HomeMy WebLinkAboutMinutes - October 15, 19232 Cit yy Hall City of ;odi Monday, October 15 - 1923 The regular meeting of the Board of Trustees of the City of Lodi for the third Monday in October was called to order at 8 o'clock P.M. on the date and at the place first above writ- ten by President J.V7.Shattuck; Trustees Hale,Hickok,Mettler, Spooner and Shattuck present. The Clerk asked that reading of the minutes of the meeting of October 8th be laid over as same had not been typed. On motion of Trustee Spooner, seconded by Trustee Mettler, the President of the Board was authorized to enter into a contract with the California Filter Company for chlorine gas to be used at the sewage disposal plant, In the matter of the opening of Hutchins Street; Eugene F. Goodrum, Attorney for Martha Lind offered the house at 420 Daisy Avenue to the City for $3,750.00 payable $1,000.00 on execution of contract and balance at time of removal,Trustee Spooner introduced Resolution #426 authorizing execution of a contract with Martha & Fred Lind for purchase of the building as above set forth; this resolution was adopted by the follow- ing vote: - AYES: Trustees Spooner,Mettler,Hale,Hickok,Shattuck. NOES: Trustees, None. ABSENT: TRustees, None. In the same matter, Trustee Hale introduced Resolut- ion 427 "Resolution Ordering Work Under Resolution of Intention No.64" and the same was adopted by the following vote: - AYES: Trustees,Hale,Hickok,iettler,Spooner,Shattuck. NOES: Trustees, None. ABSENT: Trustees, None; ( Note: A true copy of the above Resolution #427 appears at page 28 et seq herein) Bills audited by the finance cormittee in the amount of $14,250.57 were allowed on motion of Trustee Hickok; also the claiiim of Davis -Heller -Pearce Company in the amount of $15,862.75 providing the latter received the approval of Mr C.F.Smith. • Ordinance No. 143, "AN ORDINANCE ENDING ORDINANCE N0.86 AND AMEENDING ORDINANCE N0.47,AS A),rr;NDED BY SAID ORDINANCE N0.86 BEING ENTITLED "AN ORDINANCE REPEALING ORDINANCE NO.66 AND SECTION 44 OF ORDINANCE N0.46 AND AIDING ORDINANCE N0.47,ENT- ITLED'AN ORDINANCES PROVIDING REGULATIONS FOR THE MUNICIPAL LIGUT WORKS, AND FIXING RATES FOR LIGHT AND PQM" was introduced on motion of Trustee Hale and by the sane motion laid over for not Jess than five days. 2,9 (m.irutes of Oct 15 -continued) On notion of Trustee Hickok, the Board adjourned until 8 o'clock P.M. of November 5th.,1923. The above written minutes of the regular meeting of the Board of Trustees of the City of Lodi were approved November 5-1-923� resiaen of tli-e board. -DSOLUTION NO. 427 Resolution ordering work under resolution of intention No.64 RESOLVED: That whereas the Board of Trustees and City Council of the City of Lodi,San Joaquin County California, did on the 18th day of June 1923 pass its Resolution off` Intention No;64, to order the hereinafter described work to be done and improvement to be done n said City, notice of the passaGe of said Resolution of Intention saving been duly and le lly published and posted as required by law and as required by said�esolution of Intention, as appears from the affidavits on file with-, the City Clerk of said Cityy, and the said Board of Trustees and City Council having acsluired Jurisdict- mon to order said work to be done, now therefore,it is hereby - RESOLVED: That :he Ci' p of Lodi and the said Board of Trustees and City Council hereby orders the following cork to be done and improvement made in said City to -wit: That a public street shall be opened between the north line of Lockeford Street, in said City and the south line of Daisy Avenue� in said City,said street to be sixty feet in width and to lie thirty feet upon each side of a certain line which is des- cribed as that paft of the west line of Section f, Townshipt 3 North, Range 5 East, M.D.B.89 lV1W between the said south line of Daisy Avenue and the said North line of Lockeford Street the line so described being the center line oft -e street so to die opened. Excegli that part of said sixtyfoot strip of land whick lies within the rijt of ray of -the an Joaquin and Sierra Nevada Railroad, being the railway line running from Lodi to llcodbridge in the County of Sacs Joaquin. The land necessary to be taken therefore is particularly bound- ed and described as follows, to -wit: - That certain strip of land sixty feet in width bounded on the south by the north line of Lockeford Street, on the north by the south line of Deis Avenue and Iying thirty feet on each side of the center line of sai street so to be opened, as above described, except that part of said land lying within said railroad right of way.- exterior xterior boundaries of the district of lands to be affect- ed and benefitted by said work and improve:ent and to be assessed to pay the damages cost, and expenses t-szereof are as follows: A31 that certain district and lands lying within the corporate limits of the City of Lodi, County of San Joaquin, State of Uai.f- ornia, and particularly described as foliows:- Co—encing for the same at the center line of Lincoln Avenue with the south line of Forrest Avenue,(formerly Woodbridge Avenue), and running thence south on and alor said center line and its poutherly production to the intersection of said production with uhe north line of Lockeford Street; thence ''desterl on and along the north line of Lockeford Street to its intersection uritis the ::est boundary of the corporate limits of said City thence north on and along said boundary, line to its intersection with the south line of Forrest Avenue; thence east on and along said south line of Forrest Avenue to the point of beg -11 -Ming. Provided nevertheless- that the railway line, and railway right- of-vay,streeis,avenues ant alleys situated 7ithin said district shall be omitted from any assess::.ent made or levied to pay the dwn- ages, cost and expenses of the above-mentioned work and imnrove- ment; the said streets avenues and alleys belonging to saia Cit and being in use for tie erfornance of a public farsction,to-Ti?, i1 use as public streets,venues and alleys.
