In regular session of the Board of Trustees of the City of Lodi
held this date there were present Trustees Hale, Black, and Keeney. Trus-
tees Deaver and Folendorf absent.
Minutes of the previous regular meeting of January 28th were ap-
proved as read.
Building permits were granted as follows:
G. 7. Madison, private garage 118 West Lodi Avenue.
Claud LeVere, addition to dwelling at 305 Tokay Street.
Jonas G. Thompson, dwelling Lot 21, block 1, Barnhart Tract,
S.C.Beckman, poultry house, lot 14, Brier Subdivision.
A.C.Kolb, private garage. at 109 West Lockeford Street.
The Central Pacific Railway Company petitioned the Board to
grant a franchise for the extension of a sidetrack crossing Tokay street
in the City of Lodi, the petition being presented by Mr. Risdon, repre-
senting the above named company.
ORDINANCE NUMBER NINETY-FOUR,
Granting to the Central Pacific Railway Company the right to lay
down and maintain a railroad track crossing Tokay street in the City of
Lodi was introduced, read and upon ;notion of Trustee Keeney, seconded by
Trustee Black, laid on the table for not less than five days.
A resolution as follows fixing time and place for. hearing peti-
tion and application of Central Pacific Railway Company for a franchise
to lay and maintain a railroad track crossing Tokay street was intro-
duced, read and adopted:

Central Pacific Railway Company, a corporation duly organized
and existing under and by virtue of the Laws of the State of Utah,and
conducting and carrying on a general railroad business in various places
in the State of California, including the City of Lodi, in the County of
San Joaquin, State of California, having on the 4th., day of February,
1918, filed its petition with this, the Board of Trustees of the City of
Lodi, County of San Joaquin, State of California,,praying for an ordin-
ance granting to it, its successors and assigns, the right, privilege
and permission, for a period of Fifty (50) years, from and after the
passage and approval of said Franchise, a Franchise granting to said pe-
titioner,its successors and assigns, the exclusive right, privilege and
permission to lay down and maintain railroad tracks of standard gauge,
together with the necessary spur tracks, curves:, switches, crossings,
connections, appengades and adjuncts for the convenient use thereof,
that it, its successors and assigns, may require from time to time dur-
ing the lifetime of said Franchise, and the exclusive right to pass with
a steam, or other lawful motive power, locomotive, with cars, motors
and other railroad equipment over, along, upon and across the streets,
portions o: streets and other places in the City of Lodi, County of San
Joaquin, State of California, particularly described as follows, towit:
I.
A single track railroad track, beginning for the center line
thereof at a point in the South line of .Tokay street produced westerly
as shown on map of °Re -subdivision of Lot Seventy -Two (72), of Lodi,
Barnhart Tractu, a subdivision located in the City of Lodi; said point
being also Eighteen (18) feet Easterly at right angles from the center
line of the main track of the Central Pacific Railway as now existing be-
tween Tracy and Sacramento and opposite Engineer's Station 1609 plus
72.6; running thence Northerly parallel to said main track and Eighteen
(18) feet distant from the center line thereof, 60.25 feet to the North
line of Tokay street, produced Westerly.
II.
A single track railroad track, beginning for the center line
thereof at a point in the South line of Tokay street produced Westerly as
shown on the first above mentioned map;, said point being also Eighteen
(18) feet Easterly at right angles from the center line of above mentioned
main track and opposite Engineers Station 1609 plus 72.6; running thence
Northerly on a curve to the left radius 764.E+9 feet. and approaching said
main track, Sixty (60) feet to a point in the :forth line of Tokay street
produced Nesterly Fifteen (15) feet, tore or less Easterly at right an-
gles from t':e center line of said main track., and it having at the sa,:.e
time and rlace presented to, and filed ,rith, this, the Board of `"r staaz
of the City of Lodi, an Ordinance in accordance with tr_e prayer of Its
said Petition, and under and by the Charter of said City of Lodi no ac-
tion can be taken on said Ordinance until Five (5) days shall have
elapsed since the introduction and filing of the same;
NOW, -TITER=--ORE, this, the Board of Trustees of the City of Lodi,
does hereby fix Ifor_day, the 11th day of February, 1913, at the _.our of
8 o1clock p.m., of said day, at the Chambers of this, the Board of Trus-
tees of the City of Lodi, In the City Hall of the City Of Lodi; a3 the
time and place for hearing the aforesaid ?etition, and the aforesaid Or-
dinance.

Upon motion of Trustee Keeney, seconded by Trustee Black, the
foregoing resolution -was adopted by the following vote:
Ayes: Trustees Hale, Black and Ke?nay.

Absent: Trustees Deaver and Folendorf.
`Ine Board of Health requested the City to take up the matter of
flushing the streets in the business section and also to have the. State
law against expectorating on the sidewalks enforced. These matters were
referred to the Street Cor-mittee and the City Marshal.
The fire Department reported the old blacksmith shop on the Ge-
han property on Locust street has become a nuisance and fire menace as
it is a resort for hobos who build fires therein. The Clerk was instructed
to write the owners of the property requesting them to have the building
removed.
C.G.Stewart requested the Board to grant nim a permit and license
to operate a peanut and popcorn wagon on the street at the Bank of Lodi
corner. He was instructed to obtain permission of the owners of the prop-
erty and present the same to the Board when the same 'would be given con-
sideration.
A resolution providing for the purchase of land for the purpose
of opening Lee and Pleasant Avenues was introduced, read and laid on the
table.
The monthly report of the City '.arshal for the month of Jar_uary
was read and ordered filed.
Salaries and labor and miscellaneous claims against the City
amounting to $4122.7o..were allowed and ordered paid.
Upon motion of Trustee Black, seconded by Trsutee Keeney, the
Board adjourned to meet again at -8:00 p.m. !Monday, February 11, 1919.
