Monday, April 16th.,1923.
The regular meeting of the Board of Trustees of the City
of Lodi for the third Monday in April was called to order at 8
o'clock P.L:. on the date first above written, President J.:'i.Shat-
tuck presiding, all members present:
The minutes of the adjourned regular meeting of April 9th
were read and approved.
No hearings were had under the head of Public Hearings and
Protests and the Clerk reporting no communications on his desk,
both of these orders of business were passed .
Resolution No. 391 entitled "RESOLUTION ESTABLISHIING GRADES
ON PORTIONS OF STOCKTON AVENUE IN THF"'.. CITY OF LODI, CALIFORNIA"
was introduced, passed and adopted by the following vote: -

RESOLUTION ESTABLISHING GRADES ON PORTIONS OF STOCZTON
IN li" • CITY OF LODI, CALIFORNIA
RBSOLT. D, That on Stockton Avenue, south of -okay Street
in the City of Lodi, California, between the southerly termination
of the present pavement or. or near a line 221 feet southerly from
and parallel to the northerly line of Lot .cumbered 57 of the Lodi
Barnhart tract, as said Lot is shown on that certain Wap entitled,
"Lodi Barnhart Tract," and recorded in the office of the County Re-
corder in Vol.3 of Iaps,'at page 48, San Joaquin County Records,
produced westerly across said Stockton ,",venue; and the Northerly
line of Vine Street in said City of Lodi, at the respective points
of intersection of the east and west curb lines of said Stockton
Avenue, as hereinafter fixed and specified with the hereinafter men-
tioned lines of the intersecting streets, the curb grade and eleva-
�ion are hereby established as follows:
7.ith the South end of the present curb, curb elevation 46.55;
With the north line of :Maple Street, curb elevation, 45.75;
With the South line of ;::aple Street, curb elevation, 45.75;
ith the North line of Lots Numbered ?if ty-four and Sixty-eight
of said Lodi Barnhart Tract, curb elevation, 46.35;

The figures above shown are elevations in feet and deciral
fractions of feet and such elevations and the grades herein refer-
red to have reference to the height above the "base of levels or
elevations" for the City of Lodi, whi th base is a leve'_ plane fifty
feet below the center line of a certain aluminum tablet placed in
the . est gall of the Van Buskirk Building, situated at the South-
east corner of Pine and School Streets, in _ aid City, which tablet
is -arkad "U.3.Geologioal Survey, 3.:.," and which "base of levels
or elevations," was established and determined and is farther de-
fined in and by 3ec.5 of Ordinance No. 67 of the Said City of Lodi.
The grade of the respective curbs on each side of said Stockton
.:venue, outh of Tokay Street in said City of Lodi, shall be uni-

That Stockton Avenue, in said City

Tract, as said tract is shown on that
certain map entitled "Lodi Barnhart
Tract" and recorded In the office of
tae County Recorder in Vol. 3 of flaps
at Page 48, San Joaquin County Rec-
ords. produced westerly across said
Stockton Avenue, to the aertberly Ilne
of Vine Street, including all street and
alley crossings, terminations and op-
posite terminations within said limits.
BE IMPROVED:
(1) By grading the roadway and
curb and gutter spaces of said portion
of Stockton Avenue.
(21 By constructing hydraulic con-
crete cur�•s and gutters of the com-
bined type along each side of the road-
way of said portion or said Stockton
Avenue.
(3) By paving the roadway of
said portion of S•tacktan Avenue be-
tween the gutter lines, with a pave -
meat consisting of one and one-half
(11A) inches of Warreaite Wearing
Surface laid on an asphaltic concrete
base two and one-half (2%) inches In
thickness.
Excepting, however, from all of the
hereinabove described work such por-
t!ous as are required by law to be
kept in order or repair by any any
person or company having railroad
tracks thereon; and excepting also
from all of the hereinabove described
work, any of said work already done
to the official line and grade.
All of said work shall be done In
accordance with the plans and speci-
fications heretofore adopted for doing
;s.!d work and now on file in the office
of the City Clerk of said City of Lodi.

Warrenite License Mixture Agree-
ment for California. executed by
'Warren Brothers Company the own-
ers and holders of united States
Patents covering the said Wtirrenite
pavement. on February 190, 1923,
which agreement Is on file in the
office of the City Clerk of the City of
Lodi, and which is hereby expressly
referred to for greater certainty.
And said Board of Trustees does
hereby determine and declare that
said proposed work and improvement
is of more than local or ordinary
pay Ilc benefit, and will affect and
benefit the lands and district herein-
after described, which said district is
hereby declared to be the district
benefited by said work and improve-
ment, and to have the exterior boun-
daries hereinafter described as 'the
boundaries thereof; that, therefore,
the entire cost and expenses of said
work and improvement shall be, and
are hereby made, chargeable against,
and shall be assessed upon said lands
and district, which district is within
tha City of Lodi. County of San Joa-
quin, State of California, and is par-
ticularly bounded and described as

the Improvement Bond Act of 1915,
and Acts amendatory thereto, the last

This Resolution of intention is
adopted pursuant to the provisions of
these certain Acts of the Legislature
of the State of California, designated
respectively as the "Improvement
Act of 1911," and the "Improvement
Bond Act of 1915;' and Acts amenda.

objections to the proposed work or
Improvement may appear -before said
Board and show cause why said pro-
posed improvement should not be car-
ried out in accordance with this Reso.
lution.
The Clerk of this Board of Trustees
Is hereby directed to cause this Reso-
lotion of Intention to be published
three times in "The Lodi News," a
newspaper published and circulated
three times each week in said City of
Lodi and hereby designated for that
purpose by the Board Of Trustees,
there being no daily newspaper pub-
lished in said City.
The Superintendent of Streets shall
cause to be conspicuously posted along
the line of said contemplated work
sad improvement and in trout of all
property liable to be assessed, notices
of the passabe of this Resolution of
Intention, In the manner and form re-
quired by law.

President J. 'N. Shattuck asked that the Clerk be instructed
to prepare and present, on the first mestin? of each month, a
financial statement showing balances in the several funds from
which payments for cost of g6vernment are made. The Clerk stated
that tiis additional report could easily be made and would be
made if no money tivas paid into these Rands except on "pay -in"
orders from his office.
On notion of Trustee Hettler, sscor_ded by Trustee Spooner,
the offer of an unknown donor, proffered through the Presidsnt of
the Board, to paint the roof of the Baths at a cost of $214.00
;vas accepted.
Two building permits aggregating $600.00 were allowed.
The Engineer was instructed to prepare plans for installat-
ion of side-aalks on School Street from Elm to Pine and from School
to Church on fine.
