The minutes of the regular meetine 0'- ay 21st,/the regular
adjourned meetings of May 28th and 29th as readby the clerk were
approTed after the correction of a typographical e_ror in the minutes
of May 21st by inserting record of the passage of Resolution of
uD) Award 401 in the matter of the improvement of Stockton Avenue at
Page 460.
L....',T ilinson verbally petitioned the Board for permission

uent ao as to allow consultation with the City Attorney.
John Sauer asked the 3oard to a^propriate .31,000 for band
concerts and on motion of Trustees Mettler andHickok the sum of
$650.00 was set aside for band concerts; Trustee Spooner Toting No;
Trustee Shattuck not Toting.
On complaint of ..Gillette that to S.2.engines were doing
such unnecessary whistlinz,the Clerk was directed to take the
r^a:ter up with the 3iTisionSuperinten.ent of that Company.
This 'being the date set for the reception of sealed bids on
wire for the line to the sewage kiseoral slant, the following bids
were received, opened and read:- price per Hundred ouoted:-

anded '3.P.; ;20.00 on solid bare and ?20.50 on solid stranded.

It appearing that the bid of Baker-Joslyn Company was the
best bid received .:e 3oard awarded the contract for the supplying
of the wire ordered to that company b,'7 the passage of Resolution of

the storm drain; Superintendent Henning reported that he had made
efforts to repair the dama=ge anddid not consider that there was
any chance of injury to the highway.
The Railroad Coamission of the State of California wrote
the Bowed that inspection of the City's electric lines would be
made at :he City's expense until the same were in the condition
req::ired by law.
Reports of tae Marshal & ?oundmas ter were read and ordered
filed.
Ordinance No. 141 having been regularly introduced on May
21st. ,1923 was finally passed by the following vote: -

paid on motion of Trustee Mettler.
In matter of the neglected -'ar'fed spaces on North_ Central
Avenue; the Clerk was instructed to notify interested property
owners that they should live up to their agreement made when these
sp.aees were o.:ii :ted from the improved area.

The regular meeting of the Board of Trustees of the City of
Lodi for the third Monday in June was called to order at 8
o'clock P.M. ; President J.W.Shattuck presiding; Trustees
r.O.Hale, A.D.Hickok, Jno. Mettler Jr., W.A. Spooner and
J. W. Shattuck present, none absent
The minutes of the regular meeting of June 7th,
1923 were read and approved without correction
There being many of the citizens of the City in
attendance , the Board departed from the usual order of
business at this point, passing to the head .of :

VIOLATION OF ANY OF THE PROVISIONS OF THIS ORDINANCE" hating
been introduced May 21st,1923 was called up for consideration
at the order of the President and after speeches for the ord-
inance by Mr C.C.Woodciorth of the Local Health District, Mr
J. S. Montgomery of the Lodi Business Men's Association and..
Rotary Club, Mr. J. C. Bewley of the Realtor's Association,
Mr. S.S.Murphy of the Minesterial Association, Emerson B. -
Herrick of the Lion's Club, and Mrs A. V. Friedberger for
the Woman's Club, the same was introduced for -passage an
motion of Trustee Hale, seconded by Trustee Hickok. The said
Ordinance No. 142 was then adopted and -passed to print by
the following vote
AYES: Trustees, Hale,Hickok,Mettler,Spooner and
Shattuck.
NOES: Trustees, None.
ABSENT: Trustees, None.
ORDINANCE, NO. 143 "ORDINANCE REG3ULATING THE PRODUCTI-
ON,PASTEORIZING,'IIMFACTURE,DISTRIBUTION AND SELLING OF MITI
AND CREAM OR MILL PRODUCTS WITHIN TIM CITY OF LODI, STATE OF .
CALIFORNIA, PROVIDING FOR THS� VIOLATION OF ANY OF THE PROVIS-
IONS OF THIS ORDINANCE" having been introduced May 21st.,1923,
was also brought up by order of the Presidept ,'and after a
lengthy discussion by W.F.Meeske against inspection and Dr`,
Nathan Sinai for the same, said Ordinance No. 143 was int-
roducgd for passage by Trustee Hickok, seconded by Trustee
Spooner and adopted and ordered printed by the following vote:
AYES: Trustees, Hickok,Spooner.Ma ttler,Hale,Si:attuck.
NOES: Trustees, Done.
ABSENT: Trustees, None.
Trustee C.C..400dworth of the San Joaquin Local Health
District thanked the Board on behalf of the District for their
donation of $200.00 for the furnishing of the local health center.
The Clerk read a communication from Dr. J.J.Sippy, County Health
Officer also tendering thanks for the gift.
In the matter of the improvement of Washington Street,
as undertaken under Resolution of Intention No. 63: nb�protests-
having been filed after the publication and posting of the said
Resolution of Intention, the Board passed Resolution Ordering
the Work No. 406 by the following vote: -
AYES: Trustees,Hale,Hickok,Mettler,Spooner,Shattuck.
NOES: Trustees, None.

RESOLUTION ORDERING THE WORK
Washineton Street
RESOLVED, that whereas the Board of Trustees of the City
of Lodi, did on the 21st day of May, A.D. 1923, pass its Resolution
of Intention No. 63, to order the hereinafter described work to be
done and improver._ent to be made in said City, which Resolution of
Intention was duly and legally published as required by law, as ap-
pears Prom the affidavit of publication in The Lodi Pews made by
Delmar B. Rir_fret, now on file in the office of the City Clerk of
said City of Lodi; and whereas, notices of the passage of said Reso-
lution of intention No. 63, headed, "Notice of Improvement", were
duly'and legally posted along the line of said contemplated work and
improvement and in front of all the property liable to be assessed
therefor, and on each and every street and highway in the assessrent
district described in said Resolution of Intention, in time, form,
r:.anner and nunber as required by law, after the passage of said Reso-
lution of Intention, as appears from the affidavit of F. Christesen,
who personally posted t'' ^e sare, and who, upon the completion of the
posting of said notices, filed said affidavit in the office of said
City Clerk, =king oath that he completed the posting of said notices ,
on the 29th day of 1,ay A.D. 1923; and whereas, no protests or.objec-
ticns in writing or otherwise to the proposed work,' or against the
extent of the proposed district, have been delivered to, or presented
to, or filed with the Clerk of this Board of Trustees of said City of

A diagram delineating the lands to be taken and outlin-
ing the district to be assessed to pad* for the some in the matter
of the opening of Hutchins Street was presented by the engineer
and a proper resolution of intention in this matter having been
prepared by the City Attorney, Mr Glenn West, Resolution of Int-
ention No. 64 was passed and adopted by the following vote; -
AYES: Trustees, Spooner,Mettler,Hale,Hickok,Shattuck
NOES: Trustees, None.
ABSENT: Trustees, None.
RESOLUTION OF INTENTION N0.64.
RESOLY?J,T'r_at the public interest and convenience
require, and it is the intention of the Board of Trustees and
City Council of the City of Lodi to order the following work
to be done and the following improvement to be made in said
City, to -wit:
That a public street shall be opened between the
north line of Lockeford Street, in said City, and the south
line of Daisy Avenue, in said City, said street to be sixty feet
in width and to lie thirty feet upon each side of a certain
line, which is described as that part of the west line of
Section 1, Townshipt 3 Borth, Range 6 Last,!..D.B.& ;...,lying
between the said north line of Lockeford Street and the said
south line of Daisy Avenue in said City; the line so described
being the center line of the street so to be opened.
Excepting that part of said sixty foot strip of
land which lies within the right of way of the San Joaquin and
Sierra Nevada Rail Road, being the railway line running from
Lodi to Woodbridge in the County of San Joaquin.
The land necessary to be taken therefor is partic-
ularly described and bounded as follows, to -wit:
That certain strip of land sixty feet in width bounded
on the south by the north line of said Lockeford Street, on the
north by the south line of said Daisy Avenue and lying thirty
feet on each side of the center line of said street so to be
opened, as above described, except.that part of said land lying
within said railroad right of way.
The exterior boundaries of the district of lands to
be affected and benefitted by said work and improvement, and
to be assessed to pay the damages, cost, and expenses thereof
are as follows:
All that certain district and lands lying within the
corporate limits of said City of Lodi. County of San Joaquin,
State of California, and particularly described as follows:
Commencing for the same at the intersection of the
center line of Lincoln Avenue Mth the South line of Forrest
Avenue (formerly Woodbridge Avenue) in the City of Lodi,Calif-
ornia, and running thence south on and along the said center
line and its southerly production to the intersection of said
production with the north line of Lockeford Street; thence
westerly on and along the north line of Lockeford Street to
its intersection with the west boundary of the corporate limits
of said City; thence north on and along said west boundary line
to its intersection with the south line of Forrest Avenue; thence
east on and along said south line of Forrest Avenue to the point
of beginning.
Provided,nevertheless, that the railway* line, and
railway right of way, streets, avenues and alleyssituated within
said district shall be omitted from any assessment made or
levied to pay the damages,cost and expenses of the above men-
tioned work and improvement, the said streets,avenues and
alleys belonging to said city, and being in use for the perfor-
mance of a public function, to -wit, in use as public streets,
avenues and alleys.
The Lodi hews is hereby designated as a tri -weekly
newspaper published and circulated in said City in which the
Street Superintendent's notice of the passage of this resolution
shall be published, there being no daily newspaper and no weekly

newspaper and no semi-weekly newspaper printed or published in
said City, and it is hereby ordered that said superintendent's
notice be published in the newspaper so designated, three times
a week for at least four successive weeks, and said street
superintendent shall post said notice as required by law.

The Clerk read letters from the following:
A letter in answer to one written asking cost of the serv-
ices of an engineer from the State Railroad Commission to invest-
igate power rates, stating that a representative of the commission
would call upon the Board shortlys
An invitation from the rodeo association at Livermore inv-
iting the Board to be presents
A letter from Division Superintendent C.E.Gaylord of the
S.P.Company. enclosing copy of bulletin asking engineers to use
minimum of whistling in the city*
Report for the past year of the Lodi Volunteer Fire
Department enclosing equipment inventory submitted by the sec-
retary Wm. H. Faust;
Report of the Fire Chief of activities of the department
during the past year;
A proposition from the Trustees of Lodi Lodge No.Q.
K of P tendering their lot on Nest Pine at a price stated therein,
for a City Hall site;
A letter from Marwick,iditchell & Gompany, public account-
ants in regard to an annual audit.
All the above were ordered filed without further action.
On motion of Trustee Mettler, seconded by Trustee Hickok,
the Clerk was directed to advertise for the annual printing.
