Monday, April, 23-1923.
Pursuant to adjournment taken from the regular meeting of Apr-
il l6th, th Board of Trustees of the City of Lodi met in adjourn-
ed regular session at 8 o'clock P.M. and on call of the roll,
Trustees,ale, Hickok, Mettler, Spooner and Shattuck were present.
The minutes of the regular meeting of April 16th were read and
approve d
This being the date set for the reception of sealed proposals
for the contract for the improvement of Hutchins -Walnut Streets
as undertaken under Resolution of Intention No. 61 and it appear-
ing that due publication and posting of notice thereof had been
had, the Board proceeded to publicly open and declare the`.prop-
osals received; the proposal of Clark & Henery Construcjrion Co.
being the only bid received, they bidding as follows: -

Conc.Gutter per squ ft 00.25
Award was then made to Clark & Henery Construction Company by
the passage of Resolution of Award No. 394 by the following vote: -
AYES: Trustees, Spooner, Mettler, Hale, Hickok, Shattuck.
NOES: Trustees, None. ABSENT: Trustees, None.

WHEREAS, the Board of Trustees of the City of Lodi, did, in -
open session, on the 23rd day of Anril,A.D.1923, publicly open
examine and declare all sealed proposals or bids for doing cert-
ain work in said City, under and in pursuance of the "Improv-
ement Act of 1911", the names of the streets and highways prop-
osed to be improved and the location and character of said work
and the district to be assessed therefore being described in
Resolution of Intention No. 61 , which Resolution is hereby
expressly referred to for further oarticulars,-
RESOLVHD, that the said Board of Trustees hereby rejects all
of said proposals or bids except that next herein mentioned,
and hereby awards the contract for doing said work and improv-
ement to the lowest responsible bidder, viz:- CLLR? & HENERY CON-
STRUCTION COMPANY at the prices named in its bid. The City Clerk
is hereby directed to post notices of this award conspicuously
for five days, on or near the chamber door of this Board of
Trustees and also publish said notice three times in "The Lodi
News", a tri -weekly newspaper published and circulated in said
City and hereby designated for• -that purpose by said board.
33 IT YURTHER RESOLVED, that notice be given and is hereby
given that serial bonds to represent unpaid assessments and bear :..
interest at the rate of seven per cant per annmm, will be issued
hereunder in the manner provided by the Improvrurnt Bond Act
of 1915, the last installment of which bonds shall mature nine
years from the 2:-d day of July next succeeding nine months from
their date.
Mr 0.H.67ood presented a petition sired by owners of prop-
erty on Central Avenue South rf the present termination of the
pavement thereon, asking that no action be taken tword-the
improvement of this portion of Central Avenue "until the usual
petition by the property owners is filed"
The application of Ada J. ?airchilds for water and sewer
service extension to the SW corner of Lot 5, Lodi Barnhart
Tract, was referred to Mr. J. A. Henning, it appearing that
the cost would be excessive in porcortion to the party served.
Ordinance No. 139, "An 0 rdinance Repealing Subdivision 3,
Section 2, of Ordinance ro. 38" was given final reading, passed
and ordered to print on motion of Trustee Mettler:
AYES: Trustees, Mettler, Hickok, Hale, Spooner, Shattuck.
Three building permits a-gregating :A,775.00 were granted.
G. M. Steele presented his resignation as City Attorney
effective Llay lst.,1923 -end on motion of Trustee Mettler the same
was aoceDted.
Trustee Hale introduced Resolution No. 395 and the same
was adopted by unanimous vote: -
RESOLUTION NO. 395
Resolved by the Board of Trustees of the City of Lodi:
That Mr Glenn ;'lest be appointed to the vacancy caused
by the resignation of City A-torney G.U.Steele, said appoint-
ment to be e:fective from and after liar .lst. 1923
Trustee Hickok authorized the Clerk to advertise for
-.aterial necessary to build a power transmission line to the
site of the sevrage disposal plant by introducing Resolution
No 396 which eras unanimously adopted.
?ES"LUTION NO. 396.
Resolved by the Board of Trustees of the City of Lodi:
That the City Clerk be, and he is hereby authorized and
directed to advertise for bids for material necessary to construct
an electric transmission line from the tsrmonation of the City's
lines to the site of the Sewage Disposal Plant.
-SDecifications and quantities of materials to be furnished
will be supplied by the Superintendent of Public Utilities.

President of the Board J.!V.Shattuck announced that the
driver of the fire truck. H. E. Balls, had tendered him his
verbal resignation. asking to be relieved May 1st.,; on motion
of Trustee Mettler. the position was offered to M.3.C'r_annel,
-- he having applied for same some months previously.
In the matter of an increase in salary allowed Earshal
and Street Superintendent F. Christesen. the following Ord-
inance was introduced: -

The•Board of Trustees of the City of Lodi do ordain as
follows: -
That from and after the aig'r_thda7 of June, 1923 the
salary and allowances made the City ".Marshal shall be as here-
in set forth, the some to be in fall for services: -
Por Salary as Marshal. the sum of ........ 150.00 *"*
For Salary as Street Superintendent....... 125.00
As allowance for use of automobile........ 50.00
This ordinance shall be published once in "The Lodi
Nszs" and shall take effect and be in force as provided by
law.
On motion of Trustee Hale, the above ordinance was ord-
ered laid over for not less than five days.
On motion of Trustee Spooner, seconded by Trustee Hale,
the City Engineer and Superintendent of Public Utilities were
authohized to install storm drains on Walnut Street, Crescent
Avenue to ?dose Street in preparation for the paving of the
former thouroughfare.
Trustee Mettler stated that in raking the motion to
accept the resignation of City Attorney G. M. Steele, he had
desired to incorporate in the same, a resolution extending
the thanks of the Board to Mr. Steele for his years of service,
and that at this time he desired to submit the following
resolution to,the Board for their consideration and adoption:

"ifi]:?3'A,S, Lir. George martin Steele has served this City
as City Attorney since the 21st day of April 1916 and has faith-
fully rendered unto this Board and unto its predecessors in
office, the full measure of his legal knowledge without stint or
denial, serving for nearly five years at a salary ill comensurate
with the duties imposed upon him by the heads of a rapidly grow-
ing City, undertaking the devious routine prescribed by law in -
the matters pertaining to bond issues, street improvements, annex-
ation proceedings and the multiferous concerns of ordinances
and contracts for public work;
AND 5'IH ELS, Mr. Steele's private practice has now made
such demand upon his time that he cannot longer serve in the
office that he has so long filled;
BE IT RESOLVED, by this Board of Trustees, assembled in
open meeting this 23rd day of April, 1923; t'rat,in losing the
services of Yr Steele this Board has lost a valued adviser and
co-worker and the people of Lodi a servant worth far more to
them than many times the sums paid him in the past.
BE Il ALSO RESOZY D, that this resolution be spread in
full upon the minutes of the meeting at which same is adopted.

on motion of Trustee Hickok, Superintendent Henning was
instructed to apply a coat of graphite and oil paint to the roof
of the municipal baths.
On motion of Trustee Spooner the Board adjourned to the _.
