 2 and 3 of Larsonts Addition to the City of Lodi for a municipal swimmimg tank, was taken up for final consideration. Trustee Black moved the adoption of the resolution, which motion was seconded by Trustee Deaver. A vote on t -he motion upon roll call resulted as follows; Ayes -Trustees Black. Nays --Trustees Deaver, Folendorf, Keeney and Hale. Absent—None. A resolution authorizing the reconveyance to H. Bechtold of a portion of that certain property bought as a dumping ground, which resolution appears in full below, was introduced: RESOL TI GE. WHEREAS, The Board of Trustees of the City of Lodi, did, by unanimous vote, pass a certain resolution. dated March 15, 1915, authorizing.the purchase of land from one H. Bechtold, to be used as a dumping ground by the City of Lodi; and ' A -HE F�1'S, That part of the said resolution describing said property was drawn up pursuant to the terms of a certain option made and executed by the said H. Bechtold to the City of Lodi, and filed with the Board of Trustees of the City of Lodi March 8, 1915; and wVHEBRAS, It was the intention of the Board of Trustees of the City of Lodi to buy two acres of land, more or less, from H. Bechtold, and it was also the intention of H. Bechtold to sell two acres of land, more or less, to the City of Lodi, and pursuant to these intentions, and for the purpose of. incorporating the descrip- tion of such property into the option hereinafter mentioned, said _parties did, prior to the passing of said resolution, roughly meas- ure such property, which description is set out in that certain option executed by H. Bechtold to the City of Lodi, filed March 8, 1915, with the Board of Trustees of the City of Lodi; and WHEREAS, subsequently to the passing of said resolution, authorizing the purchase of land as aforesaid, trip said property was accurately surveyed by the. City engineer of the City of Lodi;and WHF'REAS, It was found that such property described in said option contained 3.6 acres, more or less; and !CRFREAS, the said H. Bechtold thereupon refused to convey as much land as was described in said option, and any greater amount than 2.8 acres, on the ground that said option described more prop- erty than, he intended to convey, and on the further ground that by mutual mistake the amount of land described in said option was one acre in excess of the amount intended to be included therein.; and { 'WHERFAS, The Board of Trustees, not caring to involve the City of Lodi in litigation, and it being absolutely necessary that the City of Lodi should secure a dumping around at said time without delay, and deeming it just, fair and'equitable, and -for the benefit: of the City of Lodi, and in accordance with the intentions of the parties, a majority of said Board of Trustees promised said H. Bechtold that the City of Lodi would reoonvey to said H. Bechtold all the prop- t;tv described In said option over and above 2.8 acres, if he, the salrA H. Bechtold, would imr•ediately give the City of Lodi possession or said property as aforesaid, and deliver to said City a good and sufficient deed therefor; and w:EP.Z+A S, Pursuant to said agreement, said H. 3pchtold con- 9 veyed all the property described in said option to the City of Lodi, and gave said City possession thereof., now therefore BE IT RESOLVED, That the City of Lodi reconvey to Y. Bechtold that certain lot, piece or parcel of land situated in the County of Sar_ Joaquin, State of California, and particularly described as fol- lows, to -wit: - Starting at a point 1019 feet north of the southern boundary of section 36, T. 4 N. R. 6 r,. M. D. B. & Tom., and located on a paral- lel 200 feet east of the -east line of the S. P. R. R.Is right of way; running thence east 119 feet to the intersection of such course with the south bank of the MoRelumne River; -thence following the meanders of said river on a northerly direction to the intersection of the above mentioned parallel with the south bank of said river; thence.on. a course south 3`441 E. along said parallel to the R. R.'s right of way 480 feet more or less to the noirt of beginning, containing one acre, more or less; and be it further RESOLVED, By the Board of Trustees of the City of Lodi,that the President and the Clerk of the Board of Trustees of the City of Lodi be and they are hereby authorized and directed, in the rase under the seal and on behalf of this -Board of Trustees of the City of Lodi, to quitclaim and set over unto H. Bechtold the real prop- erty hereinbefore described. Trustee Black moved the adoption of the above resolution, seconded by Trustee Keeney. The motion to adopt was carried by the followir:z vote.: Ayes --Trustees Black, Keeney, rolendorf and Yale. Fays--Trustee Deaver. Absent --?None. Claims for salaries, labor and miscellaneous other demands amounting to #467$.17 were allor,ed and ordered paid.
