CITY HALL, CITY OF LODI
Monday, April 2nd.,1923.
The regular meeting of the Board of Trustees of the City
of Lodi was called to order at 8 o'clock P.M. on the date first y
above written , President J. W. Shattuck presiding, Trustees Hale
Hickok, Mettler, Spooner and Shattuck present.
The minutes of the regular meeting of March 19th were
read and approved without correction.
The Clerk presented the opinion secured by City Attorney
G ",;.Steele from Goodfellow, Hells, Moore & Crick in the matter of
proceedings had in connection with the proposed issue of $100,000
bonds for the sewage disposal plant; as this opinion asked that
a copy of the resolution describing the bonds be presented, the
City Attorney stated that he would prepare the same.
Letters from C.G.Gillespie, director of the bureau of
sanitary engineering, relating to the operation of the sewage dis-
posal plant and answers thereto made by the Clerk in the interim
between meetings of -the Board were ra-ad and approved. He was
directed to answer the last letter from Mr. Gillespie and state
that the Board had received the estimate of cost of operation from
their engineer and that, though the cost was considerably in
excess of their idea of the same, they would not deviate from
their previous assurance that the plant would be efficiently oper-
ated by competent operators.
A protest against the erection of a dance pavillion on
Seaton Avenue signed by forty residents of the vicinity was read
and it appearing that this matter had been discussed in several
of the local organizations, at the invitation of President, J. W.
Shattuck, several representatives addressed the Board, asking
that no permit be allowed for the erection or operation of this
structure. It appearing that the permit had been granted and that
operation could not be refused unless the pavillion constituted
a nuisance,City Attorney Steele euggested that the license tax
could be so raised that operation would not be profitable. Inform-
ation was volunteered that Mr Piazla, who proposed to build the
structure, had stated that if there was pronounced opposition, he
would not build it.
On motion of Trustee Hale, seconded by Trustee Spooner,
bills as audited amounting to $41,352.95 were ordered paid.
This being the date set in notice duly published, for the
reception of bids for the contract to construct the activated
sludge sewage disposal plant, the Clerk stated that but one bid
had been received and on the opening and declaring of the same,
the contract was awarded to Davis -Heller -Pearce Company by the
adoption of Resolution of Award No. 389 by the following vote; -
AYES: Trustees, Hale, Spooner, Hickok, Mettler, Shattuck
NOES: Trustees, None.
ABSENT: Trustees, None.

BE IT RESOLVED BY THE BOARD OF TRUSTEES Or THE CITY OF
LODI AS FOLLOWS:-

That the Board of Trustees of the City of Lodi, County of
San Joaquin, State of California, having in open session on the 2nd
day of Apri1;1923, at 8 o'clock P.M. of said day opened, examined
and publicly declared all sealed proposals or bids offered for the
following work:

and having received bids for the said work in accordance with the
Notice to Bidders made and issued by the City Clerk on the 16th
day of March,1923, and having taken the said bids under consideration
and being fully advised in the premises the said Board of Trustees
of the said City of Lodi on the 2nd day of April,1923, at 8 o'clock
P.M. of the said day hereby awards the contract for said work to the
I� lowest responsible bidder, to wit, H.Y.DAPIS, H.3.H3,LLr'R, and
J. W. P_,ARCL. doing business under the firm name and style of Davis -
Heller -Pearce Company, at the price named in their bid for said
work. they being the only bidders for said work; and
BE IT PURTH:-R 33SOLM that the contract be forthwith
executed with the said Davis -Heller -Pearce Company upon the filing
with the City Clerk a bond as provided in said Notice to Bidders.

and City Marshal were read and approved.
On Motion of Trustee Hickok, seconded by Trustee ;Mettler,
the retiring City Health Officer was authorized to turn over the
records of his office to the newly organized County Health District.
On motion of Trustee Spooner, Jos. Mayo was allowed the
sum of $25.00 additional per month for use of his automobile.
i On motion of Trustee Spooner, the Clerk was directed to
notify Mr 15.H.Faust who had applied for an increase dor the Tokay
band, that the amount was too large to allow at this time.
On motion of Trustee Mettler, the Board adjourned until
8 o'clock P.M. of April 9th.,1923.
