In regular adjourned session of the Board of Trustees of the City of Lodi, this date, there were present Trustees Black, Hale, Crose and Montgomery. Minutes of the previous meeting were read and approved. Building permits were granted as follows: L. M. Johnson, garage and woodshed at 329 East Pine Street P. L. Try, private garage at 608 West Elis St. Robert ;lest, private garage at 113 Olive Court. A. S. Anderson, add to garage 216 N. School St. Lodi Aerie, F. 0. E.,remodel building for gymnasium. J. C. Ferguson, add to bldg at 217 N. Sacramento Street. In the matter of the proposed improvement of Lee Avenue the following Resolution of Intention was introduced by Trustee Montgomery: RESOLUTION OF INTENTION NO. 18 RESOLVED, THAT. IT IS THE IN- TENTION OF THE BOARD OF TRUSTEES OF THE CITY OF LODI, IN THE COUNTY OF SAN JOAQUIN, STATE OF CALIFOR- NIA. TO ORDER THE FOLLOW- ING WORK TO BE DONE AND IMPROVEMENT TO BE MADE IN SAID CITY OF LODI, TO -WIT: That Lee Avenue, in said City, from the South line of Locust Street to the North line of Elm Street, and from the South line of Elm Street to the North line of Pine Street, and from the South line of Pine Street to the North line of Oak Street. and from the South line of Oak Street to the North line of Lodi Avenue, BE IMPROVED: (1) By grading the roadway and curb spaces of said Lee Avenue. (2) By constructing hydraulic con- crete curbs and gutters of the com- bined type along each side of the roadway of said Lee Avenue. (3) By paving the roadway of said Lee Avenue between the gutter lines. with a pavement consisting of one and one-half (1%) inches of Warren- ite Wearing Surface. laid on au as- phaltic concrete base two and one-half (2%) Inches in thickness. (4) By constructing sidewalk ap- proaches to the North and South curbs on the intersection of said Lee Avenue. with Walnut Street. And that the alley running East and West through the Block bounded by West Elm Street, Lee Avenue, West Pine Street and Hutchins Street, in said City, be improved by grading the full width of said alley from the West line of Lee Avenue to the East line of Hutchins Street, and by paving said alley for its full width with a pave- ment consisting of one and one-haLf (1t..) inches of Warrenite Wearing Surface, laid on an asphaltic concrete base two and one-half (2%) inches in thickness. Excepting. however. from all of the hereinabove described work such por- tion as is required by law to be kept in order or repair by any person or company having railroad tracks there- on; and excepting also from all of the hereinabove described work any of said work already done to the offi- cial grade. All of said work shall be done In accordance with the plans and speci- fications heretofore adopted for doing said work and now on file In the office of the Ctty Clerk of said City of Lodi. Attention is also called to the War- renite License Mixture Agreement for California, executed by Warren Brothers Company, the owner and holder of the patents ana processes covering the said Warrenite pave- ment. which agreement is on file in the office of the City Clerk, and Is hereby expressly referred to for greater certainty. And said Board of Trustees does hereby' determine and declare that said proposed work and improvement is of more than local or ordinary public benefit, and will affect and benefit the lands and district herein- after described, which said district is hereby declared to be the district benefitted by said work and improve- ment, and to have the exterior boun- daries hereinafter described es the boundaries thereof; that therefore, the entire cost and expenses of said work and improvement shall be, and are hereby made, chargeable against. and shall be assessed upon said lands and district, which district is within the City of Lodi, County of San Joa- quin, State of California. and le par- ticularly bounded and described as follows, to -wit: Commencing at a point on the South line of West Locust Street, in said City' of Lodi, distant thirty-five (35) feet West of the Northeast cor- ner of Lot Eighteen (18), Block One (1), West Lodi Addition, as per Sup- plement to plat of West Lodi tiled for record in Book of Maps, Vol. 3, at page 36. in the office of the County Recorder of the County of San Joa- quin, State of California, and running thence Easterly on and along said South line of West Locust Street, 360 feet to a point on said South line of West Locust Street; thence Souther- ly and parallel to the East line of Lee Avenue, to a point on the North line of the alley running East and Went between Pine and Oak Streets; thence Easterly on and along said North line of said alley, rive (5) feet to a point; thence Southerly and parallel to the East line of said Lee Avenue, to a point on the North line of Lodi Ave- nue; thence Westerly on and along said North line of Lodi Avenue to its intersection with a line parallel to and 155 feet west of the west line of said Lee Avenue; thence Northerly and parallel to the West line of said Lee Avenue, to a point on the North line of the alley running East and West between Pine and Oak Streets; thence Westerly on and along said North line of said alley, five feet; thence Northerly and parallel to the West line of said Lee Avenue to a point eighty-five (51) feet North of the North line of Pine Street; thence Westerly and parallel to the North line of Pine Street to a point on the East line of Hutchins Street; thence Northerly on and along said East tine of said Hutchins Street to its inter- sections. with a line parallel to and eighty-five (85) feet South of the South line of Elm Street: thence Easterly' and parallel to the said South line of Elm Street to a point 155 feet West of the West line of said Lee Avenue; thence Northerly ani parallel to said West line of Lee Ars- nue to the South line of Locust Street, being the point of beginning; provid- ed, nevertheless that the streets, ave- nues and alleys situate within aatd district shall be omitted from any as- sessment made or levied for paying the costs and expenses of the above mentioned work and improvement, the said streets, avenues and alien belonging to said city, and being la use kr the performance of a public function, to -wit, in use as public streets, avenues and alleys. The extent of the territory to be included in said assessment district is indicated by a boundary line upon a diagram entitled "Diagram Indic ing by Boundary Line the Extent of Territory to be Included in the Dis- trict to be Assessed for the Improve- ment Provided for by Resolution of Intention to be Numbered 18," which said Diagram was approved by the Board of Trustees of said City of Lodi, on the 17th day of Marin, A. D. 1919, reference to which Diagram is hereby made for greater certainty. And it is further ordered and notice is hereby given that serial bonds to represent unpaid assessments, and bear interest at the rate of seven per cent (7r) per annum, will be issued hereunder In the manner provided by the Improvement Bond Act of 1915, and Acts Amendatory thereof, the last installment of which bonds shalt ma- ture nine years from the 2nd day of July, next succeeding nine months from their date. This Resolution of Intention is adopted pursuant to the provisions of those certain Acts of the Legislature of the State of California, designated respectively as the "Improvement Act of 1911." and the "Improvement Bond Act of 1915" and Acts amenda- tory thereof and future proceedings hereunder shall be taken and had in accordance with the provisions of said Acts. NOTICE IS HEREBY GIVEN, that on Monday. the 14th day of April. A. D. 1919, at 9 o'clock P. M. in the Council Chamber of the said Board of Trustees, in the City Hall of said City of Lodi, any and all persons having any objection to the proposed work or improvement, may appear before said Board and show cause why said proposed improvement should not be carried out in accordance with this Resolution. The Clerk of this Board of Trustees is hereby directed to cause this Reso- lution of intention to be published three times in "The Lodi Sentinel," a triweekly newspaper published and circulated in said City and hereby designated for that purpose by the Board of Trustees; said newspaper being the official newspaper of said City of Lodi. The Superintendent of Streets shall cause to be conspicuously posted along the line of said contemplated work and improvement and In front of all the property liable to be as- sessed, notice of the passage of this Resolution of Intention, in the man- ner and form required by law. Upon motion of Trustee Hale, seconded by Trustee Crose, — the City Engineer was instructed to prepare plans and specifica- tions for the improvement of ':'alnut Street, .from Cherokee Lane to Futchins Street. Upon notion of Trustee Montgomery, seconded by Trustee Crose, the monthly pay of City Scavenger J. A. Marlow was in- creased from $75 to $90, effective March 1st, 1919. Trustee Montgomery movedm seconded by Trustee Hale, that the salary of City Attorney G. M. Steele be fixed at $100 per month beginning Parch let, 1919, which motion was adopted by unanimous vote of the Board, The City Clerk was authorized to have two hundred copies of Standard Specifications No100 printed. City Engineer Barzellotti presented a diagram indicating by boundary lines the extent of territory to be included in a district to be assessed for the improvement of Locust Street, from the east line of Hutchins Street to the west line of School Street, from the east line of School Street to the west line of Sacramento Street, and from the east line of Sacramento Street to the west line of Cherokee Lane, being the east City Limits, which diagram was u!;on motion of trustee Yontgomery, sec- onded by 'trustee Cross, adopted by unanimous vote of the Board.
