HomeMy WebLinkAboutMinutes - June 5, 1922CITY HAM,, CITY OF LODI, MONDAY, JUNE 5th.,1922 The regular meeting of the Board of Trustees of the City of Lodi convened at 8.30 P.M. on the date and at the place above written and, on call of the roll, Trustees Hale, Hickok and Mettler were pres- „ exit; Trustees Rich and Shattuck, absent both on account of illness. r- The minutes of the adjorned regular meeting of May 22nd were read and approved without correction. This being the date set for the reception of sealed proposals for the improvement of Locust Street, Oak Street, Cordier Street and -Rose Street and it appearing from the affidavit of the rrincipal clerk of the Lodi Sentinel that notices inviting the name had been published in time, form, manner and number as by law required, the Board proceed- ed to publicly examine and declare the bids received which bida,being identical in amounts=for each of the streets proposed to be improved, were as follows: - Bids for the Improvement of Locuet,Oak,Cordier & Rose Streets: WARREN CONST.CO. A. TEICHERT & SON. CLARK & }E2'ERY. -Grading $0.039 squ ft $o.o35 $0.02 Paving 0.1895 squ ft 0.1875 0.185 Gutters 0.28 squ ft - 0.35 0.26 Curbs 0.58 lin ft 0.50 . : 0.50 It being manifest that the bid of Clark & Henery Construction Company was the most favorable bid received, the Board proceeded to award that company the contract for doing the work ordered on the above named streets by the passage of the following "Resolutions of Award": - Co. RESOLUTION OF AWARD No. 286, awarding Clark & Henery Construct-. ion/the contract to perform work ordered on West Locust Street AYES: Trustees, Mettler, Hickok, Hale. NOES: Trustees, None ABSENT: Trustees, Rich, Shattuck RESOLUTION OF AWARD NO. 287, awarding Clark & Henery Construct- ion Company the contract to perform the word ordered on Oak Street AYES: Trustees, Mettler, Hickok, Hale. NOES: Trustees, None ABSENT: Trustees, Rich, Shattuck (minutes of June 5th.,1922 cont.) -` RESOLUTION OF AWARD NO.268, awarding Clark & Henery Const- ruction Company the contract to perform the work ordered on Cord- ier Street A'MS: Trustees, Mettler, Hickok, Hale. NOES: Trustees, None. ABSENT: Trustees, Rich, Shattuck RESOLUTION OF AWARD NO.289, awarding Clark & Henery Const- ruction Company the contract to perform the word ordered on Rose Street AYES: Trustees, Mettler, Hickok, Hale. NOES: Trustees, None. ABSENT: Trustees, Rich, Shattuck. This being also the date not in notice duly publishedin The Lodi Sentinel, and publication thereof in time,form,manner and num- ber being proven by proper affidavit,for the reception of sealed proposals for the purchase of the bonds issued to represent the unpaid assessments in the matter of the improvement of Stockton Street under Resolution of Intention No.35 and the Clerk stating that up to the hour set therein. no such proposals had been rec- eived, the Board proceeded to award the bonds issued and authorize the delivery thereof to the contractor by the passage of Resolution' No..283, AYES: Trustees, Hickok, Mettler, Hale. NOES: Trustees, None. ABSENT: Trustees, Rich, Shattuck. It appearing from proper affidavits that the Superintendent of Streets had filed the list of unpaid assessments on Lockeford Street and that notice of the same had been duly published and post- ed, the Board proceeded to find the amount of each assessment and the aggregate amount thereof unpaid to date by the ^assage of Res - r clution No. 284 AYES: Hickok, Mettler, Hale NOES: None. ABSENT: Rich, Shattuck. Resolution No. 285, describing and authorizing the issue of bonds to represent the unpaid assessments on Lockeford Street was r. then passed, r AYES: Mettler, Hickok. Hale. NOES: None ABSENT: Rich, Shattuck. Under the head of public hearings, Mr.R.IR.Mixer of the Pro- -gr essive Business Menlo Club, addressed the Board, asking their cooperation in Paving the Southern Pacific Company improve the vacant lot at the South-east corner Oak & Sacramento Streetsq he was assured that the Board would extend whatever backing that might be possible to the club in this matter. Mr Mikeegemp directed attention to the condition of the road - ray of S.Sacramento Street where the sprinkling wagons fill and also to the fact that the authorized lights had not been installed in Maple Square; the Street Superintendent was directed to remedy the street condition. F.J.Beaty protested against the noise of motor -cycles on Lodi Avenue and was informed that he should swear to a complaint so that the nuisance could be abated. The President of the Board and the Clerk were authorized to enter into an agreement on behalf of the City for a pipe -line cros- sing at the Woodbridge Road crossing of the Southern Pacific lines by the passage of Resolution No. 281, r AYES: Trustees, Hickok, Mettler, Haled, NOES: Trustees. None. ABSENT: Trustees, Rich. Shattuck. Reports for the month of June from the Poundmaster and City Marshal were read and ordered filed. The Clerk stating that Warrant No.13493 drawn in favor of A. Carlisle and Company had been lost in the mails, the President and Clerk were authorized to issue a duplicate, payment on the original having been stopped. On motion of Trustee Hickok, seconded by Trustee Mettler, the Clerk was authorized to sign a release of indebtedness in the matter _ of the liquidation of the affairs of H.T.Tretheway, the said release being in favor of the San Francisco Board of Trade and for the pur- rose of allowing a.pro-rata distribution of assets. , Ten building permits were granted; gross cost ,$28,.960740 On motion Trustee,Mettler bills amounting to $11,986.11 were ordered paid. In the matter of the proposed annexation of the "Northwest addition, a canvass of the votes cast was had at this time and it (minutes of Jun 5th,1922 cont) being evident from the result thereof that a majority of the qual- ified electors residing within the boundaries of the district prop- oeed to be annexed had voted against annexation, Trustee Mettler, seconded by Trustee Hickok and unanimously carried. moved that all future proceedings be abandoned. This being the first meeting of the Board of Trustees since the election on the question of the annexation of the "Southern Addition" to Lodt said election having been held on May 23rd.,1922, the City Attorney presented and had read a report from the officers of election stating fully as to the time and manner of conducting the election and among other things, the results thereof as ascert- ained by them from a canvass had of the ballots cast. The report was ordered filed and Trustee Hickok introduced RESOLUTION NO. 282,'"A ; PM:SOLUTION FINDING RESULT OF AN ANNEXATION ELECTION, which was passed and adopted by the votes of Trustees Hickok,Mettler and Hale; Trustees Rich and Shattuck, absent, none dissenting. The law requiring that the annexation of a district to the City be approved by ordinance, Trustee Hickok introduced Ordinance No. 132. ORDINANCE No. 132 AN ORDIP:ANCE APPROVING THE AF]NEXATION OF THE SOUTHERN ADDITION TO LODI On motion of Trustee Mettle-, the passage of the above Ordinance was deferred for not less than five days. A true copy of above cited Resolution No. 282 is as follows, reciting among other ratters concerning the election, the result thereof . ? SOLUTIO3i NO. 282 (minutes of Jun.5,1922 cont. being a continuation of recital of Resolution No.282) City Attorney G.M.Steele presented a draft of a proposed ordinance pertaining to the collection of garbage and refuse in the City but the some being un -acceptable to the Board. was referred back to Ur Steele with suggestions for its amendment in accordance with ideas brought forth by a some -nkat leng_%hy discussion of the natter. The Board went on record as apposing the adoption of certain initiatory amendments to the state constitution whereby the Citys of California would loose the right to grant franchises and be restrict- ed in the operation of publicly owned power enterprises by the adoption of Resolution No. 290 AYES: Mettler, Hickok, Hale. NOES: NONE Absent, Rich, Shattuck. On motion of Trustee Hickok. the Board adjourned to Monday. June 12th.,1922 at 8 o'clock P.M. Attest: � Clerk.
